  1. In My Humble Opinion (IMHO) dont give up, at the end of the day its them that are fu*ked (by not supplying the credit agreement) not you so dont worry and keep the faith. you will be ok regards paul

  3. i agree with powelll they should not be issuing a default, infact they cannot issue a default as a default notice can be considered enforcing the debt IMHO which is prohibited while they are in default i:e the twelve days have expired and no agreement. i think its time to tell them to sod off (politely of course:D ) and worry more about finding your credit agreement rather than pestering you for money regards paul

  6. Sharon Daboul seems very helpful. sent a settlement letter when she said she would and has told me my other halfs money will be sent out on monday so seems good so far
  7. Thanks Crusher i will be removing the funds from lloyds in the morning and once they are in my new bank account i will of course make a donation as every little helps regards paul

Well i have been speaking to SC&M and they are now saying that they will be taking 4 weeks to settle my claim. they have had the acceptance letter from their offer,they recieved it on thursday and today i have recieved an order from teh judge saying the defence is struck out in accordance with directions dated 18th may. the defendant may enter judgment. now i have a dillema as i doint know what to do. do i enter judgment or wait for SC&M which will be quicker regards paul
  11. Hi, well apparently Barclays have sent a offer letter out today so hopefully we will get it tomorrow and send it back straight away as long as the figures match up so fingers crossed. regards paul

Hi , i would carry on as per the script so to speak and send the bundle off, then i would email them. if you miss the deadline by relying on them to settle it could cause you problems in the long run. personally with my partners claim i am not trusting them until the money is in the bank,they have said that they are going to pay and i have been told a settlement letter is in the post but til the money is in the bank im carrying on with the claim as per usual regards paul

Not sure if you want to move the thread as it would appear you have issues relevent to this part of the forum. however there are a lot of people who advise in the Debt Action Group section that could give you advice on the CCA request side of your problem so its probably an idea to start a thread /request for advice on your CCA request in the Debt Action Group forum regards paul

Hi there it would appear that they have sent you an application and not a credit agreement, however teh best thing to do is go to the Debt Action Group section of this site http://www.consumeractiongroup.co.uk/forum/general-debt/ and start a post here as there are a lot of people in that forum who could possibly help you out with some advice regards paul

Thanks GuidoT, nothing wrong with being a hardline sceptic:D especially where it concerns LloydsTSB the thing is Lloyds have added 105 pound worth of charges since the offer and it has put my account well over my overdraft with my other payments which have come out of the account so i was thinking of using this meeting thing to put presure on the bank manager to waiver the fees in return for me paying enough money into my account to pay for the items i have used to bring the account back into credit other wise i just issue another claim again regards paul
  18. Thanks Sparkie. i was wondering if anyone could help me out here, i have been asked via SC&M to go to my bank and have a bank review to see if my current arangement is the best for my needs do i have to do this before i get my money or should i wait til i get the refund regards paul

Hi Sarahbeth, yeah 2-4 weeks was the time they quoted me due to the high volume of claims. i only found this out when i rang them as there was some discrepancies in the letter they sent.i returned the original letter and took a copy for my records. still tehy had better hurrry up and pay as my file is with the judge at the mo due to their non compliance with the judges (most excellent) directions so if they dont pay soon i would think the judge will award judgment anyway. regards paul

Hi sarahbeth, congratulations i had exactley the same two letters drop through my door yesterday so it would appear the norm i have signed the letter and returned it to them but i have been told by SC&M that it could take upto 4 weeks to get the money paid into my account as they are extremely busy with all the bank claims . regards paul

Well, i aint got the money yet.... but i did get a letter from Lloyds TSB (SC&M) offering a full settlement although it did have conditions attached but im not worried about that as i have moved banks im not going to get the title of the thread changed to WON yet as i dont have the money and dont want to tempt fate so to speak. still good luck to everyone who has lloyds claims going and dont give up regards pt2537

Hi nah no worries it was just that i got a little carried away with the info comms side of things and forgot to mention the OFT and TS. im glad you pointed it out otherwise trojanska could have been pursuing the wrong track with regards to the CCA request. thanks again paul. ps i cant type quickly to save my life, one finger or the tip of a pen is the best i can do, thats why it takes so long for me to reply:)
