  1. CCA sent to MHA 10 days ago but Post Office web site not showing proof of delivery yet. So when do I start counting from, have they even got it ? Pete.
  2. Give them time to respond, you will probably get a letter saying they are looking into your complaint and will get back within 28 days. I got 2 of those. So don't worry and be a little patient. Pete.
  3. Hi byteme, I was in practically the same situation as you recently, although I cancelled my overdraft facility as I never used it. Anyway when they charged me the £25 missed payment fee that took my account into the red so I wrote an Official Complaint explaining the situation and letting them know that they were making a bad situation worse. It took about 6 weeks for them to sort it out but they refunded the £25 (well took it off my loan), refunded interest that had been added to my loan for the previous 3 months and finally agreed to my £1 token payment for the following 3 months. So get pen to paper and send it here : At the top of the page in big letters put OFFICIAL COMPLAINT Do not sign it just print your name LloydsTSB Bank plc Customer Service Recovery Sussex House 1 – 9 Gloucester Place Brighton BN1 4BE Hope it helps you out. Pete.
  4. Hi N.P Sorry, another question. Do I make the PO to MHA Collections or Lloyds Bank PLC ? Thanks. Pete.
  5. Actually I do have a couple of £1 postal Orders here, I might just do that. Should I send it seperately do you think ? That way I get a signature for them both letters. Pete.
  6. Hi GM Does this sound any good as a response to MHA ? MHA Collections PO Box 1024 Windsor SL4 1GH xx/xx/08 Your ref: xxxxxxxx Account No: xxxxxxxxxxxxx Dear Sir/Madam I received your letter dated xx/xx/08 on xx/xx/08 and note you state that Lloyds TSB Bank PLC claim that I have failed to respond to their requests for payment. With all due respect nothing could be further from the truth. I would refer back to my letters dated xx/xx/07, xx/xx/07/, xx/xx/07, and finally xx/xx/08, all of which have gone unanswered by Lloyds. As you are acting on Lloyds instructions, I would assume that they have furnished you with all the correspondence that I have sent to them. In which case I hereby request that you enquire as to why all of my written correspondence has been totally ignored by them. Furthermore, I will only communicate in writing regarding any matters relating to this account, therefore I request that my telephone number is removed from your systems. Any attempt to contact me by telephone will go unanswered and every call will be logged, and I will not hesitate to report the matter to Ofcom, Trading Standards and the OFT. I also request a copy of your official Complaints Procedure. I look forward to your WRITTEN reply. Mr X Anything I should add ?
  7. Hi N.P & GM Is it worth answering this threatogram ? I am just composing a snotty reply due to them saying I have failed to contact them (Lloyds). I'm bloody sick of writing to them just to be totally ignored. FFS I started all this off BEFORE I got into trouble and THEY ignored my letters Pete. ps. Do any of you use MSN for a conflab now and again ?
  8. Quick update : I spoke too soon, in the post this morning a letter from MHA Collections. I must say I'm not very impressed. The reference number is clearly visible for anyone to see and the word COLLECTIONS easy to make out in the window of the envelope. Basically the same as N.P's letter, pay up TODAY or we may do this that or the other. Please phone us on 0870 ........ I don't think so. Just a quick question. More and more companies now send letters with just a barcode on the envelope, so how do you know when they are actually posted. Pete.
  9. Hi N.P Thanks for the link, by the way I think if you right click on the post number and choose 'copy shortcut' you can then paste that and it will take you to the exact post . Anyway back to basics. I haven't CCA'd them yet, cos quite frankly since coming out of hospital I can't be arsed with it all. So now that they have involved yet another dept masquerading as a different company, who would I need to CCA, Lloyds or MHA ? If my luck continues as it has gone in the last 12 months I just know they are going to come back with everything required. Probably in triplicate Pete.
  10. Just a few questions regarding this: Wrote in January and they still didn't reply or acknowledge. Since then I have had a threatogram in February and a Default Notice at the end of February. April a letter from SC&M, but I doubt this is serious as it was dated 1st April In between I'm obviously getting my monthly bill which I am still paying £1 towards the arrears. Now my last statement under Account Information contains the following, word for word : Your account is seriously overdue and in view of this we have instructed a Debt Collection Agent, MHA Collections. If you are unable to make the payment on this statement, you must contact them immeadiately on 0870 010 1977. Instructed them to do what exactly ? Is this really classed as communicating in writing ? Rather than sending a 'proper' letter. The card is now near to being maxed out due to them still adding interest each month, can they take it over the card limit ? I am still getting calls from Lloyds but due to the fact I don't answer (just log it) I don't know whether it is regards the credit card or loan for certain although loan have agreed a 3 month token payment deal. Do calls from MHA still show up as the same number as Lloyds ? I'm pretty sure I read they are just another Lloyds company / Dept. Due to fact it is some weeks since this action was taken and MHA have made no written contact I have no address for them. I was considering writing to them with the same letters I had sent Mastercard and see if I get any reply from these 'people'. So what do I do ? Thanks for any advice. Pete.
  11. Just reading back through the thread passing time. You mean the one round the corner from Hurst Linen ? My missus works in the old folks home opposite, and my mate used to be the landlord there a few years back, then moved on to the Halfway House on Whiteacre Road. Small world eh. Pete.
  12. Hi MD You could try sending them(Aktiv) something along the line of the letter used here http://www.consumeractiongroup.co.uk/forum/show-post/post-1482539.html Just amend it to suit your needs. Pete.
  13. I was in exactly the same situation and it took 3 letters before they even replied saying that my token payments were not acceptable, and interest would still be charged. I just continued to pay my token payment as that is all I can afford at the moment, so make sure you don't miss paying this. My god, you speak to these people ? I took one call off them just after I had problems, never again. The attitude of the caller was disgusting and she was only interested in getting money off me, insisting I do this that and the other there and then. Told them to put everything in writing in future !! Never answered thier calls since, but they keep trying. Same scenario here again. You will probably get letters from BLS COLLECTIONS next offering you a massive saving if you settle the account within so many days, I got 4. The first one suggested I could SAVE 50% and this was followed by another suggesting I could save 15% I hope you have another bank account, when they charged my current account £25 late payment I wrote an official complaint letter. This was to show how they were making a bad situation even worse, and that this would be viewed as counter productive. I got the £25 refunded all interest that was added to the account refunded and they suddenly accepted my token payments for the next 3 months. I also have it in writing that once the account is passed to the Consumer Debt Recovery Dept all interest is frozen on accounts. They also put a default on my credit file. Good luck with these empty heads, but keep at it they will eventually get them message.
  14. Well I have finally had a decision made on my Official complaint, which I posted earlier in this thread. The response is somewhat puzzling to me. They seem to think that I was complaining that they had refused to accept my £1 month token payment and they had refused to stop interest and charges on my loan account. Unless my letter was badly worded. My complaint was about the £25 charge on my current account, thus taking it into the red. Anyway they have failed to uphold my complaint .............. But as a gesture of goodwill they have decided to : Refund the £25 charges to my current account Refund £189 interest / charges on my loan account Accept token payment untill the end of June. Bit of a contradiction I'd say considering they failed to uphold my complaint. The reason they refused to accept my proposed token payment originally by the way, according to this letter was because my outgoings were more than my income. I have also been told that once ANY account is passed to the Central Recovery Department then NO interest is added to it. Pete.
  15. Evening everyone, I recently read on a thread on here that the letter (N) in the Template Library is not suitable for a Credit Card CCA request. I think it was something to do with the sections that it referred to in the Template letter. I can't remember where I read it though, so does anyone have an amended one that is suitable ? Thanks. Pete.
  16. Well those nice people at BLS Collections have wrote to me again. I must say in the space of 4 days (Post #42) their attitude has really changed, offering to save me upto 50% now. Why is it I get the feeling that they are not telling me the full story I think I may ask them to put the details of this amazing offer in writing so that I may consider it. Pete.
  17. Hi N.P I also had the letter from SC&M regarding my loan, that was on the 7th Feb. I have heard nothing else since then from them. However I did get one from BLS Collections on the 14th March saying they were acting on behalf of Lloyds to collect my pennies. They even want me to fill in an expenditure sheet for them Pete.
  18. Hi Surprise, Health wise I'm getting better daily thanks. As for my complaint. They signed for my complaint on the 28th January. I got my first reply, dated 5th February. It just said that they expect to complete enquiries within 4 weeks or let me know if there is going to be a delay. I then got another reply dated 22nd February. This said that despite thier best efforts they had not been able to resolve the matter but will write again within the next 4 weeks with a response or an estimate of when I could expect a decision. The complaint is about charges they are applying to my current account because of missed payments to my loan so I don't know how that would affect them passing it to BLS. Just another quick question. If BLS are acting for Lloyds then why are Lloyds still phoning me ? Unless it is regarding my CC rather than my loan, but it is always the same number. Pete.
  19. Since my letter from Lloyds solicitors on the 7th February I have heard nothing untill this morning when I received this letter from BLS Collections, who are a trading name of Lloyds TSB Bank plc. It's in the small print at the bottom of the letter. There is also an expenditure sheet on the back which says I must fill it in and return it to them. Do I really have to fill it in ? I have already sent Lloyds THREE copies of my expenditure sheet, which is probably in a bin somewhere now. I have a couple of questions relating to the paragraph I have boxed in. It says that they may be forced to make telephone contact with me. So who is going to force them ? Or they may advise Lloyds TSB that a personal visit may be required. Would they not be wiser asking me about a personal visit first ? Now I have no problem at all with meeting a Lloyds employee at my local branch to discuss my situation, so this would seem the most sensible solution. What I need is a quick suitable reply to put them straight on both points that, I don't do phone conversations, and I certainly don't do home visits either. Oh, and who do I now send the CCA request to ? Thanks for your replies Pete.
  20. Due to unforseen circumstances I haven't sent the CCA request yet. So do I just send it to the Collections Centre in Andover. These are the people dealing with my account at the moment. Thanks Pete.
  21. Quick update regards my Credit Card. This morning got a 'YOU SHOULD READ THIS CAREFULLY' Default Notice letter I have never yet had a reply from these idiots regarding my circumstances, and they have failed to even acknowledge any letters that I have written to them, or answer any of my queries Instead they just skirt around the issue and send threat after threat. Anyway first thing Monday it will be CCA time for definate, so any templates and addresses for Lloyds Mastercard would be really appreciated. Thanks Pete.
  22. Hi all, Thanks for your concerns. I'm back now although everything didn't go as intended and I ended up in Hospital for just over 3 weeks and had to undergo 2 major operations in 9 days. Anyway latest from Lloyds is that they have instructed Lawyers to make 'Formal Demands' for the balance within 7 days. Or they may do this or they may do that etc ..... Lawyers are SECHIARI, CLARK & MITCELL. The address is exactly the same as the Credit Operations Customer Service Recovery. They are dealing with my complaint I wrote last month. Pete.
  23. Hi N.P Thanks for asking. I'm back now, although not in such good condition as was expected. A 5 /6 day stay turned into 3 weeks in hospital and 2 major operations within 9 days of each other. Anyway the only reply I have had from Lloyds CC was one that told me that I must be treating this account as low priority. No mention of the letter I wrote to them asking why they ignored my previous 3 letters. Now I'm just getting a little bored with it all to be honest. How do I get both of my threads moved back to General Debt ? Pete.
  24. Is that the Ladysmith ? I'm from the same neck of the woods, looks familiar. Alas I am usually 2 sheets to the wind to remember Pete.
  25. That doesn't seem right at all if you look at the charges quoted. £95.00 PCN (inc. £5 debt registration) (VAT Exempt) £11.20 1st letter fee (ex.VAT) £29.74 1st Visit Fee (ex.VAT) £90.00 Attendance to Remove Fee (ex.VAT) £59.08 2nd Visit Fee (ex.VAT Forget the ATR, there is a 1st visit @ £29.74 Then a second vist @ £59.08 So what extra costs do the bailiffs incur by having to go back again ? Do they pay double time to the employee ? Do they go a different route and put it down to travelling costs ? If I am out when my window cleaner comes for his money, he calls the next day. But it doesn't cost me double for cleaning my windows. Pete.
