  2. Hi, I have a 16 month iPhone 5s, on the three network, and until recently the battery on the phone was ok at best. However, more recently I have noticed that my iPhone will power itself off when the battery power is low. I have noticed the battery power at 38% and it has done this. It would also turn off if I had around 10% power and I attempted to use the camera. Anyway, the only thing I could think of that had changed was an update to the IOS that could potentially cause this. I tried to phone three uk today but their system was not available so I could not speak directly with someone. I managed to have a 4 hour conversation with three uk via a series of tweets and when I eventually explained to them that the phone battery was not working as I expected it to they asked me to contact apple directly. I replied back saying The Sale of Goods Act makes reference to 'the seller', this is the shop, the retailer, or the individual you bought it from, and this is who you made the contract with. They replied back and said that three's policy does not cover device faults and sent me a link, http://support.three.co.uk/srvs/cgi-bin/webisapi.dll?command=new,kb=mobile,ts=mobile,t=article,varset_cat=billing,varset_subcat=3772,case=EXT(EM36278) The fault has, as yet, not been identified, so the question I have is, am I being fobbed off and is there anything else I can "tweet" back to three uk to try and progress this? thanks in advance Miffed_With_Mobile
  3. Hi all, I have a question relating to a fine issued for a contravention of being in a bus lane. I will detail what has occurred up to now. At the beginning of September I received a Charge Certificate for the amount of £90 from Reading Borough Council. It said I owed them this amount because they had not received the full payment of the Penalty Charge within 28 days of issuing it. I knew nothing about the Penalty Charge Notice as I had never received one in the post. On the advice of the Citizens Advice Bureau I wrote a letter to Reading Council enclosing the charge certificate. The letter stated: I am disputing the charges levied in the attached Charge Certificate because, as such, the procedure for issuing the Penalty Charge Notice was not carried out correctly as I have never received any Penalty Charge Notice. On the 30th October I received a letter back from Parking Services. The letter is pictured below. I hope you can read it. [ATTACH=CONFIG]47493[/ATTACH] I am willing to pay the £30 as I was definitely in Reading that day, at the time, and remember being lost at one point so it is possible that I did drive in a bus lane. I have tried to call the CAB for advice but had to hang up after 30 mins of waiting as my lunch break was over and I had to get back to work. I have a few queries relating to this charge. Should I just pay the £30? Do I have any basis to dispute this, and if so, does anyone know how? I was considering disputing this letter as the correct procedure still had not been followed. I have still not seen a PCN nor any evidence that I have committed any offence at all. If there are any people with similar experiences or any advice that could help that would be brilliant.   5. Thanks all, i truly wish I could just do my old job as normal and can't understand why I should lose out financially because of someone elses mistakes. Also, the things that he was guilty of would shock any decent human being and i don't feel justice has been done. In fact I would go as far to say that the company have protected the manager and i believe they are effectively promoting/supporting bullying and that really doesn't sit right with me. I feel like my career is going to be limited here anyway so what have I got to lose?
  6. Hi, I don't feel like I should resign. I have gone through all stages of the grievance procedure and all I got was an apology! The reason I want to take this further now is I don't feel the company have given my complaint enough weight and ultimately I am the one who is at a detriment now

Hi becky, I want to bring a claim against my manager for bullying and harrasment and my initial grievance also stated that the company could and should have done something to protect me and I am citing a breach of health and safety with reference to the bullying as he had already been disciplined about his behaviour. I was signed off sick in June of last year relating to this bullying and was advised to put in a grievance which I did. I was, at the time unaware of any timings relating to a tribunal and I initially submitted the grievance in October and it was officially completed in April this year. Anyway, if you are saying that a tribunal is not the correct place to try and get this resolved, do you have any other advice for me Thanks

  9. Hi all, I have had a grievance appeal rejected by my company which I raised against my line manager for harassing and bullying me. I cited a direct breach of the protection from harassment act 1997 and gave them a folder full of evidence and witness statements to the appeal hearing. They reconvened several weeks later and said they would be dealing with he manager internally and put his behaviour down to his management style. They informed me that I would be given a new role, which I have no relevant experience in, and I would now report directly to the general manager. As far as I can tell I have been left worse off after making a genuine complaint. I used to work as part of a 2 man team who used to provide 24-7 support every other week and used to get at least 22 hours extra pay every month and that was before anyone had called us. I am now sitting at a desk with little to do feeling utterly miserable and dejected. The company have also very kindly sat me next to my old manager which I suspect has been done on purpose. Does anyone have any recommendations about how I should progress this? I know I am outside of the 3 months less 1 working day timescale to register an employment tribunal but I believe that as I cited a breach of the protection from harrasment act 1997 I may have a much wider timescale in which to pursue a civil court case. Does anyone have any prior experience of this or are you able to offer me some practical advice as to what to do next I would be extremely grateful! Cheers Miffed
  10. Hi Sam, went back to the dealer and he gave me a full refund and didn't argue at all. Thanks for all the help and advice given. I am off to look for another new car....again and this time I am taking my RAC man to inspect the car!!!
  11. just spoke to the garage owner and all he would say is that the car was sold to me as a part exchange to clear with 129,000 miles on it and questioned why I took it to Honda. I told him because the turbo failed and he said that Honda were just touting for business by saying that it was faulty and that other things were wrong with the car. I said a major oil leak doesn't sound like they were touting for business. He remarked well they probably just need to tighten up a gasket and that will sort that out. I said, I would like a full refund on the car. He said I am on holiday for a week so call me a week Tuesday I don't want to sort this out while I am on holiday. I said I would be putting it in writing that I am rejecting the car and he could come and pick it up. He just repeated that he was on holiday and then hung up on me. 5 minutes later he called me back and said that he wanted me to take it back to the garage and the lads would look at the car and give me a refund if they agreed with me. What are your thoughts on this, they are expecting me to bring the car back tomorrow and I am not sure what the right thing to do is now.

Sam, I haven't managed to get hold of the owner am I still entitled to write the letter you advised me to send or should I give them a right of reply first by phone? Even though I have spent £400 finding out what was wrong with it I would ideally like to cut my losses, learn a valuable lesson and buy a car elsewhere!
  13. just called the boss' mobile number and there was no answer. I also called the office and there was no answer either. They may well be closed for the day but I will keep trying them. I was going to write to them today and just outline what had already been discussed, is this advisable?

I called the seller and spoke with one of his staff who I informed of the list of issues found with the car and he said he had spoken with the boss who had said as the car had not been sold with a warranty there was nothing that could be done. I said that the car is not fit for function and explained that they were responsible. He then asked me to fax a copy of the reports over and then told me to call the boss who was on holiday and ask him to sort the issue out. I haven't yet called him but will do and let you know what he says.
  15. Hi, Thanks for the reply, I am going to call the seller today and ask him to repair the issue and at least give him the opportunity to resolve the problem. I will let you know the outcome shortly.
  16. Hi all, thanks to those who replied earlier. BAD NEWS. I have had the car looked at by Honda today and they have given me a list of things that are in need of replacement. The car needs 2 rear brake discs and pads, brake fluid, all wipers, number plate light, new clutch, major oil leak from rear oil seal, both B/arm bushes NSF, a new turbo and finally 4 new tyres as they have only 2mm and 3mm of tread on R + F respectively. SO, I have read on the CAB websiite that I should stop using the car and speak to the dealer and ask for a full refund or ask for the above repairs to be carried out free of charge. What are your thoughts? How should I approach the dealer in the first instance? I will be giving them a call first as they are over a 100 miles away and I don't won't a wasted trip. thanks again in advance. MWB
  17. Hi Just had the RAC look at the car and they said the turbo has not gone but they were unable to diagnose what the issue was and recommended that I get the car in to a garage! I am getting it serviced by Honda so hopefully that will help, and they may be able to diagnose any issues!
  18. Hi all, I bought a Honda Civic 1.7ctdi from a dealer in Sheffield on Sunday. The car is a 54 plate and has done 129k and cost me £1885. When I got to view the car it was advertised as having done 127k and when I viewed the car it was displaying 129k, also, the car was listed with a full service history and was missing the last 2 services. I accepted this as the car was in good condition and they did knock off £100 off the price. Anyway, I was driving the car this morning and I think the turbo has gone on the car as I cannot get above 2500 rpm and above 60 mph. My question is under the SOGA what am I entitled to do? Can I return the car? Does the dealer have anyboigation to accept it back or repair the car? Any help or advice would be gratefully received, I forgot to mention I live 100 miles away from the dealer! Thanks
  19. had a grievance appeal today they have heard my evidence and will let me know the outcome as soon as. Many issues were raised in the meeting but the one key thing that was mentioned by my union rep was the posibility of me raising a grievance for breach of the disibility discrimination act and the fact that the company may have not made reasonable adjustments to help me with my disability. I drove home satisfied that my concerns had been listened to and when I arrived home I got a call from the Director who was chairing the appeal and he wants me back in work tomorrow to help him with some work and he stated that this should relieve some of the stress of not being paid. I am not sure quite what to make of it, is he a genuine guy who is looking out for me or is he just covering himself in case this goes to court?
  20. Hi thanks for taking the time to reply. I have been suffering the symptoms of severe depression for over 12 months now, I have been referred to a mental health practitioner and have undergone months of therapy and my gp is keeping my medication levels the same for the next 6 months and then it will be reviewed. I have an appeal hearing tomorrow for the grievances and I will have a better idea about what will happen after this, as you say I fully expect the union to let me down and abandon me. With reference to the harrasment appeal I have 2 new witnesses one of whom witnessed my manager talking with one of his snitches that he wanted rid of me and another who witnessed him making abusive remarks about my family so hopefully this will be enough to verify my grievance. I work in the private sector and I have copies of most policies. And it is only the company doctor that has made an assesment, as far as I am aware I think a judge is the only one who can verify my disability??? I am up for a fight as I have nothing to lose now and I need a good reference to be able to leave so a compromise agreement might be the way to go if they won't listen to my complaint??
  21. Hi all, my company have sent me home sick telling me I am not fit to do my contrated role and with no pay. I have been off sick with work related depression and anxiety for 6 months and have subsequently submitted a grievance against my manager for harrasment. The company informed me that I had only 15 days left of sick cover that the company would continue to pay me for so I replied and informed them that I would be willing to come back to work. With 1 sick day left they arrange a meeting with the company Dr and he says that he is impressed with my health and demeanour but doesn't think it is a good idea to work in my old area while the grievance is ongoing. He sends the report to HR asking them to meet with me to discuss my options. 2 days later I ask HR to call me as I have reservations about working elsewhere. They call and say they will discuss with the Dr and get back to me. A few days after this I get a phonecall saying they have found me somewhere to work. I ask about my request to discuss with the DR again and they tell me that they have discussed it and they were sticking to their original decision. I ask them to get the Dr to call me and they agreed but still re-iterated that they want me to turn up for work the next day. Stupidly, I said I would not be coming back until I had spoke to the Dr again as I thought the return to work needed to be mutually agreed. Anyway, after a further 3 days of hearing nothing from the company Dr or HR I spoke to my unon who told me just to go in to make sure I got paid and then take out a grievance. SO, I returned to work, did the job they asked me to do. They then tell me that they are not paying me for the 8 day period between when my sick note ran out and my return to work so I submit a grievance. Grievance is rejected because they say they are under no obligation to find me work and the Dr has declared me unfit, I appeal. Which is being heard on Thursday. Three weeks into this job and the original grievance for harrasment is still not resolved, bearing in mind I submitted it 4 months ago!! Yesterday they told me to go home as the person who's job I was covering was coming back from sick and as the doctor had declared me unfit to work they didn't have to pay me either. So I am in a right mess here and I can't believe they can do this to me. My stress levels are through the roof, even though I have the necessary strategies to help me cope with my problems. Somebody suggested that I should tell them I have a disibility and request that they make reasonable adjustments for me but I don't know what to do. I am at the end of my tether with my employers and can't believe they are treating me this way. What should I do guys?
  22. Hi Honeybee, yes I thought it was illegal but they are. The reason for it is because I did not have a sick note to cover my period of abscence. The reason I believe it is illegal is because I told them I wanted to return to work in late December and they said I had to see OH to be given the ok. I went to OH on the 4th and he said I could return to work but recommended a different department than my manager as the investigation was ongoing. I initially agreed but after disccussing it with my wife I thought it might be more detremental to be placed in the dept next to my dept doing a job I am not familiar with and with people I don't really know. I felt it put me at a disadvantage with respect to my manager and called HR on the 5th to ask if I could return to my own dept rather than another one. They informed me that if I was not happy then they could find me somewhere else and I could remain off work with no pay. I said that this was not acceptable to me and asked them to speak with the OH Dr. I was told that they would speak with him and ask him on my behalf. They called me back on the 6th to tell me that they had discussed it and the original assessment stood. I asked them to contact the Dr and get him to call me. I had still not heard anything and called HR to ask for an update. They inform me that they had found me a dept to work in and I asked them where my call from the Dr was. I was told that they would chase him and get back to me. HR rang me by mistake thinking it was the doctor they were calling and said she had not been able to get hold of the doctor. HR again asked me if I was returning to work and reporting to another manager in a different dept. I said that I still had not discussed it with the Dr and didn't know where I was to go yet. In hindsight I should have just gone in but they were just ignoring my request to talk to the Dr. I eventually spoke to the Dr on the 17th face to face and he apologised to me for not calling me but said he could not pick up his messages as he had no signal on his phone. I had already started work on the 16th in the dept they wanted me in and this week they told me they were deducting my wages from the 5th - 16th. I contested it and said that they were keeping me from work because of the investigation at least up until the 11th and I would take no pay from the 11th - 13th and suggested that I use holiday to cover this but they just said you don't have a sick note from the 5th so you are therefore AWOL and thats why they are not paying me. Hope that answers your question. cheers Miffed BTW I had been calling and emailing everyday to ask where my call from the Dr was and requested an urgent update to which I got no reply.
