hiya all
again my apologies, ive got a lot better now since earlier in the year, ive still not had any letters from anyone regarding this and like others have advised i think i will stick it out till i do and then put in a request 31.15 if i get to that point - i feel i need to fight my other fresh claim from link financial for the moment,
however a little question, since there has been a court summons, if say hsbc do not do anything could this be statute barred eventually or wont it work in this way because of the court claim?

very long time ive not logged in apologies so much happened - illness, redundancey and now trying to get back to work
Have received a claim form from link financial ltd and i have till this weekend to enter the acknowledgement to defend all and then from a past case of mine i think i have to do a cpr request, but the site has changed so much since i last logged in i cant find my subscribed threads or ones showing id started, id had help on hsbc claim which i did a cpr and i will need to resurect that one too soon as its in limbo still
also cant get my scanner to work so will get dd to sort out for me later im hoping but for now will type up info

The claimant claims the whole of the outstanding balance due and payable under an agreement reference xxxxxxxxxxxxxx
opened effective from xx/xx/2007
The agreement is regulated by the consumer credit act 1974, was signed by the defendant and from which credit was extended to the defendant. The defendant failed to make payment as required under the terms of the agreement and by xx/xx/2009 a default was recorded. as at xx/xx/2009 the defendant owed mbna the sum of £5xxx by an agreement in writing the deed of assignment the benefit of the debt has been legally assisgned to the claimant effective xx/xx/2009 and made regular upon the claimant serving a notice of assignment upond the defendant shortly thereafter, and the claimant claims 1. £5xxx 2. interest pursuant to section 69 county court act (1984) atr a rate of 8% per annum from xx/xx/2009 t0 xx/xx/2010 of £6xx and thereafter at a daily rate of 1.28 to date of judgement or soon payment date.

this i think is an online credit agreement for which i only got a tick box photostated little peice of paper but unfortunatley i moved all stuff around so im relying on my memory will losing my job i became a bit disorientated and basically became a bit of a recluse in all matters of life, but hey ho,im willing to try and get myself sorted again, im sure ill be fine with all your help
after reading a few threads, i think i have to ask for copies of all the documents they claim in the poc, and also should i also ask for statements from day one and could i then counterclaim for the 12.00 charges that were possibly applied? also i read something about a tomlin order if i have to end up paying in back, can this be useful and also with me unemployed (though we are foster carers now not sure where that puts me on a legal standing if im still unemployed as such)
i would appreciate your help and any template guidance that i could request the cpr 31.14 is it from memory?

i also got your pm, sorry for my delay but fantastic help as always from all on this forum, looks like you have been helped with some fab info and also again fab help that i can now understand better for myself for my own bcard accounts so huge thanks to all as ive learned something useful also
take care and do your exams and yes the letters do intend to panic you but really do not worry over them at least you have told us about what your fears were but hopefully now you feel better and less worried

i will look at what ive had as the dn, but i asked for that in myprev cpr request if i recall and i only ever got the cca and no copy of the dn thus i will look at my info and get back to you
i was also thinking of pursuing my sars at this stage as they had responded requesting i send them a signature before they could supply the sars info and i feel i could do with that at this present time to help in other ways perhaps,
good idea on the inspect the document i had not even thought of that element that i could

a bit of an update
nothing yet received from sols or anyone else ref this -
am still without job but on contribution based jsa and i have been told its not the same as income based jsa, thus have had to pay for my eye test, glasses, prescriptions etc ,
however have my 13 week interview will bring this up as a final clarification if i can get the fee waived
otherwise guess will find the money to do what i have to do for the strikeout,
just weighing up what is really best to do, do i finish this off with a strike out as i feel its in limbo and thus waiting on statute barred but that s a few more years,
my credit file is horrendous thus no need to fight the dn entry, just a bit confussed whether me applying for the strike out would it not get them to persue me even more to a court case?
sorry not been too well and thus im slowly getting my thoughts clearer

Letter amended and posted today.
Arrived home tonight and in post today DN issued from Mercers!!!!
If I didn't have the knowledge of CAG this would really have bothered me, how would I have had any clue who Mercers are and how can Barclays act this way?
I will scan it and post it here tomorrow, but they have got the remedy date wrong! Why am I not surprised?
hiya dotty well mercers did that to me too, and yet it dont show on the credit file and no dn ever has shown to date - so i think it will be just a scare tactic and also im pretty sure mine really wasnt typed up in the way a proper DN should show
im sure others will come along and give further guidance but wanted to let you know my experience hope it helps

your explanation is fully clearer for me now, having read lots of info, i was a tad confussed but i had thought with hubby working we wouldnt get mortgage help and thus i just need to concentrate on getting work or get new training too so will let you know after tomorrow for others to understand too
do i need to take in my cv - my pc crashed ended up with a new one and a lot of my letters were in a file which i thought id backed up on a stick and now that dont work me and pcs just dont get on:mad:
i m doing a free spreadsheet course which im hoping can let me do this computer driving course in sept which understand will give me higher qualifications in all info tech
anyway go in and re ask for help im guessing life is too short to worry too much about it,

have been on job seekers contribution based allowance and due for my 13 week interview
what happens can anyone guide me pls,
also i read on another link info ref mortgage interest possibly being paid but my partner works full time and thus i wonder if we wouldnt get any help even though our house income has dropped a lot with me losing my job
past few weeks im become a bit low its really quite dis heartening when you call or write and you dont get a reply back:(
been checking on sites and papers and job centre
not sure what i have to show or what will be asked of me at the interview, never ever been in this position before and first time unemployed

still unable to find any letters advising it was a temporary affordability arrangement for 6 months to change from repayment to interest only.
My concern is nothing has changed - because im still unemployed and my financial situation has not changed and they are aware of this. so how can i fund or pay this extra amount with effect from 1 june 2010.
I just need to know can they force this change knowing my situation ?
letter sent as ellen advised today, but the above concerns me.

Hi there, did you receive anything in writing from the mortgage company stating that the conversion to interest only was just for six months? If not you need to write to them advising that you were unaware it was only for 6 months.
In the meantime - have you considered applying for the Mortgage Rescue Scheme? Frequently asked questions about the Mortgage Rescue Scheme - Housing - Communities and Local Government if you get in touch with Shelter they will be able to help with an application.
Thank you so very much Ell-en, that is fab info above, we have searched the sars info and all paperwork received and cannot find any paperwork to alert us that this was only going to be for 6 months thus we will write to them tomorrow regarding this,
also i personally not aware of the mortgage rescue scheme, it will be followed up by survivor also tomorrow, and yes shelter were very understanding on the day of the eviction over xmas, so again huge thanks
