Here we go, Sent cca for my Managed loan 05 June, i received something today Covering letter reads: "I have enclosed a copy of the original agreement which fulfils our obligations under section 77 of the CCA. I can also confirm that our laid down written procedures require the Bank to provide each customer with a copy of the agreement at the time of the paperwork is completed and this would of been provided to you. As per regulation 3 (2)(b) Consumer Credit(Cancellation Notices and Copies of Document) Regulations 1983 this copy does not require signing. I trust this information is to your satisfaction blah blah blah." So ive read enough to know for me to recieve a truly executed agreement it needs to be signed, so straight away i read the letter and i'm hit with legal jargon and dont know if this is right or wrong? Can it be it doesnt need to be signed under those regulations? Now to my "agreement", everyone else ive seen on here, tend to be one page, again this maybe down to them being credit cards and not loans, but this agreement is on 5 pages of HSBC headed A4 paper. From what i understand it needs to contain APR, it does, big box page one, cancellation notes, it does page 3, amoutn payable, it does, number of repayments, it does. So apart from it looking like it could be a new one and not mine, i just need to know where i stand regarding the signature. If it would help, i could post pictures of it, feel im beginning to whittle Just thought i needed advice before writing back along the lines of i require a copy of the executed agreement, i need to sign it for it to be executed, so Ive posted this in the cca thread as well, to see if i can get any suggestions on next move

This isn't for a credit card its for a HSBC Managed loan, so dont know if anything is different or slightly different.   9. I never signed up for MBNA on line banking or whatever it is. Did you? Wont it show you on there an upto date statement?
  10. Morning, Nope not heard a word, the last letter was received 08 June, so today is their last day. Didnt expect the sar to turn up on last day but it did, hoping for the same again, i very much doubt it though Dont want to file at court, just need to know how much interest they charged me and how much ive paid in PPI, not too much to ask is it.

  13. Well i changed the message a bit more, along the lines of 5% of contract time used for 58% of premium. Anyway, Egg dont mess about do they, just over an hour later, i have a reply, someone a Lending Servicing Specialist is passing it over to someone in the Client Liason Team, no idea on job titles, but asked me if my details were correct. Heres hoping for a cheque more than likely a copy of the policy
  14. They do lots of things, such as ask for ID, dont treat it as a full sar etc. Have a read in the MBNA forum

  16. To be honest, it came as a shock, as i previously posted i only thought i would have 3-4 ranging to £100 maybe. So hadn't really geared myself up for anything to big,thought they would refund £100 no problem, so when it totalled £600+ i was surprised, havent read many of the other Egg threads, can only go on the fun im having with other banks. I only asked for £600 because although the Egg Card account is closed, i defaulted on the loan to clear the card, i would prefer the charges money back in a cheque, so i stated i would only accept £600 in a cheque if they didnt agree, i would then persue the full amount plus further costs. I didnt realise they would be as easy as this, thought it would be a goodwill offer of maybe £200, then haggle before court, where as id just prefer a quick settlement if poss. Also it is one of my smaller ones £2k from HSBC, £2k ppi from Egg on the loan i defaulted on http://www.consumeractiongroup.co.uk/forum/ppi/97795-egg-loan-ppi-defaulted.html and lots of fun with MBNA.

  18. Hi Mummy Regarding the CCA they have, from you posting it 12 working days plus a further 2 working days to cover posting to send you your agreement. If after this time you haven't received it, your account is now in dispute, they cant sell etc. Then a further calendar month from this date is when they have committed a criminal offence( 06 July i reckon) Regarding your S.A.R - (Subject Access Request), have you tried sending them a secure message through their website, i did at the weekend, my loan statement arrived yesterday and a full list of my transactions for my Egg card arrived today and they waived payment Just sent them a LBA about my charges thro the secure message system again, as per my thread.   19. Well just added it all up and it comes out at £654. Sending the LBA through the secure message system, with a note asking if they need it in writing. Im asking for a cheque of £600 to settle within 14 days, if not full amount including interest and court costs

  23. Just reply and ask for a copy of your request to have the ppi added. He is telling you, you asked for it, now ask him to show you the proof, if he can then no, if he cant, then yes. Look in the PPI forum im just starting against PPI on an egg loan i defaulted on after 3 months, never got a penny back............. Will soon tho Well hopefully lol
