      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

About 6 weeks ago I issued my Data Protection Act. Initially they stalled and tried to get me to go through my branch and pay for each statement. (******** b*****s).

 

Anyway, finally got them last week.

 

It was shocking to actually go through the statements and I actally felt nauseous when I saw how much I had let them take. It came to £4380, all between 2000 and 2004.

 

I sent my first approach for payment and I got a letter from my branch manager today. Basically with the party line that the charges were in accordance with the banks published tarriff. Also I was suprised to be offered a £50 "goodwill" gesture.

 

Sorry Ms Tania Morris. Only a £4380.96 "goodwill" gesture will prevent this from going to court.

I sent an LBA on the 19th to my local branch. Recieved a letter this morning from Clydesdale customer relations this morning.

 

To paraphrase;

 

You were made aware of charges when you opened the account.

The charges have been applied properly according to policy.

Its your fault the charges were made so you're not getting your $$.

The £50 goodwill offer is still open.

Do I send the moneyclaim of £5300 to this chump or to the branch?

Is this £4,380 plus 8% interest? Moneyclaims need to be under £5,000 I understand, but the 8% can take it over. Personally I wouldn't bother with the branch unless you feel like sending them a copy. Seems to me the chump is the one dealing with your claim.

It is the interest that takes it over £5k. I can do it through moneyclaim, I just have to pay extra in court fee's.

 

Just a quick one on moneyclaim. It only allows you 1024 characters on the particulars of claim part. Is there anyway I can attach the spreadsheat itemisation of the charges and interest separately?

I am a little nervous about the possibility of court, but to be honest, I'd relish the opportunity to show them for what they are; opportunists who prey on the vulnerable.

Received the defence this morning.

 

Absolutely nothing in it that I haven't read on other threads.

 

However, it was signed by a "Senior Corporate Lawyer". Have others who have had defences filed had this, or have they wheeled out the big guns for me?

Me and My Mum (who's making the Claim) have also had a letter from the big guns, Kirstie Ross she's called Senior Corpporate Lawyer for UK Legal, basically Clydesdale Banks In-house Solicitors.

 

Dont let them scare you, thats all they are trying to do!

I was just wondering what happened to the balance of £8.13, that was taken from my account as a 'closing debit' when YB closed my account. It's on the statements YB have sent me in black and white. (maybe I was doing a little more than wondering what happened to it seeing as I know full well what happened to it, apologies mods)

 

Nothing libellous in this post I assume, I really hope I have to go to court though and YB can explain to a Judge where that money went and who it was paid to, as it forms a small part of the money I am claiming back.

Just when I was starting to feel left out......

 

Received the "carrot and stick" letter this morning. Offer of £2000 to save costs, with the threat of a counterclaim if I dont accept.

 

They're also disputing the amount of charges they have taken sent another load of copy statements. I'll have to go through 'em again today at some point to double check but their saying I'm claiming £400 too much.

 

You can ask me the question Noel.
