  2. Hello Everybody I was wondering do you receive statements for managed loans? Pardon my ignorance but I am claiming on behalf of my husband and as he is one of these people who gets their statement and does not even before bother to open up the envelope before throwing it away - he cant remember if he got any statements!! The reason why I ask is we are going to be recovering the interest in the managed loan that he was forced to take out as he was overdrawn (mainly due to unlawful charges) We are unable to find out his account details for this loan. We went into the branch and they said they couldn't find the details!! Not sure what to do and whether we should try sending out a DPA notice but cant really as dont have any account details. We are in a bit of a pickle and I am not entirely sure where to go from here. Can anybody help??

  4. I am starting a claim against HSBC for my husband for £1653.00. and I have written to Natwest and Barclaycard for their charges for me. Sending off Prelim letter now so fingers crossed. I will not be taking any offers we will be taking it to court so that can claim for 8% compounded interest as this is £584.45 Does anybody know how much it roughly costs to bring a claim to the small claims court? Anyway - will keep you updated with progress.
  5. Yeah I know that you are probably right!! It is just that I hate Natwest so much!! I have lots of other charges that I can claim back from about 3/4 years ago so I think that I will concentrate on that now - and as they have annoyed me so much - I will not be happy with statutory interest I will be going for the whole contractual interest as well. Watch this space - they have now made a proper enemy out of me and I will not stop until I squeezed every last penny that they owe me out of them.

I had an advantage gold account with Natwest and I am not sure if you know but you have to pay £8 a month to have it which is taken by DD anyway I had a belly full of Natwest so I decided to keep the account open with £1 in there and not use it. I asked them to make the account into a normal amount and I requested to cancel the £8 DD which they said they would do in the branch. Anyway went away abroad for 6 months to come back and find that my account is overdrawn by about £500 and they had issued me with a default notice. It turns out they had continued to take the £8 out which made me overdrawn and charged my interest as well. I called up and disputed this and evtually had to write they said they would take off all charges and remove the default. This was back in early 2006. Anyway I got my credit reports 3 days ago and the default is showing as a default and not even settled let alone taken off. When I wrote to them asking for compensation this is what they wrote to me. "I have now arranged for the default recorded with the credit referebce agencies in June 2006 to be removed and would apologise for this oversioght on the Bank's part. In view of the other defaults recorded against your name it is unlinkely that your credit record has been adversely affected by this entry" I am not just fuming by this I an hopping off the walls!! I cant beleive that a bank can use your credit record in this way. I am in the process of having the other defaults removed as they have all been applied due to excess charges. Should I write something back or should I let sleeping dogs lie? Any advice on how to proceed I would be very grateful - the way in which Natwest have treated since I opened my account in 1998 is really and truly disgusting so I am up for a fight with them as they make my blood truly boil.

  9. I have sent a DPA letter and sent 10 letters subsequently. The orioginal DPA letter was sent with a £10 cheque and recorded post and a second copy was sent by recorded post 10 days letter. They have received both signed for letters and I then sent 8 more letters to all the address' in the library. The 40 days have lapsed and nothing. What do I do now? I have no idea of the scale of charges that had been placed on the account within 6 years but I know that it is a lot how do I file a court claim against them when I have no idea as to the charges. Please can somebody help as I have tried to look through the threads but cant semm to find anything? Thank you in advace to anybody who writes with any help.

  11. I have had many charges from many accounts and credit cards but a lot of them I have now closed. Does anybody know if you can still claim back the charges from closed accounts?:-|
  12. I have just asked Barclaycard to send me a list of charges or the statements as per the letter and they have written back saying that they can only send statements and each statement will cost me £3 each. Is this right and what do I say to them back? Can anybody help me?

When you send a CCA to a debt collection agency what happens if they cant provide the agreements - does this mean that the debt goes back to the credit card company who you were originally with? What happens if the debt collection agency has bought the debt what would they supply to me? If the debt collection agency can provide the information provided do they get agressive and try to up the amount that you pay? If the debt is handed back to the credit card company what stops them from handing it back to another debt collection agency? What is the benefit of using a CCA? Any help I would be eternally greatful.:grin:
  14. Could I please ask what does a CCA means? - what is it short for. I am very curious and I could not find the meaning on this site.
  15. I have just found this on another debt website - this may help you stop their calls. If you are a BT customer, they have a service called 'choose to refuse' which might help you if you are getting a lot of calls from an unpleasant creditor. You have to key in a PIN number after a call. The caller will get a message refusing them if you don't wish to take their call the next time they ring. The cost of the service is approximately £10 per quarter for a maximum of 10 numbers. Ring BT on Freephone 0800 169 2707 for more details.

  17. I was wondering if anyone can help. I had an advantage Gold account with Natwest and they were so shocking at managing my account that i decided to leave it open but with nothing in it. There was one direct debit going out of the account and that was the advantage gold payment i think about £8.00 which I asked Natwest to stop as I did not want my account to be Advantage Gold anymore, I wanted it to remain as a normal account. Anyway I went away for a couple of months and returned to find that my account was £500 overdrawn and I had received a default notice from them in respect of the debt. The reason why I had gone this amount over the limit was because they had not stopped the advantage gold payment but had taken it. When they took it there was nothing in the account so this took my overdarwn which they charged me for and these charges kept accruing until it got to £500. The long and short is that I wrote to them asked for themoney back and my default notice taken away. They recharged the money and said they would remove the notice. It is now a year on and I still cant credit - the reason why is that Natwest have left this amount on my credit report and have not even removed the amount that it is still outstansing. I have written to them but I have been waiting for answer from them for 2 months now and they keep saying they are looking into it. What can I do? How can try to hurry them up and start being a bit more forceful? Please help as this has already worngfully been on my credit file a year longer than it should have been on there for and now I am going to have another 6 years of this being on my file when it shouldn't even be there in the first place - can I seek compensation? as I wont be able to get great credit when I really should have been able too.
  18. I have had many dealings with many debt agencies and Intrum Justicia are one of the worst. My debt was with a credit card Natwest and there was about £3,000. They have hounded me, sent numerous letters lied and cheated all the way through to the bitter end. I have now paid it after 3 years!!! but this is how I managed them. I changed ny mnumber with BT - extreme I know but they just wouldn't stop calling and I went ex directory - becasue they look you up in the phone book if you dont. I bought a sim card on the same tarrif as my current mobile and gave them that number - I could check the messages occassionaly but unless they actually get through to you they dont leave messages so dont count on them leaving any. I went to citizens advice and they gave me a really handy leaflet which told me to write a letter and explain my circumstances and confirm the amount that I can pay and attach an excel spreadsheet with all of my ingoings and outgoings to prove I cant afford any more than I have offered. They will usually write back and accept the offer. I paid about £30.00 for 6 months. You must be really careful to stick to the agreement because they will try to increase it at every oppurtunity and occasionaly you need to resend your statement of means. The easiest way to pay is by direct debit so that they have no ammunition for trying to say that they were not able to get the payment hence they have to increase the monthly amount. Be heavy handed back, they are trying to break you - dont be broken.:o
