  1. Congratulations Wobbler. My dates for ‘The End are/were the same as yours. I’m too chicken to make that call. They made me an offer which I immediately rejected. Meanwhile I watch avidly to see if they will credit my account with costs and interest originally requested. Judgement due on 24th but I think I will try to call 2morrow. Well pleased for you!
  2. Know what? That's how I felt yesterday when I looked at my account with Cap1. Waiting for Halifax now, as they acknowleded on 4th july. Anti-climax - you got that right! Ps Sorry Moneyhelp - just reading through your thread and bumped into a fellow who felt like I did yesterday.
  3. Sorry to say this but THEY DO!... at least in my case. Stated them a couple of days pre Cap one and Cap Ones gone through. Hbos' only acknowledgement of my existence has been the looonggg wait for my statements. Statements req 30.3.07 - (fought for statements) 1st letter sent off finally 21.5.07 All my letters ignored. I filed my N1 on 8.6.2007 they were deemed served 17.6.07 Hbos acknowleded claim on 4.7.07. Patience is a well worn carpet.:-|
  4. I got through! Feel numb! Can't believe it. Text book procedure for me. I think it was the length of time it took and then the quick execution of activity from the time I submitted the N1. That’s when it gets exciting. Can't believe its over! Yes I know it was the objective... but WOW! Cap1 for Two a/cs started 7.4.07 Statements 2.5.07 1st letters for charges 11.6.07 N1 to local Court 18.6.07 issued by court 25.607 sent by court 27.6.07 deemed served (11.7.07 defendant deadline to reply) Meanwhile N1 acknowledged by Cap1 on 3.7.07 They secretly credited my a/cs on 6.7.07 Got full return of charges plus 8% int plus goodwill (£10.00) + court costs on one and on the 2nd cap1 they fell short on the int by £194.41 But hey!.... whose counting. Thank you Cap 1 claimed 703 + int = £939 rec'd 703 + int of £42.14 + 10.00 goodwill ***Was also given virtually all my interest of 232.06 (s/be 236.55) but same day they took away 189.92 sooooo…. interest of 42.14 received. What’s all that about??? A chq refund on the way for 189.92? To cancel court proceedings or not to cancel.. That is the question – it’s not even contractual interest yet hey have to mess up and frustrate the issue at the last point. Now I’ve got to read up on ‘how to’ i) complete survey b) donate c) cancel court claim Busy Busy!
  5. Thank you Ukaviator and Thank you Techspec for replying to my post. So whacked from work this week, - read your posts to me, had some wine and fell asleep! I've spent so much time 'on-site that I really should have charged for my 'time'. I will respond fully when I freshen up, check my online statements and and get my 'goodwill' gestures in line with the original amounts requested. However I will say to Techspec that having read Martins website and using MS Project to calculate my dates I have NOW got 3/8/2007 as the expiry date for my Cap1 a/cs to expire - i.e. default judgement should I not be re-paid in full. MS Project 'includes' week-ends' unless I was to search how to adapt the progamme to 'exclude' week-ends. Cap 1 was deemed seved on 27.6.2007 They Acknowledged 3.7.2007 and I've taken it from 27.6.2007 + 28days (using MS Project) and result is 3/8/07. I had needed to clarify with reading, from 'which' date I needed to add an additional 14 days to make it 28 days in total due to defence. Beetes post ,yesterday, confirms what I thought I should do. "They have 28 days from when it is deemed served regardless from when it it really served and /or acknowledged". Anyhow, I will get back once I've checked my on-line. Once this is all over I can get back to proper housekeeping and d.i.y.ing which I have sorely had to neglect. Later;)

I messed up my calculations a little by leaving off the interest charges @8% for ONE charge.- I don't know what happened. however the sum between my N1 claim and the revised schedule sent to Halifax is £4.40 I sent letter 5 rejecting the offer AFTER N1 stage which agrees with their own 'suggestion' that should I not accept their offer that I should return the payment, which has or will be credited into my account AND call them. I do not have the gift of negotiation. I just want restitution for the distress that a particular someone allocated to my account caused me. I reject their offer with a PASSION beyond words.... 8th June Halifax N1 filed 2nd July Halifax N1 expired 4th July Halifax made partial offer 4th July faxed across rejection expires 24th July

  9. I to was suprised by the deposit in my account when i went online yesterday. They have refunded the difference between £20 and £12. I was more please dwith their speedy response I only sent off my letter requesting my charges + interest on 20th June and by the 25th June they had credited my account. Royal Mail tracker still haven't updated their records so i could check whether my letter had been delived - but whoa! the deposit prooves it WAS delivered. Por Royal Mail..... They are inundated;) However on the discovery of the surprise I prepared a Letter Before Action and sent it off today. Got in from work today and there was the 'Sorry letter' about how 'sorry' they were. Mmmmmmm! Press on. Lots of people are STILL very Timid to take the 1st step. It would not have gone through SO QUICKLY if it was not illegal in the first place.
  10. Hi everyone. I rejected Partial offers from Cap One placed dierctly into my both card accounts. I ommitted saying ' partial offer acepted....' I don't accept it. i did the 'disappointed.....' line though. I just re-iterated the full amounts worked out on the spreadsheets to be refunded. dis-regarding their offer. When I filed at court my N1 at court I did not adjust the original spreadsheet amount to reflect the 'partial' amounts credited directly into my separate accounts. When I eventually do receive the Notice of Issue from the courts for Cap 1, do I write off to the court and advise them of the 'partial amounts' paid into the account but rejected and ask the court to amend my claim total accordingly, or shall I write to them now - revising my original spreadsheet amounts.   13. Congratulations to you. I also am waiting for the their deadline to pass. 2nd July 07. I don't think I'll bother to give them a letter before proceeding with req for judgement. I'm well pleased for you. We all need the encouragement to play the waiting game.
  14. Hi, Please could I ask you, Do I use the same wording on my N1 form for Cap 1 credit card account as one does for the Bank N1? Or do I need to 'tweak' it to fit credit card circs? I am not bothering with the contractual interest, therefore will I need to adjust any other 'wording' or 'acts' quoted. I really want to put this baby to bed first thing on monday. Thank you to Aviator who explained about having two credit card accounts with cap one - file two separate claims. PS Filed my Halifax N1 yesterday at court for £2144 + £565.11 interest

Went today to county court to submit halifaxs claim. Thanks so much for not abandoning the forum even though you got through!
  18. Could not see your 'scales' to thank you for your response and congratulate you. Will be filing mine for Halifax tomorrow. Then Cap 1 and Cap 2 on Monday, then with Barc visa - reporting to FOB(?). Well please for you. As Asda says, 'Every Little helps'... least i think that's Asd;)
  19. Wish you well with Future mortgages. I tried them for the morgage fee and they sent me reams of docs, that I'm yet to thrash through. but i will. Working on cap visa at the mo. them omitted to send the mastercard so another letter and a call 2morrow...
  20. Hi guys. Just got statements for one of my accounts VISA they've been paid for the Mastercard too but what may have confused them is the fact that there were TWO account numbers to each Account - have I lost u too? Lost my cards for both accounts then they issused me with a new account number for each of my TWO accounts...so I thought I'd be helpful and quote both the old and new account numbers for each of the TWO separate accouutns one with visa and one with mastercard. Silly me, they sent two statements exactly the same deatils with the only difference being that they made one copy with the old a/c no and the second copy (same a/c) with the new a/c numb. The fight goes on.... and on.... and on...
