  1. Ok My LBA was sent early this week. I have begun the invetiable and started look at the court bundle as It appears nobody inany thread hs recieved ay further contact from Barlcay during the LBA stage. I have download the court bundle and read it. It very unweilding and I could do with getting ahead of the ball now. Iam I right in assuming that: 1. I need a copy of all of there correspondence. ( including statements ) 2. A copy of my letters sent to them. 3. the contents of the Court bundle. Addiitonal i could not find any material in the court bundle that I need to personalise, is this correct ? The only personalise documents are what i have pointed out in 1 and 2.
  2. Spoke with James today (01244 672628), I explained I was now not in position of any correspondence from them and my LBA was due to be up on the 8th March. He was at first not intrested in take any of my account details and just told me the letter would be with me before the time was up. I politely told ok and if I had not had anything by then , i would be proceeding through to the courts. Has anyone had to go beyond the LBA stage with MBNA???? Because I am for now sure ready to.... Barclays are now only 2 weeks away from the same too..... seems i am going to be busy!!!
  3. 8 Days remaining on LBA, I get the feeling this could be a court case.
  4. Rung mBNA today before sending LBA. They young lady said they have a full 28 days from when i sent my first letter so I will get a response on or just before 8th March. I hope they pay out in full other wise its court here we come. Also they didnt comply properly with my SAR and only sent statrment. Correct me if I am wrong but a SAR covers any information they have upon me does it not and an manual interaction they have made on my account. Advice to all you skilled experts out there please ?
  5. Hi All, Recieved a letter recently from a Ms Harris in the Barclay Retail Banking Customer Relations Dept in Swansea. She thank me for my letter and basically says she is unwilling to pay the goodwill gesture as aprt payment as i will be seeking the balance via the Small Claims court. Do I send a LBA in the next two days or should I now begin my claim through the courts. This is the second letter of this type as my first claim attempt was on estimates. Any suggestions ?
  6. Got my call back from an arrogant women called Claire. She claims she has a further 28 days to comply. I kindly told here that she was wrong and that she could contact me in writing when a decsiosn had been made. In the mean time I was sticking to my timetable. I also mentioned she did not comply with my SAR and only passed the 6 years worth of statements. and what they were proposing to do with the non compliance. They said I would need to write in and send another £10. Surely this is incorrect and anyway there opurtunijty to comply has gone. Can any one advise who and how to carry this forward. I guess a LBA letter asking for them to comply might be the answer or should i notify the data protection regitrar immediately ? Your advises are welcomed.
  7. Spoke recently with Nicola Clement. All thou they seem to think thye know there things. They back down if you give them the facts. I am awaiting a call back tommorrow. So we will see what happens.
  8. Letter now dispatched today (12/2/07), so I guess I should not really expect much from barclays now and begin my court bundle.
  9. I didnt think you could claim the intrest unless you were going to court ?
  10. Hi all just about to send the second prelim letter with actuial figures this time. I am right in saying I can only reclaim my fee and not the intrest levied on them ( unless it goes to court ). Is that right or can i claim th intrest they have imposed on me too. Any Advice. I dont seem to see a clear answer in the threads, and the pre lim letter suggest fee plus intrest.
  11. Statements have arrived and the quick initial tot up with the calculate suggest near £2000. So the pre lim and letter showing my list of charge is being sent in the morning. I guess the games now begin. I reckon it will be april before i see my money the speed of barclays
  12. Have submitted my prelim letter today after rin them for my maximum intrest rate. I was supposed to be speaking to Colin but got a lady who kindly informed me the intrest rate is 24.9%. At this point she didnt attempt to indulge me in dialague over a settlement and said they will be in touch when they recieve my preliminary letter. So it lets wait and see time now. I will also now have to address the fact that my SAR was not complete and althogh i could calculate the fee and charges for the last 6 year ( yes not before ). I do not have a SAR which is complete in any way. Any recommendation on this ! What will I get if i choose to take this further ? I prrsume you can take them to court for not supplying the full SAR.
  13. Jeeze i was shocked they offered £500 but the sum of fees were over £1100. With standard intrest and contractual intrest the total is over £2800. Can this be right, it surprised me and it going to surprise MBNA to that I jhve done my homework ( even if i had some help ) James
  14. Was your claim successful for contratual intrest as well as standard intrest ? What rate do you put contractual intrest at ?
  15. Hi recieved my statements today, but they say for a full SAR i will need identification and a £10 fee. The have given me also a £500 goodwill payment as a full and final payment. I have total my fees up and they are over £1000, but i dont know how to add the intrest ( contractual / compound ). I have use the simple england bank template to total my fees. Could anyone tell me how to change the percentage ( 8% ) to 27% or send me a simple credit card excel sheet. When I have calculated this I will send my prelim letter, in the meantime i will write to them saying I shall accept the £500 as a partial payment. After the prelim been sent is it worth pursueing them over the telephone, additional I am going to pursue them for a full SAR. Any advices on this as I think this maybe a separate issue. HELP
  16. OK a quick update: Sent Estimates of charges Then Asked for statement after branches said they couldnt. Barclay then send initial offer for £735 I then I send a letter saying I will accept this as part payment whilst i await my statements. Today I recieve a letter from Helen Davies, from Retail banking customer relations in Swansea. She thanks me for my letter then goes onto say "I am sorry you remain unhappy following our response to your compliant and not that whilst i am accepting the amount offered, you will be seeking the balance through the small claims court I confirm our offer, made as a gesture of goodwill, was in full and final settlement of your complaint. As such, I am unwilling to pay you the sum of £735 as an interim measure" it then remind me i still have time to accept there offer. I assume its say to say this is standard practice with Barclays or has anyone else recieved a part payment before persuing the rest. Any advice at this point. I am still waiting my statements.
  17. Ok the bank show my DD as stil there ? I cannot make any sense out MBNA. No money has been taken by DD this month. I assume it there choice to not take the money by Direct Debit. If I want to start paying by dd i have to go through form filling again. Great !!

  19. OK I have had a response from Barclays, in reference to my original claim on estimates. I shall post the details later. But in essence the letter says it all wrong but as a good will gesture they will offer me £735 but this is ther final offer and i have to sign to agree this and send the letter back. I am obviously not got going to accept this as i have recently now written to them asking for my statements. I shall tell them i will take this as part payment and pursue them for the outstanding amount. I assume barclay wont actual pay this to me though as a part payment and when my statements come i will need to right to them again request the actual amounts.
  20. 14 days in and still waiting. Can any one tell how long it takes barclays to comply with sar ? No acknowledgment and money not taken from account either ?
  21. chris_d I havent even had any paperwork from them yet so i cannot calculate that yet. I suspect it wont clear the balance either.
  22. Starangely enough after my phone call, I had a call from MBNA collections saying my Direct Debit had been cancelled by them and would I like to pay my balance for this coming month plus what i missed over the phone. Is this not harrassment when its not due to 7th Feb.
  23. Rang MBNA RE the letter and was told this is a standard letter ( as per the million others osted here ). Very pleasant lady explain my document would be be with me very shortly and that they have had a lot of people now claim there fees and penalties back. No further movement thou and was told just to wait for statements.
