  1. You are probably right Alan, i would imagine it would be very hard to contest in court and theres a chance Lloyds would defend. I wouldnt like to take the risk for such a small amount.

  3. You should NOT have accepted the terms outlined in the letter m8. That money is your not theirs. If it went to court they could say that your signature has waved any right to arguing for charges. Sticky situation now.
  4. Its very difficult to work out m8. As you can only claim for overdraft interest that has been chasrged as a result of an unlawfull payment taken by the bank that has taken you over your overdraft. I have not added any just incase its incorrect. But i have added the 8%, but only at the final stage and not before.

  6. Ahh i actually let them off with all of the interest on charges. The £3134.01 is totally interest free. I found it difficult to calculate and thought it would be time consuming as im in the middle of a University Degree and am very time limited

  9. Claim for these.......................... Unpaid DD Unpaid SO Overdraft Excess Fee Overdraft Usage Fee Then once all these have been totalled up and your letters have been sent. You then add the 8% interest by using the excell spreadsheet in the templates thread. The 8% gets added once it goes to court and not before.

  12. I doubt that the bank would want the publicity of a court case. Think about it, if they do go to court it will be in the paper (coz you will tell them to be there) and their will be thousands of more claims going in.

  14. You dont add the 8% until it is going to court m8, none of your letters to the bank should include the 8%. Thats for the courts only. Your overdraft interest is very hard to work out as you can only claim for interest that is caused by the bank taking you overdrawn. Thats why most of us just ask for the charges back firstly then add the 8% when it goes to court.

    You got that letter same day as i did m8, Will be keeping track of your progress. Ive created my account with moneyclaim so im just waiting for the 14 days to lapse then im filing. Good Luck

  18. Standard reply today, telling me to bugger off, if i want to complain go via Omnbudsman. This is our final reply. Looks like moneyclaim is my next port of call, am i right in saying that i should wait until the 14 days are up before filing with moneyclaim? As i forgot to do this in all the excitement before sending my LBA.

  20. Thats what i thought i should do m8, I will take out all of the overdraft interest (it really doesnt bother me to lose that) But do the other charges i am claiming for seem ok?
  21. I have used the spreadsheet and have calculated that i am owed. £3303.81 +£801.08 at 8% (interest) Giving me a Total of £4104.89 I have claimed for 75% of the overdraft interest, not all. I have read conflicting replies as to what exactly can be claimed back? Is this right? Unpaid Direct Debits ranging from £25 - £35 Unpaid Standing Order £30 Overdraft Usage Fees ranging from £10 - £90 (per month) and the renamed.. Overdraft Excess Fee ranging as above. Overdraft Interest normally range £4 - £8 Can all of these be asked for.
  22. As far as im aware of course you can claim these back, i have claimed these on my letters. Theyu cannot justify charging £60 for excess usage fees.
  23. Although i doubt it will get that far i would read up for court anyway m8. Best be prepared for the worst then it makes you feel better when it doesnt happen.
  24. Hi Dan, i used the penny berryman address to get my statements, then my prelim went to the customer care address, they replied with the standard letter after only 6 days, then sent my LBA to the customer care address as well.
