      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am thinking about claming charges from my Egg Account. From reading through the threads I get the impression its pretty difficult to get any refunds from Egg! Anyway, I had a credit card account with them a few years ago, I decided to ask about transferring the credit card balance into a loan (which I am still paying off). I've never had any charges on my Egg Loan, but I believe I had quite a few on my credit card. I understand that you need to have your account number in order to start the ball rolling and gain access to your charges and statements, but I'm not sure that I still have that information anywhere ..... could I just contact the company directly and request the information?

 

I'm a bit worried about approaching Egg as they do seem to be very awkward.

 

Anyway, any help would be greatly received.

contact them by phone they will have your account details, then send of dpa(sar) request...... by the time you get to our stage you will have seen some victories I am certain..... they are just getting as much interest on our money as they can before the flood gates open and i for one hope they go under and prudential close egg down.... they say they are responsible lenders , because they are internet based and allow to pay by direct debit????? they frequently increase credit limits without request to keep you within your balance.... This to me is not responsible, I know they can stop borrowers use cards as they often do if you go about £50 over limit so why dont they do it at credit limit so you dont go over.... this would stop them increasing credit limit and in my eyes be a much more responsible lender, I can not wait to see me st.claire, in his black bin bag(ref to phoenix nights) in court when I explain to judge, that although egg insist that they are within rights to charge £20 they have reduced to £16 when everybody else has gone to £12 (still not enough) , yet they have still increased their interest rates and cash out charge.... yet are still reluctant to refund any charges.... I doubt this will ever see a court room , but I hope you all join me in closing down your egg account even if you have to transfer to another card.... I would love to see the demise of egg....in numbers we have power, this site has proven that on so many fronts,,, I hope we can use this strength and this site and grow and go on to more challenging issues....

Only direct action by the masses will work....

 

Look at all successes they have never come from negotiation!!!

You can also check your old bank statements if you still have them. If you have paid from your bank acct your Egg number will be listed on the payment. I got my old acct numbers through Secure Messaging. For Info I still had to send proof of ID, fill in one of their forms and now they have just sent my Postal order back cos I never filled in who it was payable to. They delay as much as possible so if you send them everything first time then they cant delay (Hopefully!).

Quick Update .... I received an email to say that they have sent me out a letter requesting some proof of ID before they can send out my statements. I guess thats just standard then as my account has closed? Nice that they have at least responded and not just ignored me though ... but hey there's plenty of time for that!

I received a letter from Egg requesting me to complete an application form to gain access to my information. I have completed their application but also enclosed an SAR and the £10.00 fee. I have requested info on my Egg Card and also my Egg Loan ..... So here goes the 40 day wait then! :)
