  1. Just had another call from Activ Kapital this morning at 9.15am! They have picked up a debt in my name which I don't recognise at all. I explained to him that I would be sending a CCA request to the original creditor asking for a signed copy of the credit agreement (which they won't have obviously). The guy then proceeded to tell me that this would make no difference as they weren't the original creditor and could persue the debt anyway. Surely they can't?
  2. Hi guys, I have 2 debts with BCW amounting to just under £900 for both. Anyway I'm on a DMP with the CCCS (Consumer Credit Counselling Service) so payments have gone to their client, Thames Credit, like clockwork. Thames Credit decided enough was enough and passed to BCW (Buchanan, Clark and Wells). Told CCCS about debt transfer so all should be ok??? Ur NO!!!! BCW keep sending letters, received 3 for each account last week threatening to take to court, why aren't you acknowledging your debt and paying etc etc which I AM!!!!! For the past 3 weeks I have come home from work to have 7 silent voicemails on my phone. After doing 1471 I dial the number back to hear this: " This number is reserved for outgoing calls only.....(10 second pause)....this is a member of the BCW Group" Nrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrr!!!!! Phoned BCW and asked them to stop ringing me as am paying through the CCCS. They replied with "No, until you pay we can ring you as much as we like as we have an automatic dialler" Is there any way I can block their numbers, complain to them, get them done for harassment?? It's driving me round the bend!
  3. DO NOT PAY ANYTHING until they HFO send the requested info back to you and send any docs to them via Recorded Delivery so they can't say they haven't received your request.
  4. Unfortuntely they are a genuine company and they use scare tactics to try and get you to pay more than you can afford. Send of the CCA request as previously advised, sit back and wait for their reply. If they don't comply with this request you can then complain to the relevent organisations. Someone else will be able to advise you on this situation.
  5. Do not provide them with any earnings details/employer details/expediture details under any circumstances. Only a judge in a court of law can order you to give up this information.
  6. Hi guys, My husband and I are on a Debt Management Plan with the CCCS (Consumer Credit Counselling Service) and have been since November 2007. Couldn't pay CCCS this month due to husband losing job and rent arrears being priority. Called CCCS and they suspended payment saying that it would be reinstated for May 2008 with payments recommencing then. Anyway have now received this letter from HFO's solicitors Turnbull Rutherford: Dear Mr xxxxxxxxxx Re: HFO Services Limited - Barclaycard We have been instructed by HFO Services Limited in connection with your outstanding debt of £971.14. We understand that from our client HFO that you are refusing to take any action to resolve your debt. Because of your failure to act, the file has been passed onto us and we are reviewing your case in anticipation of legal proceedings. We have of course charged our client legal fees for reviewing your case and our fees have already been added to your debt. If you had contacted our client earlier you could have avoided this additional cost. If we are instrcuted to proceed with litigation, we will obtain a County Court Judgement against you. We will then seek to enforce our CCJ by way of an Attachment of Earnings Order. The effect of this is that your employer will be informed of the CCJ and will be instructed by court to deduct an amount from your salary each pay day and send it directly to our client untilt he debt has been cleared. We will also seek to secure our CCJ against your property, and any assets that you have may be removed by court-ordered bailiffs and sold at auction in order to pay your debt to our client. We feel it is only fair to warn you that the amount that you will have to pay our client following the litigation will be substantially greater than £971.14. As it will include legal and court fees, together with the cost of enforcement and accrued interest. You can avoid this by caling me, your case manager within seven days of receiving this letter in order to discuss your account. I am sure this is too threatenign and against OFT standards. We've been paying them for months!!!!! Any help much appreciated.

  8. Hi guys, Lowell have sent a letter to my husband that O2 have sold a debt of £483.40 to them and that they are now duly authorised collection agents. My husband can't remember whether he owes this money or not and I've told him not to call them as I've already dealt with them previously and they are a nightmare Can he send a CCA/SAR request to obtain info on this debt and proof he signed a credit agreement etc??   11. "The debt went with my friends partner as she was the only signatory on the loan" The partner was the only signatory, not my friend, she didn't have anything to do with the loan in any way shape or form.

RW - What is your full name please Mrs ******** Me - Er Er (Family Fortunes Wrong Answer Sounds) RW - This is a serious matter now confirm your address please Me - Not sure where I am at the moment so I will get back to you later RW - This is not a joke, you need to take it seriously, you have to confirm these details to me, it is a legal requirement. Me - Really? RW - Yes Me - Oooohh, will I got to prison if I don't answer? RW - It could go that way Mrs ******** Me - Yeah whatever you say my friend, come one I thought we were playing a game? RW - You have an outstanding balance of £***, how are you going to pay this amount? Me - We haven't confirmed who I am yet so why are you telling me someone elses balance? RW - Um...err, I'm sure we confirmed who you were? Me - No we didn't, isn't what you've just done very wrong? I might have to come and spank your bottom now! RW - Excuse me?   13. Hi all, Posting on behalf of a friend. She has received a letter from Westcot Credit Services saying that she owes £5367.02. Background to the story is her partner took this loan out with Natwest Bank when they were together. The loan was not in my friends name and she was never a signatory. The payments from the loan went out of the joint bank account they had together with Natwest They then split up and sorted everything out. The debt went with my friends partner as she was the only signatory on the loan. Anyway it now seems that the ex-partner has stopped paying which is why Natwest have transferred the loan to Wescot Credit Services. I am sure this is wrong as: - My friend never signed for the loan and the loan is not in her name - Natwest have not called or contacted my friend Can anyone help with this one ? Many Thanks Katpuss

  15. Hi guys, I've now recieved a letter from Ultimate Credit Services who say I owe £140 to MEM Consumer Finance Limited. I've never heard of MEM and Payday Loans etc etc. The letter also had my road but no house number and they just put the county I lived in and not the area!!!!??? The letter also looks like something that I could have created on Microsoft Publisher!
  16. Hi guys, Have been on a DMP with the Consumer Credit Counselling Service since November 2007. Most up to date payment made on 25th January 2008. I have a debt with Capquest. Capquest have been paid along with all my other creditors but now this has happened: 15.02.08 - HL Legal (Capquest's Solicitors) called me yesterday as they hadn't received this months payment. I called the CCCS and they told me that payments had been sent but can take a few weeks to clear as Capquest well know. Called HL Legal back and they said they would contact Capquest and then get back to me. 16.02.08 - Received letter from Capquest saying that my payment arrangement had defaulted and therefore the full balance was payable. Called Capquest and got through to some muppet who sounded like a broken record as all he kept repeating was "When are you going to pay?". I explained to him that I was on a DMP and he then told me that Capquest had contacted the CCCS and that the CCCS had told them that I was no longer on a DMP!!!???? I told him this was incorrect. ANYWAY the best thing about this debacle is that they can't get the amount that I owe them correct: Statement from CCCS as of 25.01.08 - £1,267.05 owed HL Legal Phonecall as of 15.02.08 - £1,300 Capquest Letter received 16.02.08 - £1,405.02 I asked the eegit from Capquest where this extra money had come from and that I had not received any notification, letters or paperwork of these charges etc and he got ratty and said they didn't have to send me anything to explain the amount going up!!!!! What the hell is going on?? Any advice appreciated!

  19. I have never requested a copy of the credit agreement from the original creditor. How would I do this and what would it acheive?
  20. In total I owe about 11k to all creditors. The biggest one I have is with Thames Credit and they are more than happy with the DMP payments. I rent a flat, I don't have a car, everything in my flat is second hand. It just doesn't make any sense. The CCCS have tried to deal with Lowell's by sending them THREE payment offers and they have received this months payment from the CCCS. I am really worried as I didn't set aside the demand as I had no idea what to do. I stupidly asked Lowell to set aside the debt
