  2. It must be the day for it:- Droyds have replied regarding one of the accounts they are dealing with, it reads as follows:- Thank you for your letter dated 09/07/2007. In view of what you advise we agree that the debt in unenforceable and further action has been withdrawn. however there is a debt still outstanding and the registration of the debt at the Credit Reference Agency will remain. Yours faithfully Now obviously this a good result but surely if they are admitting that the debt is unenforceable then they cannot leave the debt still showing as owed at the CRA's - not sure about this, any advice please much appreciated, thank you

Hi Can anybody help please because I am at the end of my tether with Roxburge - they had passed the account onto a solicitors (graham White) as mentioned above - I then sent the letter Default letter (from Josie) to Roxburge and the "Bog Off" letter (from PO) to the solicitors. I have now received another letter from the solicitors, more or less saying I have been sent two copies of the agreement - (both of which were unreadable (as stated above) by the way) and their client (roxburge) has suggested I attend a local branch (Next) to discuss any further aspect of your agreement and account. It then goes on to state that unless payment is received withing 7 days they will have no alternative but to revert back to their client for their instuctions to commence legal action for recovery in the Small Claims Court and then the usual threats re: baliffs, CCJ's, Attachement of Earnings etc. It also has a nasty message at the bottom stating "ACT NOW BEFORE ITS TOO LATE" I am at a loss as what to do next so any help would be appreciated, thank you

Hi An going to send a CCA request for this tomorrow, just wanted to know should I mention their tactics, ie -saying they were a courier company etc, or ask for a complaint procedure in with then CCA request. Not sure if I should or if I should how I would word it. Any advice much appreciated, thanks

Stupid "people" I am not going to book an appointment,I am not going to contact them, I am going to CCA them, is this correct? Can they serve papers - I don't think they can, can they? Am very cross now - their tactics are terrible

Thanks for all your replys - I'm dealing with other DCA's (thanks to this site and have had great help and support, all CCA request gone and even some non-compliance letters) - I think it was just the methods used by Ruthbridge that got me. When I first rang they said they were a courier company who delivered parcels, packages etc and that they were holding something for me so of course, being stupid and naive, gave them my mobile number. I rang back again as something didn't seem right and after fobbing me off for a while they said they had legal documents from Ruthbridge so I searched Google for Ruthbridge and it came up with the same address etc. They have called my mobile but it was switched off and they left a message saying they were from Ruthbridge Legal Dept - abolute w*nkers (sorry for swearing). Will have to get a new sim card I suppose. I don;t know where my other threads are - they might need joining together as they are so may DCA's on my back and I'm not sure where to turn next or what to do and I feel like I;m bothering everyone - not sure - anway just wanted to say thanks, will await the "legal documents" with interest and keep you updated.

Hi had a lletter this morning addressed to "the Occupior" from Express Deliverys so I phoned them up - they said they had some legal documents from Ruthbridge Debt Collectors to send me so are going to send them. I've googled Ruthbridge which has the same address as Express Deliverys ??? and now I am scared stiff - what legal documents, what can they do, I'm at the end of my tether and am sat hear crying. What do you they mean by legal documents - will I have to go to court. I don;t know what debt it is for and I just can;t go on anymore. please can somebody help me????
  8. Hi all Hope I make sense here - I have CCA'd Droyds for 3 different account, they have failed to provide a true CCA, only sending a sample CA. The 12+2+30 days passed and I heard nothing more and thought that was the end of it. Now I have had letters from 3 different DCA's relating to the same account - am i right in thinking I should now send the non-compliance letter, adding the Data Protection thing - ie: they cannot pass my details on to another DCA etc etc and copy the letter to Droyds and the new DCAS. What should happen then as it feels like they will just pass my details onto DCA's until they get their money. Any help much appreciated, thank you

Roxburge have not supplied me with a readable copy of the alleged CCA and have ignored my last letters now it has been passed on to Graham White Solicitors (which is a trading name of Mchael Sobell, Solictor, Regulated by the Law Society, Registered Number 18321) Should I just give up now and offer a token payment. Any advice very much appreciated

Have had another letter from Roxburge - included a copy of the alleged CCA - still unreadable but they say it is and I can go in to a Next store to get one if I want to obtain a sample/blank agreement for clarity?????????????? It also states payment proposals are required within the next fouteen days or they will continue with their collection procedures. The copy, from the bits I can read are as follows:- Credit Agreement Regulated By The Conusmer Credit ACt 1974 welcome to the next Directory. Please complete and sign both copies and return the part marked 'our copy' in the envelope provided. Then I have filled in my name and address and account no. Then there is a section" how your directory account works", I can't read this bit. Then "Important you should read this carefully, you rights" Then I can't read the rest apart from my signature and that of someone signed on behalf of NEXT which I think is pre-printed if that makes sense. Can anybody help please. Thank you
  12. hi Advice need if at all possible the 12+2+30 days has passed since I requested the CCA from studio - have heard nothing else from Studio but..............had a letter from a new DCA on behalf of Studio stating "Intended Court Action". What should I do next, surely they shouldn't have passed the account on whilst it was in "default" Do I CCA the DCA or do something else - any advice much appreciated.
  13. Thanks Josie I CCA'd Studio over 12=2+30 days ago - they replied that they do not have to have a CCA for Home Shopping??? After this letter from them I've heard nothing since and now got this letter from a DCA - do i send the letter you posted to the DCA or Studio. Or do I send a CCA request to the DCA.   14. I've just received a letter from another DCA acting on behalf of Studio. I have CCA'd Studio and they more or less said you have to pay it, Home Shopping doesn't fall into the CCA guidelines ect. This DCA is iQor Recovery Services and is a letter entitled "Notice Of Legal Proceedings" This is a notice if intended court action, valid even if not read by you. Take notice that documents are being prepared for the issue of proceddings for recovery of debt details of which are given below You are required to pay the full amount by 21 June (today!!!!!!!) Any ideas anyone??

The ones I am talking about today will have passed the 12+2+30 days tomorrow, unsure of what to do really as like I said, I haven't heard anything from some of them (so thats ok) some have them have said they have requested the CCA from the original creditor (does the timescale still apply when they are waiting for it?) Bit scared of getting TS involved at the moment as I am scared of what they will say - they'll think Im a right one and shouldn't have got into debt etc etc. Anyway, thanks for your help
  16. Thanks for all your support people. Its very much appreciated. So can I report them to TS even though they've said they are waiting for the CCA from the original creditors? Also does this still apply if they have passed the account back to the original creditor. I'm not getting any letters etc - seems to have gone very quiet but I suppose it won't last for long. Also, we have a few accounts with one DCA, I have requested the CCA for 3 of the accounts which they have responded to but the other accounts we have with them I have heard nothing, not a threatening letter or anything even though I haven't requested CCA's for these account.

Well. its now been 12+2+30 days (or will be tomorrow) since I sent some CCA requests, some of them haven't replied at all, some of them are saying they are passing the account back to the creditor and some say they are awaiting an alleged CCA from the original credior, so my question is what do I do now, if anything. Any advice much appreciated.
  18. I think I'm getting to the stage where I just want to give up - there are so many DCA's on my back it might be better just to offre them a token payment. I seem to be confusing everyone and I feel like I am just bothering everyone. On a slighly brighter note I got a reply from Intrum Justica saying they had passed the account back to the creditor at their request. But the creditor doesn't have a CCA either - another cataloge company. I just can't for the life of me understand why these companies give you credit without getting you to sign a true CCA. Are they not aware of the law?
  19. No, sorry PO, the DCA that wanted my address was a different one - which was why I wondered how to respond. This one is Activ Kapital or something. I CCA'd them and the this was the letter I got - please confirm your addresses since 10/2001. they state they have a copy of the CCA and I cant understand why they need my addresses. I am pretty sure that this one what I signed was an application form. Roxburge have sent me copy statements but I only sent the letter you suggested yesterday asking for a copy of the CCA that was readable so I suppose I'll have to wait for them to respond to that? Sorry, if I've confused you - I confuse myself sometimes

Post has just been and I've had a letter from Roxburge - (first letter posted on OP) they've sent me a load of copy statements but as I sent them a letter yesterday saying i wanted a "Clear" copy of my CCA (meaning one that I could read - as per PO's advice) I think I'll just hang fire and see what their response is to the latest letter I sent. Is this the right thing to do? - the "alleged" CCA wasn't clear at all, in fact it was unreadable and we weren't sure if it was an application form or a true CCA.
