  1. I know more about CT than NDR - but if it is the same then the Liability Order only covers the outstanding monies due to the Council not the Bailiff's costs, I am not sure what the statutory fees are for NDR but am sure that someone will be along soon to clear that up. SFx
  2. Well done with the IC, however, have you made any payments since your first post, hopefully, you will have at least saved the monies and be able to pay the coundil direct and then just deal with Rossendales. SFx
  3. Have you paid the total amount outstanding and not just the arrears? I think that you must have but wanted to clarify. Are the letters dated after the CT was paid in full - if so then no they cannot charge you for any letters. If not there are statutory sums that they are allowed to charge which are £26.50 for the first and £18.50 (if I have got that wrong someone will correct me!!!) If a Liability Order has been issued against you then that only relates to the council tax charges not to the charges that Rundle have put on the account. SFx
  4. Though it is lovely to hear from you again, it is sad it is on this thread. What has the OR said regarding the missing accounts? I think it would be worth phoning the opps solicitor because the Judge is not going to be best pleased to have his time wasted. Hug again and hope some other more bankrupty literate bods can give you some solida advice. SFx
  5. Ted you send the Form 4 to the court where the bailiff gained their licence, they send a copy to the Bailiff company and then they have 14 days to reply. It is at this point that the judge will decide whether or not the bailiff has a case to answer. If they decide that there is a case to answer you can ask for it to be transferred to your local court and have the hearing there. SFx

The use of a Form 4 can be very successful, it is a powerful tool, though it must be more than he said she said, you need to file it in the manner that judge would be used to with appendices exhibits etc. It is not difficult but as with most things the more time put in the better job that is done.   8. CAB are correct they cannot take the table and chairs, the sky box belongs to sky, are the tv or dvd on hire purchase? If you can prove that you work for your Dad and the computer is a tool then no he cant take it. SFx
  9. No worries hope you get it sorted Though from a totally personal prespective, it is a bit rum having £3000 outstanding in Child Maintenance and car that is valued at £29,000, might be time to think about that! Lecture over!! SFx
  10. Yes they can take it after five days. As long as the Bailiff is certified then it is a valid WPO as far as I can see. As it is child maintenance not only can they take the car and sell it for a really low amount if and you will still be liable for the outstanding. They can also apply for your driving licence to be disqualified. SFx
  11. Yes they can - even though it is worth substantially more, when sold at Auction it would probably fetch that. Have they made a levy on the car? SFx
  12. Morning all - sadly the BA Barracus of a bailiff is in fact certified and has been since Jan 06 therefore no help on that one. From speaking to DBH I have found some majorly glaring issues, that will be raised today. I have passed several of my ideas passed Her Royal Highness Tomtubby!!! to which she has agreed with my plan of action for DBH SFx
  13. Firstly a huge hug - It will take time but we can help you to sort this out. No they should not have taken your laptop if it is the means of earning your living. No they cannot take the car if it is registered to your ex husband do you hve a good relationship with him, in so much could you get a copy of the certificate of ownership. Thirdly - could you please tell me exactly what happened when they came to your house with the locksmith. Which council is it and which company not the actual bailiffs name? There are some very very serious issues here. I have to go out for 45 mins but will pop back when I get back in. In the mean time hopefully Tomtubby will fly by and give you some further advice. SFx

I am not a great expert on NDR - however if she does pay the Council in full then the Liability Order is satisfied and the charges are not covered by this, they would have to start another proceding to recoup them. If you send a SAR then the debt to Equita is in dispute and therefore cannot be collected on till this dispute is settled. If the Bailiff does come get her to call the police and state that their is a person in her shop threatening her, do not tell them it is a Bailiff, they would be committing a criminal offence by trying to gain moneies by deception. I am sure that if I am completely wrong someone will be along very soon to tell you correctly!! SFx
  16. One of the issues that particular concerns OH is that his boss has stated that he should tell suppliers not to just "pop in" and that he is to be presant if OH has a meeting with any suppliers. This is detrmental to the dept. running as his boss spends about less than 50% of time at the office, (no idea why!). Many of the suppliers that he has dealt with he has done over all the 8 years that he has been there. The boss's boss also has extremely good relations with these suppliers. As with most businesses much is based on good will and relationships and with this new dictate one very important supplier feels extremely intimidated and uneasy with dealing with OH's company. Sorry to bang on but it is useful just to vent and not pop down the road and give this person a peice of my mind!!!!!! SFx
  17. You could ask for written confirmation from B&S to the agreement that you have come to and as long as you dont deviate from the dates agreed their is no reason that they should not honour it. Sorry be to be the haringer of doom but with a WPA if you miss a single payment they can come and take goods listed, unlikely they will more than want the full payment up front, not a position that you would like to get into. Check out on entitledto to ensure you are receiving everything that you should be and also that you are getting any council tax and housing benefit that you are entitled to.   18. This is probably not what you want to hear, but I would rigidly stick to your £16 a week this is a very very decent offer in Bailiff terms. I think that it will just cause ructions and demandsz for the toal amount to be paid if you try to renogociate it. The council will be unlikely to take it back for the simple reason B&S have managed to come to an arrangement with you. How much is outstanding? SFx
  19. Yes I do - you still in a medicaly vulnerable posistion ad have been since they started contacting you. Also you are breastfeeding and the stress cannot be doing your milk any good. I would tell them this, it might be worth getting your Midwife or H/V to write a letter to you stating the effects of increased stress on an b/feeding mother and vulnerability to PMT! SFx
  20. Thanks SW -I think it is the fear of rocking the boat, he did go and talk to his ex boss yesterday, the one who admitted that he is current boss "has it in for him" !! I have suggested that he speaks to his boss's boss with whom it gets on very well with and happens to be the deputy MD and has known OH all his working life. Sadly when he makes the nasty comments his colleque who has only been there for a month wont admit he has heard. Fair enough I would probably be the same. I do hope that it does not come down to Contructive Dismissal as OH loves his job and I truly beleive if you cut him in half it would say his company name like a stick of rock. The difficulty of bullying is that it is underhand and power based it is hard to unearth. Thanks again SFx
  21. I think we need to get Tom Tubby to have a look here, I will email her and get her to take a look. I know that there is something regarding charging multiple visits at the same time but cant remember if they are or are not allowed to do this. Have you told the council that you have a newborn and that this is causing a lot of distress post partum? SFx
  22. That is what you have to say to the Bailiff in both written and verbal communication. State that you do not have good or the means to raise this sum of money and that it is infact fruitless to persue this case, and to hand it back to the council. SFx
  23. There is no set time, however, it is good practice to call no earlier than 7am and no later than 9pm, but there is no law that says this is the case. There is a very good chance that they wont attend at all today. I would use the time to do everything that you can to get the council to take this back, and also point out to the concil that you have next years liability as well and that if you cant sort it out then you will be unable to pay next years as well. The real reason that Council's use Bailiffs is that they do not cost them anything!! SFx
  24. Hi my OH has a boss who is a bully, recently he has managed to implement procedures that are of no benefit and to are almost detrimental to the running of the department. My OH has been in his job for 8 years and at the company for 15 years. His boss has only been at the company and in his job for 1 year. He is highly respected within his industry, though his current boss, has now made several decrees that effectively stop my OH from doing his job effectively. Though hearsay - a very reliable source, a senior manager in a different dept, has said it is known that OH's boss has it in for him. OH is worried about speaking to his senior manager as he fears that his boss will become even more vindictive and implement disciplinary procedures that would proclude OH from receiving his annual bonus. Any thoughts please SFx
