  1. quick summary of events and thoughts, would welcome peoples thoughts and if i am right in what I am thinking. total minefield this Work Issues. Thursday 24th June 2010 Manager texted; 6.22pm Hi Andy, I’ve been trying to call you, please be at AVC Warrington tomorrow morning at 0900, I’m not going to be on my phone a while so can you please text me to confirm you have received this and will be attending, thanks First of all this was my day off and I had only one missed call from Paul during the day. I tried calling him various times and also texted him during the evening to find out why I was required to be there, was if for a meeting or training ? On arrival in Warrington Friday 25th June 2010. I was met by Manager and informed I was there for an investigatory meeting. If I am correct ACAS guideline stipulate that “It is not always necessary to hold an investigatory meeting (often called a fact finding meeting). If a meeting is held, give the employee advance warning and time to prepare.” After the meeting I was informed that this may led to further disciplinary action. In the evening I tried to call Paul Rowlands to find out why I had not received any work for the following day, again he who not answer the phone or respond to my text messages. I have to contact another manager via text message who called me within 10minutes to say that I had been suspended until further notice. I hadn’t received any communication directly from my manager or a company HR employee informing me of this. Is this another breach in ACAS Guidelines ? I had correspondence or communication from the company until 10.55am Monday 28th June 2010 when I received a telephone call from HR asking why I had attended a meeting schedule for 10am the same day. I informed them that I was still waiting to hear from them regarding the investigatory meeting and formal notice that I was suspended. He stated that I was sent a letter to my home address on Thursday 24th June 2010. I said I hadn’t received such letter, (surely they should have sent it recorded delivery, is this a breach in ACAS guidelines). I was then told I could come to the office, read the letter and have it dealt with there and then. I let them deal with matter there and then as I knew what the outcome was going to be. I was informed that I could have a work colleague there as a witness. I would be right in thinking now, they have breach further ACAS Guidelines for not giving me ample time to form a defense case in relationship to the allegations. To date I haven’t received formal notification of my dismissal. Would this constitute unfair or wrongful dismissal on grounds of procedures not being followed
  2. I have just received that dimissal letter from work today, am i right in thinking that I was supposed to sign the minutes and agree to them before leaving the company as these are not signed
  3. apparently they will be talking to him again as somethings he said didnt tally up with what i was saying. in the mean time he has continued to work. I have said that I will be appealing, and putting in a grievence about my manager for bullying. just need to find a way to copy text messages from my works mobile so i can use them as evidence. i really think i have been stitched up at work over this whole matter
  4. no he didnt, but they said at the end of the day it was my decision to do the job the way i did. i will try and post the minutes from the meeting later on today.
  5. can i make a Subject Access Request request or similair to find out exactly what information is being held about me to use in an appeal
  6. I have worked for them for about 3years in total, we transfered over via TUPE over 2 years ago. yes i now have a copy of the update as mention in above c)
  7. right been to Warrington for my meeting, it was a disciplinary after all, and the outcome was dismissal. just a few things i need to run by people. a) I was notified by text message that I was to be at our regional office for 9am the following with no explaination. after regarding through some stuff from the acas website, i came acroos the following It is not always necessary to hold an investigatory meeting (often called a fact finding meeting). I explained that I hadnt been informed of this meeting and that I had had no correspondance from the company what so ever since thursday 24th. They were adamant it was sent. I was told i could go to office this afternoon, read the letter and corresponding documentation and it could be dealt with there and then. now today is actually my scheduled day off, are they allowed to acually call me in for a disciplinary on my day off c) they also produce a document that was descibed as Revisions to the disciplinary procedures regarding health and safety related disciplinaries, september 2009. in that there is a section which reads "where an employee is found to have carried out work on a roof top without the appropriate equipment and/ or processes being followed, the likely outcome will be dismissal. now i can honestly say that i have never ever seen that update until today.
  8. i would say that it was a joint job, the thing that really gets me is, my boss new about this incident, weeks ago and still had me working on heights work since then
  9. not sure, i have been doing the job the longer than him, but havent done the special heights work before. I was trained in january and didnt do my first job until 13th May
  10. i was suspended for a breach of health and safety, which i have admitted. on the day inquestion I was working with a more experienced engineer who hasnt been suspended. They have already had an investigatory meeting, which i never had time to prepare for as I received a text message at 7pm asking me to attend warrington for 9am the following day. so i think this must be for a disiplinary
  11. I am about an a hour or so drive away. I would be prepared to travel to the meeting today, but i feel that I havent seen this letter or any statements relating to this, so I havent had time to prepare for this meeting, this being the case. If I was sacked, wouldnt it be deemed as an unfair dismissal
  12. I have just been phoned by my HR department in Warrington wanting to know why I havent attended a meeting this morning at 10am. I explained that I have had no communication with them at all since the investigatory meeting last thursday. I was informed that a letter was sent out to my home address on the 24th (thursday), which i have never received. He then stated that I could go to Warrington today read the letter and if I was happy they would continue with the meeting. urgent advice needed, god i am bloody shaking typing this
  13. another update, postman has been this morning and still no formal notice of suspension and the official reasons why and when I am supposed to be suspended to. also no emails or phone calls, this is day 5 now help anyone please, acas rules seem a little vague on this
  14. well just had an interesting phone call from the lad who works with me on the heights work (safety Man) that he has been allocated work for tomorrow, so it would appear strange, considering we work as a team, I would certainly think that he would be suspended also, but appears not peoples thoughts would be most welcome
  15. postman been and still no letters from the company Sidewinder, i agree totally with what you are saying, the problem we have is figures, our manager is constantly pushing us to complete more work. they have increased out completion figues from 92% in march up to 95% now. we constantly get text messages informing us on the consiquences if we dont reach targets. that was the main reason I lost forcus on he job, and was concerned in completing it for my figures
  16. Hi BigRedBus, yes I have the minutes of the meeting, very short in brief to be honest, the only thing it says on the bottom is basically that this may lead to disciplinary action being taken. I signed there copy of the minutes, but mine where not signed that I brought away
  17. Hi BigRedBus, thanks for the reply, if they were supposed to have informed me by the end of the investigatory meeting, then it should of been minuted also. is that 100% correct
  18. i have looked, but cannot seem to find anything regarding this, i was wondering if anyone would know for sure
  19. well its now 6.20pm and i have had no contact today from my company regarding the suspension, no letters via mail, no emails, no phone calls and no text messages. can this be right, surely the have to by law provide this in writing before now

Hi HB and thanks for the reply, Regarding the training, just checked my details, I did what we call a special heights course on the 21st and 22nd of January this year and didnt actually carry out my first job requiring the skills until May 13th. I stressed at the time that I hasnt happy and didnt want to do this work. But was informed that I had to do this kind of work. They found out after my manager had to visit the customer regarding a damage claim caused by my collegue. Since the incident, I have work various other days working at heights as a 2 man team. What I cannot understand is why have they let me continue working at heights. Up until the investagatory meeting yesterday, surely if there was an issure, wouldnt they have a duty of care to remove me from that type of work, so i would be a risk as such. sounds like I am waffling along, sorry
  22. I thought, i should of been informed in the meeting and it being logged in the minutes of the meeting, the meeting ended at 10.25am this morning. I found out this evening around 7pm. they had plenty of time to contact me. basically we work as a 2 man team, an operator and a safety man. I was working on a pitched roof without the full H & S equipment in use. I left my ladders and walked up the roof before throwing a rope around the chimney and attaching myself to said rope. I have to admit it was my first time doing this job as a 2 man tean. I did my training in I think feb / march time this event occured in the second week of may. I also expressed my view to manager that I didnt want to do this kind mf work. But all they seem to be bothered about are figures. The other person with me is on weekend off now, no one has contacted him, so he doesnt know if he is in the same muck as me. Considering this happened a few weeks ago, they have still had me work in a heights team for 2 days in the last week. hope this makes sense

I was given minutes of the meet, their copy was signed by the 3 of us, but mine wasnt signed. I thought I should of been informed prior to attending the meeting what it was about and the reasons. but i aint a lawyer, just hate the way I am getting treated
