  1. I am not entirley sure of what my interest rate should be - as I opened the account back in 1999 I dont think they will be able to provide me the original agreement - so how would I be able to find this out! I wish now I did not throw away my papers - I am really learning my lesson!!

  3. I sent my list of charges and they sent me a letter with exact same wording as above so now going to send my LBA - I am not sure though if somebody has had a success with adding contractual interest maybe I might give it a go? Has anybody had any experience in this and what rate did you use?
  4. Received the court papers about a week ago and it says on the papers that they have to file their defence by the 6th June 2007. What do I do now do I wait? Do I send a letter to DG Solicitors? Can I ring the court to find out if they have filed a defence? Any help really would be good.

I opened the account in 1999 so I think I might have a fair chance with the T&C's - hopefully I will have a go and look around for any similar threads and I will let you know how I get on. I only had £72 worth of charges so it was not a huge amount - so maybe if I wear them down they may relent!   6. The default was put on my account after I did not pay for a couple of months but I paid the account off a couple of months ago. The account is now closed. Does this mean then that when the account is closed they can still process my data but they dont have to provide me with an original agreement? I have already asked for my charges back but there were only a couple. Thank you for your help, kiri
  7. That is great I will hold on a for a bit longer then -I wasn't quite sure. I dont actually owe them any money I did it to get the default removed as even though I had charges on my Credit Card it wasnt the reason why I got the default so I thought that would be a weak argument.   8. I was wondering if anybody was able to help me. I sent a request for my original agreement from Natwest on the 24 April 2007 with a £1 fee. I have heard nothing in response to this and it has now been 30 days. I originally sent the request as I want to remove my default - am I right in thinking that as they have not replied in 14 days the agreement is now un-enforceable if this is the case does this mean that they cant carry on with supplying my information to the credit reference agencies? If this is the case then what do I send them and how can I try to enforce that they remove the default? Anyway help would greatly appreciated - kiri260180
  9. Thank you so much for all in the info - I will look tonight for old T&C's but I have a feeling that we dont have any but I will check anyway. In the meantime thank you for the direction of the items that you have suggested that I read - I just want to make sure that I am prepared as possible.   10. Was going to put it in post box - but couldn't as they didn't have one!!! So was forced to go in person!! - wanted to avoid this but thought it best in the end best to get the feel of the place in case it does got to court. I have filed the N1 going to call in a couple of days to find out court date. I have read with the interest and now ffeling quite scared the Lloyds TSB case that Lloyds just won. It is clear that I need to prepared to go to court - I have a couple of questions and would really apeciate any help from people as I am now feeling that I may have done the wrong thing. 1. I am doing this on the behalf of my husband. He has said that he doesn't want to stand up in court - can I represent him? If it does go to court how do I do this on his behalf? 2. The Lloyds TSB thing was found in favour of Lloyds because there was not enough evidence - I only have the bank statements do I need to be getting original agreement - and if I do - will HSBC be forthcoming in giving this as they probably know by now that I have filed against them. Please could somebody help as I want to be ready and I want to make this as painless as possible and I am afraid as I am not legally minded I am finding this part quite hard. Any help or suggestions would be really helpful. kiri
  11. I am exactly in the same position as you with HSBC started alomost the same time received exactly the same response or lack of and for almost exactly the same amount of money. I filed my claim at court on Friday but now I am really wondering if I have done the right thing?? I was not prepared to start collecting agreements and everything - I not sure how to prepare - can anybody give me any advice?? Kiri260180:confused:

Still not heard anythig yet - called the number again and they said ooopps we sent them last week have you not received them yet? - noooo or otherwise why would I be waiting 20 mins on hold waiting to speak to you!! Oh well will said they would make my case a priority - so keep you all posted!!

  15. I have sent off Prelim - a standard response of "we are looking into it" no offer then sent off LBA no response at all. I am about to send off my N1 form 1. Do I include costs such as the recorded post costs? 2. Do I also need to put in the claim that I would like the default to be removed or do I do this when they try to settle - or after the claim has gone through? Any advice would be really helpful as going to hand deliver it this afternoon.
  16. I got my six years statements finally after the 40 days elapsed and sent off my prelim letter - no response - sent off LBA letter no response. I am right in thinking that when we give them 14 days this is not working days this is actual days? Can anybody clarify this point for me? as if it is 14 days then I can file a claim against them today which will be fun!! My husband is having kittens about it but I am really excited so I want to make sure that I am doing everything correctly and we are not in wrong for pushing ahead too fast.
  17. Thank you Skylario I was so excited at getting the number I issed a digit!! Still not heard anything and been another week - but I guess I have to allow for the bank holiday will give them till the end of the week!! Thanks everybodey for your posts will let you know how I get on.
  18. Just in case anybody picks up on this thread. I called NatWest this morning and they actually have a dedicated line for people complaining about their charges!! The number is 0800 015 212. option 1 and then option1 again. I was also told that there is a problem with the statements between 2002-2003 and they are well aware of this. Apparently this has to come from a seperate department and database and they will usually follow your initial statements after one week - if not then chase again. Hope this helps anybody that is in the same situation as me.
  19. I will do, thank you both of you for your great advice. I will be polite as I was to have the upper hand but it is really hard as they hav no excuse that they are really busy with all of these requests - what if we turned around and said sorry I am too busy to pay back my charges I will do it when I am good and ready!! I dont think they would be very patient - in fact I know they are not as they slapped me with a default notice when I did not pay them back after their unlawful charges took me over my overdraft limit! Anyway will kill them with kindness for the moment until I get what I want and then I will hit them!!! Thank you so much for your reply I will have a read through the thread - there are so many on here I did a quick search but could not find any that fitted the bill - so thank you for posting that. I will let everybody know the outcome - from the statements that they have sent me they already owe me £730 and I think I have about £500 more so will keep everybody posted with the outcome. I think having read some if the links that I may also write a letter to Sir Fred Goodwin - I think that he would like to hear about his department is dealing with these requests and the delay's that that they are delibrately setting in place to slow things down - hopefully I can bring to his attention so that he can put a stop to this for future claimants. I have also read the new post from BankFodder with regards to claiming for waste of time as I think that I have fairly good case. It does not really describe in his post what reasonable charges for timewasting are apropriate if any could shed any light then I would be most grateful as I am going to take them to cleaners with this one as I cant stand them!! I sent off my S.A.R - (Subject Access Request) request to NatWest for my six years statements - they waited twenty days and after I wrote to them chasing they sent me a letter asking me to go into the local branch and change my address; as they did not recognise it even though my statements were sent to this address for 1 year before my account was closed. Anyway did that and did not hear a peep out of them after having sent another chasing letter asking them what the hold up was. The cut off date for my SAR is this Friday. I received the statements this morning and I am missing a year and a half's worth from mid 2002 until beginning of 2004 - which for me is when most of charges were levied. What do I do now do I phone them and request the rest? How can I prove that I did not receive them? Can I report them for being in breach of the SAR if they do not get them to me by Friday - and will the courts see this as a breach? Does this mean that I can ask for any reasonable amount back from them through the courts without having to ask for the rest of the statements and again if I do this what stops people from saying that they did not receive half the statements?   22. Thank you for all your help. I will write a complaint pronto!! I just wanted to find out if they were in breach. The thing that annoys me is that BT cant even say that the person was trying to impersonate me as the person they were speaking to was Male!! And my account is in my married name with a Mrs so there is no mistaking that I am female!! At least I know where I stand now I can give them merry hell!! Thank you again everybody.
  23. Has anybody had before BT giving all your personal info out to somebody who is not even on the account. I live with my partner and although I dont mind my partner knowing everything I was behind on paying the bill and they called home and I was not in. Anyway the guy from BT told my partner how I did not keep up with payments how I was cut off a year ago and that I had bad credit with them and that I was late with this current payment and I had to pay immediately or otherwise I would have a default against me!!!???!!! Are BT allowed to speak to anybody about your personal data even though they are not on the account? My partner did not know all of the above so there is no way unless he had been told by the person over the phone that he could no what he told me. It is all true but I am not sure that I want it broadcast to anybody who picks up the phone to BT. Is there anyway of stopping them from doing this - Am I legally aloud to complain?

Thank you but unfortunately there is just a desription when the payments are being taken out of his account and no account number plus to make matters worse - no online banking and he does not have an account with them anymore!! - we are truly stuck!! Thank you though for your helpful comments.
