    • The last photo shows the overflow carpark looking at the block which our room was located. When we got out of the car my partner thought that the building was for staff accommodation.  The unsecured bedroom window opened onto this car park.
    • Also I see that you are doing a lot of this on the telephone – and without any written confirmation. This is a big mistake. You need to start taking this matter seriously and so everything should go in writing. If you have telephone calls then they should normally be recorded. Read our customer services guide. You should make notes about every telephone call and then you should send an email to your telephone correspondence confirming what they have said or what they have agreed. It is important that you keep detailed paper trails here. Of course we may be jumping the gun and maybe big motoring world will step up to the mark – but I'm afraid that they have a lousy reputation has you have seen and so you need to start practising survival techniques and protecting yourself. You say for instance in your letter of rejection that the mechanic told you on the telephone that the gearbox needed replacing. Do you have any other evidence of this conversation? This is going to sound a bit harsh – but other people will be visiting this thread as well for their own purposes. You conducted their research about this company before you bought the vehicle. You now are fully aware that this is a company which can be very difficult to deal with and causes a lot of problems for many of their customers and yet you are still taking a telephone/verbal approach. Do I need to say any more? Also one of the documents you put up is an email exchange but it is not clear who is writing to who or what dates. If you showed this email to somebody in a pub they would be asking lots of questions about who sent the first message, who sent the second message, what dates were they sent et cetera. Please think about this before you post things. Please can you clarify the details of that email exchange. Please will you present the information carefully. We are all volunteers here and we have to rely on you to do the spadework

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I've just paid Excel £60 and now I've been reading these posts I wish I hadn't.

 

I paid them because I was worried I might end up with a CCJ, but I can see now I was worried about nothing.

 

I will never pay another so called "fine" from any private parking company.

 

Excel have taken control of Westgate retail park, car park in Wakefield. Customers who use this car park need to be made aware of the posts in this forum. I have written to Wakefield Express Newspapers and sent them a link to these posts.

 

I wish you all good luck in your battles with the bullies.

Yes that's where we were got, we took our new baby and two year old to Mothercare, Excel only cater for three able bodied parents to park outside Mothercare, and a great long row of empty disabled spaces, maybe we have a majority of disabled parents in Wakey ?

 

To be able to get the baby seat out of the car we had to take one of the many empty disabled spots. We were only parked for 9 mins, when we came back the attendant had just stuck a ticket on. When he saw us back at the car he came over and hung around for a confrontation but we just ignored him. It was difficult though I fealt like knocking the little s**t to the ground and ramming his digital camera up his a*se, but I managed to keep calm.

 

While we were reversing out more parents were parking in the disabled spots, I had to warn them all and point out the attendant to them.

 

I'm kicking myself for paying the "fine". £60 buys a lot of nappies and baby formula. I've written to Wakey Express and Mothercare, I'll post on here if I hear anything.

I think the more people who complain to the press the better. Oh, and the suggestion that we send them an empty envelope with no stamps on is a brilliant idea.

My wife has just told me I have another letter at home from Excel telling me they are "retaining my fine". I think I might write to them now telling them they must return my money, because they are not legally able to fine anybody, If they don't return my money within 14 days I will be taking THEM to court, and they will be liable for the court costs, plus my £25 costs.

 

I know I won't get my money back but I am wasting someones time in their office...haa haa.

Just sent this letter to Excel

 

Dear Sir

I am in receipt of your letter dated 16th September 2008, informing me you will be “retaining my remittance”, and that “no further appeals will be considered”. In my opinion no appeal has, or will ever be considered when the people deciding the outcome of any appeal are the very people who are claiming my hard earned cash.

I only paid you because I fell for your deception and believed you had the authority to fine me as the registered keeper of the vehicle in question. I have since however discovered that your company actually act outside the law.

If you intend to keep my money you need to provide me with evidence that you have the right to it. Firstly, have you any evidence to prove that it was me that parked the vehicle that day? And secondly can you provide me with details of the law / statute that backs up any right you think you might have to keep my money.

If you cannot provide me with the evidence required, please return my £60.00 within 14 days.

Failure to provide satisfactory evidence or payment within the specified time period will result in myself seeking further advice. You will then be liable to reimburse me any further costs I incur.

I will of course let you all know how I get on, not expecting any cash back but the response from Excel might be worth a laugh.

You have not replied to my previous correspondence dated 19th September 2008. And you have not returned my £60.00.

I am hereby informing you I have obtained a claim form from Wakefield County Court.

I am now claiming for:

£60.00 plus £20.00 costs

You must pay me £80.00 by 22nd October 2008.

Failure to make payment by the due date will result in a County Court Claim being issued against you.

You will then be liable for £30.00 court fees plus Interest will be claimed at 8% pursuant of section 69, County Court Act 1984.

I could understand you having a "pop" at me if my vehicle had taken the last disabled space in the car park in question, and your poor parents had nowhere to park. But the reason I have issues with Excel, Mothercare and the owners of this particular car park is that as I stated earlier PARENTS with VULNERABLE CHILDREN need to park outside Mothercare and they are being discriminated against in this car park purely for profit.

blue badge holders can park anywhere can't they ? Tell me Bircho, why should we be discriminated against, just because we don't have a blue badge ?

 

I do have a massive car though and I can't open the doors wide enough to get my kids out when parked in a narrow parking space.

Absolutely !!

 

As long as WHOEVER designed the car park in question leaves it having so many empty spaces with a little man in a wheelchair painted on them, then yes of course park. If they only had a handful of these spaces, and ample wider spaces for parents it would be a different matter.

Thanks for putting such a constructive slant on the debate as to how retail parks should enforce disabled bay abuse.

 

Abuse !!!??? How dare you ???!!

 

My vehicle was parked for 9 mins in an empty bay that had a little yellow picture of a wheelchair on it, along side many many other empty bays also with the same painting. Where is the abuse ?????

That was just about as constructive as ever into the public debate. I take it as you have nothing constructive to add you believe my comments about the abuse, do not condone its use and poster under the name I Hate Excel is not using these forums how they should be. As, when it comes to that matter, you arent.

 

I stumbled accross this forum, whilst googling Excel Parking Services. The people in this thread are all victims of Excel's unlawful deception and illegal practices.

 

By the way, just what has this got to do with you anyway ?

Sometimes people may have a genuine problems where they have been issued with a ticket or whatever and perhaps Excel have made a mistake. Then I can go fully with what you say. What I cannot agree with is you knowingly parked in a space you know you should not have parked in on the pretence that the landowner or whoever have not provided enough parent & child spaces. You then took it to blame Excel for this using their name as your username when really all they have done is carry out their job for which, I am sure, the vast majority of people in the country would support, that is parking in a disabled bay when you are not supposed to. And you are now using the forums to try and get advice on how to riddle out of paying for something and, on top of that, except to gain sympathy from a judge.

 

I have a feeling you are either

 

a. An Excel Employee

b. A Traffic Warden

c. An argumentitive tw... with nothing better to do than pick fights on furums.

Neither of them three, I'm afraid. In the same way as some people hate marmite, I have been in car parks where I have been unable to park in disabled bays when needed.

When we haven't got enough parent/child spaces left to park in, we can't park in the street, we'd get a fine. A legit fine probably not a pretend fine like the one I got from Excel, which I have paid by the way, it's not the money, I am not just trying to get back £60, it's the way Excel are [causing problems] everyone, and as I pointed out before, the more people who challenge them the more chance something will be done to stop them.
