ARGH. Of all the times for the printer to run out of ink :o Ok so ive scrawled that on the bottom of the copy of the letter i had already done for him. Will send special delivery in the morning. Hopefully he can read my hand writting -

Thanks Gary, yeah i had thought about that, but mr Lombardi is requesting a copy of the letter i sent to the court along with the agreement form. I suppose i could hold back sending the courts copy a couple of days? would that be ok? I amended the letter above to the court to say they have agreed to pay the money within a few working days. Im hoping that along with the letter they have sent stating theyre intention to pay is pretty binding. -

to anyone waiting for settlement before this date... wouldnt panic too much as i received full offer today, so looks like they are getting through them. good luck to anyone else panicing about going to cardiff -

good news received a FULL settlement offer today. Will be posting back the signed form in the morning along with letter to the court stating that it has been settled. Is there a template in existence for this or is there no real need for anything too wordy? thanks everyone for theyre help on this im sure i couldnt have got here alone - donation will be incoming once the moneys in my account -
I also had an order transfering my claim from my local(ish) county court to cardiff. Bit annoying really as its turned it into a 170mile round trip.

Are all the hearings onm the 26ht march in cardiff, directions hearings? thats what my letter says at least as i understand it you dont need to attend but can send written representation (ie reasons to allocate it to small claims). Reading that quote above has me worried that i will need the full court bundle!!!

Thanks Gary, I have added that to the exiting letter. I will hold off sending just yet though untill im 100% on what i will be doing. May try giving barclays a ring first though to test the water. -

sorry if this is a bit long winded... Just deciding if im going to attend the directions hearing. will need to book it off monday. ah. of course. never thought to ask what it said in the accompanying letter!!. Shame hes already paid it into his overdrawn NatWest account as ive just read that the cheque could acctually have been paid into any account. Still im sure he will be chuffed anyway. thanks again. now i just with my claim against barclays would result in a cheque out of the blue like this but im not holding my breath

Hi sorry to jump on your thread but i have a friend who is in a similar position. he was taking NatWest to court, already filed and received a date as far as i know. today he received a cheque from them for the full amount (less 2 charges that are now more than 6 years old) and has paid it into his NatWest account (seems he had to because it said payable to acc number on it, which i find odd - but im guessing he has an overdraft that needs clearing) anyway its paid in. should he wait a while before sending the discontinuation of claim forms to the back and courts for the cheque to clear? surelly they wouldnt do anything like cancel the cheque before it clears? if someone could give a quick reply on this as hes phoning at 8 i'd be very gratefull ta

Hi, I also have my court bundle about ready to be sent but havnt sent it yet as like above wondering do we wait a bit. Or even maybe a letter approaching them to settle might be a good idea? dazpara, so you're just going to take your own copy ofd the bundle with you to court on the day? Personally im not sure if i will be able to get to cardiff yet so im thinking seeing as were totally snowed in here until the big melt im gonna get everything ready and post a copy of the bundle to both barclays and the court. unless anyone thinks this is a bit soon? -

received a court date today from cardiff courts... so it seems the draft order was not accepted in my case. anyway my main question is this. Should i now send the court bundle off to both? I have done copies of all statements and correspondence since the S.A.R - (Subject Access Request). im not sure on what to do with the schedule though? what date should i print it off bearing in mind that it obviously changes each day. is it simply a case of sending everything (court bundle, schedule, & statements) now and waiting around til march to see what happens? -

Hi, received a letter today from Brecknock country coutry. the attached piece of paper says the following Is this normal practice? to be transfered from one country court to another? also the text ive highlighted above about neither party attending. I hadnt received a date or anything regarding attending the court? Would that be an allocation hearing then? I hope i havnt messed up somehow!!! not sure what i do now! do i wait and see what happens or maybe now would be a good time to try and draft a letter to barclays giving them another chance to settle? -

yeah hopefully it will speed things up abit but it does seem to come down to how busy the courts are from reading a few threads. Mines been transfered to brecon couty court which is one of the smallest in wales. will see what happens now i guess. I think ive subscribed to your thread if not will do it now and keep and eye on it also, took a couple of days over christmas to get copies of all my statements and correspondence done. that was a big job that i didnt want to leave until the last min!! Just need to print the court bundle out now and arrange it all somehow. -

AQ just sent by recorded delivery (deadline 9 JAN 07) along with attached draft order and payment. Now in the process of copying all the relevent statments from the S.A.R - (Subject Access Request)... might take a bit! -
Hi, Have filled in my AQ (an N149) today when I was directed to this thread currently the section "G - Other Information" reads as follows How should I modify this (if at all) if i intend to include the draft order as show at the thread start?

Taking today to fill the AQ and start copying statements. one question before i put the AQ in an envelope. under "Other Information" is this the correct info to put (quoted below) or is this only for when you think it might not be for the small claims track (my claim is less than £5000)? Ive got a bit confused!
