  1. She does not have much paperwork. Someone told me that they don't give much weight to Critical illness or death in service policies which i don't think is correct? I made a claim and won against Lloyds and they were the ones who asked me if i had Death in service policy.
  2. My Wife has made a claim for PPI against Lloyds for some loans several years ago. Main points being it was never fully explained to her and was told she needed to take this out for her to be given the loan. She also had a separate critical illness policy, entitled to 6 months full pay and 6 months half pay from her employer, she also is entitled to death in service payment etc. None of these were used of her. She made a claim a few weeks ago and received a letter today saying they are not currently in a position to provide her with a final response in relation to her complaint. The FCA has indicated it will implement additional rules and guidance for firms on how they should access certain categories of complaints where the level of commission on the PPI policy was not disclosed. I understand that your complaint is likely to fall within one of those categories. they are saying they want to wait until this comes out before making a final decision and this should be towards the end of 2016. They say based on the information currently available to them they do not believe your PPI policy was misold. However when the FCA release further guidance they will consider the complaint again. Has anyone else received this from Lloyds or any other lenders?
  3. Hi Jo My court were also deciding what to do in light of the OFT announcement. I kept my fingers crossed but was fairly confident as Lloyds TSB failed to comply before the OFT announcement. I am not sure what will happen in cases were Lloyds failed to comply after the OFT announcement was made. As far as i am aware it is not taken for granted that banks will automatically get a stay. I was advised on another post to claim 36p a day from date of claim to date i was requesting judgement. The Judge did not award me this (Only £36) Good luck in your claim
  4. Hi SwissT I will post a thread once payment has been received. As you say i think you are correct they won't appeal. Now it is a matter of badgering them until they pay.

  6. Cheers I have spoken to the court today who read out the order. Do you mean i should ring the court again in a week or so to see if Lloyds are appealing?
  7. Hi Peter Once i have received the order in the best should i contact SCM? Also do i get a choice of having the money paid into my account or by a cheque? Is it correct they are taking around three weeks to pay? Gary
  8. Lloyds failed to serve on me and file at court a counter schedule by 4pm on the 23/7/07. This was days before the OFT announcement. Completed form N225 requesting Judgement. Claim was looked at by Judge yesterday and ruled Judgerment in my favour for the full total of £2174.00 which was the amount i was claiming:grin: The only amount i did not win was the daily rate from day of claim until Judgement which was only £34:rolleyes: Order has been sent to me and SCM and have ordered Lloyds to pay within 14 days. I believe they are taking around 3 weeks to pay. What would be the best course of action to take once order is delivered to me? Whats the likelihood of Lloyds appealing or is Judgement final?

  10. Sorry but i just have a gut feeling i am going to get shafted:mad: My case was in front of the judge yesterday at Grantham court who only look at abnk charges cases on a Monday. As of yesterday the court manager told me that the banks had not contacted them requesting a stay on any cases. However when i called back at 5pm she said the judge did not have time to deal with any bank charges cases and all were being transferred to Lincoln crown court to be looked at this Friday when they will be dealt with. She then said that they received an email at 4:30pm informing the courts about the OFT announcement on Friday. Do you think it is even worth calling and sticking to the full amount??
  11. Hi What did you say to SCM? Lloyds failed to comply with the Judges orders in my case by 4pm of Monday this week byy filing and serving a counter schedule. I should find out this Friday what the Judges decesion is. Apparently they don't appreciate it when Banks ignore the judges orders. Must people say i stand a very good chance as the OFT announcement came four days after the bank failed to meet a deadline as mentioned above. I will ring them tomorrow ans see if we can come to an agreement. How did you approach it? Should i said that i am expecting judgement this Friday for £2200 and try and say i would settle for less if we can agree a figure? Don't like to risk a stay been granted in my case and having to wait a year plus. I need a holiday now
  12. I wish i could be celebrating but it is still on hold. The court manager told me to call at around 2pm to see if it had been heard. When i called back she told me that due to the high number in court today the Judge may not get through the whole list today. She told me if it did not my file would be passed to the court in Lincoln court who would look at it this Friday. The problem is with my court is it only looks at bank charges every Monday. The thing that worries me is as of today my court have not received any application for stays. However if i find out that on Friday the bank has contacted the courts and my case is put on hold i will not be a happy fella:evil: However i do feel that i should be in a strong position as Lloyds failed to comply with the Judges orders before any OFT announcement. I feel so frustrated and angry thast i am so close yet so far. I did include a supporting letter with my request form for judgement. It included the letter Lloyds and several other Banks had placed on their website. I did highlight that the request for a hold was at the judges discretion. I also said how frustrated i was that Lloyds throughout the claim had failed to enter into any negotations. I also said it makes me wonder if the banks failed to serve and file a counter schedule as they were aware of the OFT announcement due on the Friday:-) Not too sure if it would do any good. In my eyes as soon as the failed to serve and file a counter schedule then they have no right to ask for a stay.
  13. I assume the courts will only grant a stay if it has been requested? I also understand from a previous post that the Banks have to go through the Master of Rolls first before the Banks can make the request. One hopes that no court will grant a stay because they have been reading the papers etc. My court manager told me this morning that they are carrying on as previously until they hear otherwise. Then again you never know:)
  14. Hi Do you mean it will be middle of the week before a get a judgement or before the Banks contact the courts following on from the announcement last Friday?
  15. My case is in front of the Judge today and in his posession is my rerquest for Judgement. I have just spoken to the court manager who said that no banks have contacted them regarding the test case so they are continuing as normal and i should have a decesion today I will also donate £10 to this site
  16. My view on the matter aswell is the same as PWARD33. As pointed out the Defendant would be asking for the matter to be put aside after having ignored the Judges last orders. The Judge will also be aware that the orders were ignored four days before any announcment was made on the Friday. I would think this way as i have £2200 resting on this Judgement LOL

Now if this is true i will be jumping for joy:D 99% sounds good to me:-) I suppose it also depends on the Judge and if he wants to possibly adjourn because he knows there is a application to the master of the rolls but don't think he will. If i do get judgement:) is there any right of appeal or would they not bother?

Hi That's exactly what i wanted to hear:) Even if you were lying and only said it to make me happier:D To be serious for one moment i think i would have a good chance espicially when the Bank have not complied witht he Judges "ORDERS" In a supporting letter i did point this out. I don't see how the judge would grant a hold as the OFT announcement came days after Lloyds had allready failed to comply. I think the Judge may not be best pleased espicially if he thinks the bank may not have complied with his orders because they were aware of the announcement on Friday.
  21. Hi Does anyone know how the Banks are making the courts aware of the request for a stay? I only ask because in my case Lloyds failed to comply witht he Judges orders and serve on me and file a court a counter scedule by 4pm 23/7/07. Before the announcement i sent a completed "Request for judgement" form and my local court manager told me the judge will view my file on Monday(tomorrow)and i would probably rule in my favour. I made her aware of the ORT announcement and by 4:55pm(5 minutes before the court closed for the weekend) she was not aware of this and and received no requests from any Banks. I am hoping the Judge looks at my file tomorrow before the Banks send the court any requests. I assume if the judge in my case is aware of this test case through the media but there has been no request from the bank for the matter to be put on hold he should carry on with a judgement? Surely it is down to the Banks to request a hold on the case without relying on Judges to have read the papers etc? How do you think the Banks will notify the courts? By fax, post etc?
  22. Exactly same on Lloyds website. Called the help number but they just repeated what was on the website. They told me i should receive a letter within 5 days.
  23. Good luck. £8000 is a lot of money. Knowing the banks i don't think that offer will be forth coming. Is the offer legally binding????
