  1. I was being harrassed by a DCA who banged on my door asking for payment. I told him I wasn't paying anymore until my CCA was provided with a statement of account. He laughed. I also told him that under ENGLISH COMMON LAW, people are allowed to visit my home without expressed permission, such as the postman. Under english common law i told him i revoked the license for him to visit me at my property. Should he return he would not only be conspiring in a tresspass, i would ring the police and take out an injunction. When, and only when I see the proof of this debt, I will make arrangements to pay direct to Moorcroft. Try it, might work. Knowing my luck though i'll end up in a worse financial situation than I am now, which I dont think is possible but hey, you never know. Worth a try anyway
  2. So basically they don not need to provide the information requested, is that what we're saying here? If that's the case then how can they prove that the debt actually belongs to you and not someone else of a same name?? This is why people like us get screwed. What is the whole point of asking for a CCA, sending the payment off for them to supply it to you, if iin the end, you still have to pay it?
  3. The house i live in is privately rented although i have lived here for quite some time. When i moved in it had a pre pay gas meter. I am finding this a real pain, however I was told to switch over to normal billing it would cost about £300 to change it. Any advice on whether this is correct or not?
  4. I have a bank account with YORKSHIRE BANK. I dont have an overdraft facility although i have the facility to set up direct debits/standing orders, and a switch card. They do a search to see if you have evr been bankrupt, not to see if you have bad credit history (thats why i chose it) However if you need an overdraft with them, they do a credit search. Hope it helps
  5. LATEST RE MOORCROFT Moorcroft collection agent has just called at my home AGAIN! Me and my partner have had a heated discussion with him. First he says they DONT have 12 days to reply because THEY have to get the information from Provident which could take some time. He laughed in my face saying that 'he's heard it all before'. He said they dont have to provide it and if they dont provide it in the time frame I told him, it WAS still enforceable because MR MOORCROFT wa one of the richest men in the world (wonder why that is!!) and these companies have rights too. So again, i'm really confused. He also said that Provident would just sell the debt on to another company if I started to be non-compliant. If Moorcroft cant provide the information requested, can PROVIDENT sell the debt on or is the debt completely unenforceable, by means that no-one can collect the debt? I AM FUMING!!!!!!!!!!!

  7. I sent the £1-00 postal order with my letter. I photocopied the letter which I have kept along with the receipt of the postal order, and I sent it recorded so I also have the receipt of that. They are not claiming they haven't received it, they have received it and it is on their system, but what they are saying is they DO NOT need to comply with the request as i HAVE admitted it is my debt by paying them. I was bullied into this by the coleection agent who I told to take me to court who then informed me that they didn't need to take me to court or get a court order to get the bailifs in now, so naturally I was panicked and came to an agreement reluctantly. If the CCA 1974 states that they must provide me with the information or if they dont they commit a criminal offence, then surely it would be illegal for them not to do and still try to recover the costs?
  8. I sent a CCA request to Moorcroft with regards to a PROVIDENT account. They still sent the collections agent to my home so I have spoken to them today to ask them not to do it again. I was told:- I still have to make the payments to the collections agent regardless They will NOT provide me with a CCA as requested because I know that the debt is mine as I have made payments already I would have been provided with a CCA myself at the time of getting a loan with Provident and therefore they dont know what I am wanting from them because its basically tough To resolve it now without any further action I could make arrangements to pay them directly IS THIS RIGHT??? DO I NOT HAVE A LEG TO STAND ON NOW?? I told them to comply with my request or the debt will be unenforceable and they laughed.

I have just read your post and the replies, and I think what people ar saying now is because they couldn't provide the information, the debt is now unenforceable meaning they cant collect the debt from you. If they do turn up with the agreement then obviously it will be up to you as to what action you then take. I personally would write to them and tell them that you are no longer willing to make the payments for the above reasons and should they wish to take legal action, see them in court. They have comitted an offence.
  10. Lowell Portfolio is who I have to pay the £10 to monthly. If they are not registered, are they actually allowed to take this money from me? Where do I stand with regards to that?

  12. Considering they have now doubled the amount owed and the costs are more than the 'debt'. Will any of us ever get rid of these people?

I have got dealings with the idiots here too, regarding an account from 6 years ago and I told them they couldn't reclaim the costs cos time had expired etc (didn't really know my rights) and they bombarded me with letters every few days until i made an arrangement to pay it back. I have a thread posted somewhere asking what I can do, but i think they all just use bully boy tactics anyway. I have bad health, depression, bad heart, etc, but they're not interested in all this, all they tell me is 'you shouldn't be in debt in the first place' I hate all these companies, they are all wearing me down physically and emotionally. I wish someone would set fire to all these companies and destroy all their records. (not that i condone such behaviour!! but it would be nice not to have to worry about what comes through the letter box)
  15. How can I CCA them when I never signed an agreement that I am aware of? What will that achieve?
  16. About 6 years ago I had an account with HSBC, and an overdraft facility (i think, but only for £100 if i remember rightly). I was ironically enough working for Baines and Ernst at the time, a debt consolidation company in Manchester. I ended up leaving here and as I received my final pay into my account, I decided to draw it all out (it wasn't that much!!) and spend it on some things we needed for our home. However, the same day as I had drawn the money out, Baines and Ernst decided they had overpaid me and took the money back out of my account, therefore causing me to go above my overdraft limit. Not receiving any money into this account, I didn't know until I had received a letter from HSBC demanding the account to be brought up to date. I angrily rang them and said I didn't know that people were allowed to take money out of my account without my permission (and it didn't have an overdraft facility on it or anything). They said if they had paid money in they had to the close of business to take the money back. I was that annoyed I stomped my feet and told them that there was no way I was paying for what I classed as their mistake, and asked them how they expected me to seeing as I no longer had an income. I didn't hear a thing, then out of the blue, 6 years later ot there abouts, a letter came from Lowell Finance to tell me that they had taken over the debt. I angrily phoned them and said if I was liable for it why had HSBC not contacted me since I disputed it 6 years before? Again, being the push over that I am, I had to agree to pay it back. At the end of the day its only £10 per month I have to pay them, but its the cheekiness of it I cant get over. Is there anything I can do for this or do I have to just grin and bear it? I have to admit to being in quite a bit of debt, although I am starting to get there. I just don't feel its fair that people seem to take advantage of me when I am at my lowest.
  17. My partner had a debt with online finance. This was for a moped he had bought before we got together. He heard nothing until a letter arrived from Shoosmiths solicitors, asking for him to pay £450 which is owed to online finance. He contacted Shoosmiths and came to an arrangement to pay £20 per month, and they accepted on a 3 month basis to be reviewed, and told him that they would send payment slips. When the payment slips arrived, I noticed that the balance they are now trying to reclaim is for over £900 but this is not the amount agreed on. Are they allowed to do this?

  19. thanks very much. I'm glad I found this site because I am learning so much more. When he first came banging on my door, i didn't have a choice but to arrangement payment, or at least thats what he told me then. I didnt know he had to go to court to get a bailifs order because he said that 'he is different from all that' they can do it without this action. Do I have a right to call the police if he refuses to leave my property without a payment?

  21. If any of you have read my previous thread, then you will know my situation. If not, here's a brief outline. I took a loan out with Provident Personal Credit in 2004 but then I moved. Last year a collections agent from Moorcroft knocked on my door and forced me into making a payment arrangement insisting that if I didn't then bailifs would be sent round. I said they could go to court for it, and he said it wasn't neceassary to do that, they could instruct the bailifs without a court order. Last week I ask for a coppy of my CCA but he laughed and said 'i had been looking on the internet too much' and I said, actually it was the CAB (which it wasn't, but i wasn't going to tell him that), and he said 'listen love, don't waste your time, we don't listen to the cab, its your debt, you know it is, and you're gonna pay it back like it or not. If i have to send a bailif round its £200 for him to knock on your door which will be added to the debt' I am by no means disputing the fact that I owed money to Provident, but I am sure that the amount they are trying to get off me is way more than it should have been despite this very intimidating guy informing me 'moorcroft are not wescot, we don't add any charges on the debt'. Do I still have a right to ask for my CCA? If so, if they don't provide it within the time limit, is the debt therefore unenforcable despite me paying to it already? And, does it matter that its a collection agent from Moorcroft collecting the money, because this fella really scares the hell out of me? Do I send the CCA request to Moorcroft itself, because if I gave it this collection agent i'm sure he'll laugh at me because he said I can't do it now. I have 2 children and as I say, this man scares me, very intimidating, and not only that, he knows how uncomfortable I am with people knowing my business, but he seems to go out of his way to make sure the whole street are aware of what has happened, despite me telling him not to discuss it outside. I feel humiliated, and more to the point, annoyed. I hate this man coming to my house, and if I have to pay it back, i'd rather pay with my bank card. What can I do???
  22. Not really but it was to keep the guy from sending the bailifs round, as i was that worked up I had to take his word for it. Does it matter that its a home collection agent for moorcroft?

A collection agent for Moorcroft has told me I have no right to ask for a CCA and even if I went to the CAB he would send bailifs round because he doesn't need a court order, and he's really intimidating. He said because I have been making payments I have therefore admitted the debt is mine so its basically tough. Is this right?
  24. I thought i only owed 400 but this guy has had me paying for 750. He told me they didnt need a court order. What if provident cant provide me with the CCA i signed, and does it have to be signed by me? Or can they just send a normal copy of it that I would have signed?
