Hi Rhia, Good Idea I sent SAR on 8th Jan (from template) Reply from MBNA thanking me for complant 17th Jan Sent reply 8th Feb stating not a complaint treat as SAR under DPA(from Template) No reply. 3 phone calls to remind them of their obligations . Got word of GOGW payment at this stage into an account that has been closed . Informed them they had only til the 20th Feb to comply with SAR. Issued LBA giving 7 days to comply No reply Complaint sent to ICO on 8th march claim issued 9th march anyone else had the same deal? Could someone please tell me how to post a link to my thread.....lol

My personal feeling on the matter intercity is that they will tell you anything on the phone and you are wasting your time. I have spoken to Mr.Doherty as well and he has made me promises re my SAR . Not once did he keep his word. I would just stick to your own timetable, the one you laid down in your letters and go for it. They want to delay you as long as possible. I have just issued a claim against them for non compliance to my SAR Good luck Ill be watching fingers crossed mate.

ok Claim lodged with small claims court in N.I.. Just waiting on verificaton now. Failure to comply with SAR under section 7 of the DPA. PLease please let me have filled everything in correctly!!!!!!!!! Feeling a bit lonely on this thread i think im posting to myself!!!!.....LMAO

OK Today i posted off the ICO complaint . Feel better already. Tomorrow im filing. Could someone please guide me as regards what damages to claim?? i think i am ok filling in the court form and POC just need some guidance for the damages?

Hi Suzy, been reading your thread with interest, i have had a similar experiance with mbna who i have just reported to the ICO for breach of DPA(SAR). They also issued me a GOGW payment into an account that has been closed for over a year....lmao Please please let me know how you get on obtainging your refunds from a closed account Perhaps the "closed account fairy" will leave a cheque under our pillow?......

I know how you feel.....lol Dont fall for their tatics. They want you so frustrated you gave up. No company in the world can be that incompetant The last to time i was on the phone with them(james doherty) they said they would sent me a letter to say more or less what you have just received in yours. I told him to send it if he liked but they were now in non compliance of my SAR and i would be filling for a court order to make them comply. We have got to just press ahead with our plan. However i take your point!they are lower than a snakes belly......lmao

Just one quick pointer davy. Make sure you adapt the SAR letter slightly to state that you do not want it treated as a complaint but as a full subject access request under the data protection act. mbna have been treating these SARs as complaints, and as such not issuing statements etc Generally they are a pain in the a___. So make it clear to them from the start what you require. Battleaxes thread has great details on SARs and what to request. Good luck!!!

Hi progenic, At least you got some form of reply...lmao I am just going to complain to ICO and issue a claim against them for non compliance. Perhaps if enough of us use this route we can force a change in their stratagey??

Just downloaded the "Data Protection Act 1998 Complaint form" from the Information Commisioners website. I am starting to fill it in now. Any help would be appreciated, especially concerning what info to include for the complaint. Dont want to send to much. Also can anyone help me regarding what to claim in damages when i get round to filling agianst MBNA for non compliance??

Quick update standard responce received on 14th February "sorry to hear your complaining we will sort it out in four weeks or let you know what is happening" blah blah blah LBA sent on 27th ferbuary i also amended the Lba letter slightly and added the following paragraphs: In light of the media coverage of these events and the fact, that to my knowledge,not once has Abbey defended there costs successfully in court, preferring instead to settle in full at the last possible minute, i propose to give you one last chance to settle this dispute with me. I am hoping your good judgement and finincial acumen will allow you to settle with me now in the amout of £1987 before i proceed to issuing a claim against you, were you will be liable for £1987 plus interest at the court appointed rate of 8% plus my costs ,plus your own legal fees. This would result in you being liable for an mount in access of £2500. Not only that but i will be informing the court of your obvious procedure of dragging these matters to the last moment possible before settling and thus abusing the court system. I require payment in full of this money. if you do not comply fully within 14 days then i shall begin a claim against you without further notice. Has anyone any thoughts on this? Dont expect it to make a difference but what the hey!!!!

I only differ from you beacuse i had the stupidity to phone them a few times and try to reason with them and make them comply........lol (total waste of time) By the way did anyone make a GOGW payment to your account ?

Rang again.......no joy,spoke to a nice quietly spoken girl called Nicola.She said there was no "expert" available to take my call......lmao I asked name of said expert and she said Dan Friar anyone came across this gentleman??? She was able to confirm £268 was paid into my acc (which is closed) on 12/02/2007 as a GOGW. informed them Again they are in breach of my S.A.R. and i want my details!!!!

Just an update..... 40 days has passed on 20th Feb so MBNA are now in non conformance of the data protection act. i rang them up to inform them and spoke to James Doherty in the customer advocates office (01244 672892). Informed him they were in breach of the data protection act. He informed me there was no one there to deal with my call(yeah Right) but had i recieved the G.O.G.W. payment of £268? He proceeded to tell me that i should have received a letter detailing my G.O.G.W. Where was it paid into i enquired? Your account he says well that would be hard because its been closed for over a year!! oh right he says but we have updated your account thats why you have a new account number but i will have to get someone to ring you back who knows more about it i then informed him i was putting it in writing they had a further 7 days to comply with my sar or its off to court he says thank you if you put that in writing for someone that would be great(PMSL) anyway my ring back did not materialize today (surprise surprise) so i will ring again tomorrow is everyone who writes in with a sar now recieving a G.O.G.W. payment at this stage in the hope that we will go away?????
