  1. Hi AllisonStephenson - First thing you must do is start your own thread. (or the moderators will be ticking you off! Just start one under the heading of the bank you bank with and call it AllisonStephenson vs (Bankname). Secondly you have already started the process, by sending the preliminary letter. Do not break step - send the Letter Before Action from the template site. Whilst you are waiting for a reply to that - Go back and read All the FAQ's again and the step-by-step instructions. Once they reply to your LBA telling you to get lost - file a claim at Moneyclaim online. Its all in the Step by Step Guide. Hope this helps.
  2. Its fine to be concerned, we have all been there. But, if you ask for advice and receive the same answer from 3 different sources, and don't act on that advice, then the only other solution is to start again to satisfy yourself that all the steps have been taken diligently in order that in the very unlikely event that you go to court you will not slip up on a small detail. I would say though that as you have your proof of posting you should be ok. The mail was sent in good faith and if you read all of the postings re Halifax on the site, then you will note that most letters do not get acknowledged by them. I didn't even check if my own recorded delivery letters had been signed for by them - I just stuck to my timetable and my account is now £1700 better off for it!
  3. Nope - Mine was deemed served on 3 May - they acknowledge and stated that they intended to defend. They paid up in full on 17th May. So it looks like the money fairies might come to you either today or tomorrow!!! Good Luck
  4. I really don't mean to be negative here, but you asked advice - three separate people have given you the same answer, and yet you seem not to be hearing it. I would suggest you have two alternatives a) post another letter to satisfy your own concerns. b) take the advice given.
  5. It will be the day that it was deemed served to them (I think from memory you can either check that date online, or you will receive/have received a letter from MCOL giving you that date. It is defiinitely not the date that the bank acknowledge the service. Hope this helps
  6. Brilliant News C&S!!!!! It seems you, Sean and myself all had a visit from the money fairy overnight!!! They paid £1690 into my account this morning!!! Whoopppeeee!
  7. YAY!!!!!! Power to the People!!!! Halifax settled with me in full this morning! - The odd amount they credited to my account yesterday was in fact the interest charge and court fees - they put the rest in my account this morning! - Keep the faith everyone you WILL get your money back!
  8. YAY!!!!!!!!!! Well done Sean! I also had a money fairy visit my account yesterday, but they only deposited about 20% of my claim, so am waiting for the rest! (Maybe they couldn't afford all of my claim in one go after paying out for yours! LOL!) Great News!

Hmmm still no correspondence from the Halifax....HOWEVER, there is a mysterious credit on our account today for about 20% of what I am claiming....Have no idea what this is for as we don't use this account anymore (funnily enough because of the exhorbitant charges they were levying!!). Guess I will have to wait and see if a letter comes explaining what it is all about....
  11. Nope, nothing yet, my bank account is still sitting there with my OD in it!! - they have until 1st June to settle mine, so a couple more weeks and I will either clear my OD or go to court!

  13. Hi Sean My claim with the Halifax is running at the same time as yours, can you keep me posted as to what happens with you and I will do the same? I have had the same response as you to all my letters - zilch.. although I have received a letter from the court saying they intend to defend, but have heard nothing more so far.
  14. Absolutely - too little too late! Who do these blo**dy banks think they are??? You can bet your bottom dollar they wouldn't give us 7 days! Good for you Guadge, hope you get your money and soon! Keep us posted!

    Also, depending on what information you already have you might need to use the Data Protection act request template or if you already have all your statements then you can just send the preliminary request for refund of charges template. If you don't have your statements, send the DPA request and don't forget to include a £10 cheque. This is the absolute maximum that they can charge you for all the statements you need for the last 6 years so don't be fobbed off by them if they try to charge you more. Once you have sent the DPA letter they get 40 days to respond to you. Hope this helps

  18. You too They have ignored everything we have sent so far, except this. We have not even received a partial refund (which of course we would have accepted graciously, before pursuing for the rest of our money!!) Will hop over and have a look at your thread..

Good luck chipsandsausage - My claim is running at the same time as yours - I have received an acknowledgement of service this morning stating the Halifax intend to defend....which gives them till about the 1st June to file a defence. I am waiting with baited breath to see what their defence is going to be - maybe we will all find out finally how their charges are made up?? I hope so, it would help everyone else on here so much!
  20. Received my acknowledgement of service today - they state that they intend to defend my claim in full Bring it on - will be interested to see what their defence is... Apparently they now have 28 days to file their defence. Anyone else at this stage with the Halifax? Would be interested to know..

  22. I just entered the total I was claiming for - i didn't provide a breakdown - I had som many charges I wouldn't have had room for anything else!
  23. Hi - Stick to your timetable not theirs. This is a common tactic with them. Just push ahead after your 14 day deadline. Don't break step.
  24. Thanks Guadge and Blindman - will make a note in my diary. Actually to be honest (and you may think me masochistic!) but I really hope they don't ignore this - I would much rather have my day in court. My other half (who originally didn't believe that we could claim these charges back) is now coming round to the idea now that he is seeing the results on the Litigation thread! since transferring everything to Barclays (ok ok I know none of them are perfect!)we haven't had nearly as many problems!
