  1. Hi all The above company had passed the 12+2+30 days but were still chasing so I sent them the non-compliance letter - they have responsded by sending me copies of statements but no CCA - where do I go from here? Are the statements enough? Any advice much appreciated, thanks

  4. Thats all they have sent me - should I go to TS or reply to this/them first. Is there a template letter I can send? I even entered my DOB wrong - I put the year I opened the account instead of the year I was born but I obviously didn;t sign this before opening the account as I entered my account number and flexible card number. It was for a catalogue but you got a card to use instore ITMS. Sorry to bother you
  5. Thanks There isn't anything on it but:- Littlewoods Flexible Account Credit Agreement Regulated by etc etc I have filled in my name, address, account number and signed and dated it. They have "signed" it and thats it - not a word more, nothing, zilch which makes it so puzzling I suppose i should be pleased but am so confused, there are no terms and conditions - nothing. Not even "we will/may carry out a credit search, we may report to CRA's etc etc- absolutly nothing!!!!

Hi I have receieved a response fom CAbot in relation to my CCA request, the letter states: We have a customer by the name of xxxxx and unfortunatly the information supplied to us by the origimator was out of date. As a result we used valid tracing methods in an attempt to locate our customer and your details were amongst a number of name matched that were found. At that stage a letter was sent to your address requesting that you contact us. Please contact us to confirm your previous address so that we can confirm that the account is linked to you. We can then proceeed in investigating your dispute in this matter. Now the debt is for an old Argos card that was taken out some years ago, in fact I would imagine that it is statue barred but cannot be certain. I need to repsond to this as I dont want them to send a letter to my parents address (where the debt was taken out) my mum has the same initals as me so I dont want them to know I am in debt so where do I go from here? Do I confirm my old address or just send a letter regarding the Statue barred rule even though I am not 100% sure it is thoughI am about 90% sure. I moved in here in March 2002 so will have lived here for 6 years in March and the debt was taken out at my old address................

Hi folks I have recieved a response to my CCA request regarding a LIttlewoods account and am mightly confused First of all there is a compliment sip from Credit Account Managament in Woking, Surrey, then there is a compliment slip from Littlewoods stating please find attached copy of signed credit agreement with the word "Phoenix" written on it then my original CCA request with the words "DRD Sold", "Scotall" , "LX", PO1907" all written on it - not by the same person and doesn;t look like they were all at the same time ITMS. Then we come to the "Agreement" which just states Littlewoods Fleixible Account, Credit Agreement etc and all there is on it is my name and address and account number which i have filled in (no DOB though) my signature, which I've also dated and a signature from them which I cannot be sure if its pre-printed or not - they havent dated it and thats it!!! No T&Cs or anything. Nothing else at all, is this a true CCA?

Hi all I have received a reposnse from a DCA regarding my CCA request for Littlewoods Fleixible Account there is a compliment slip from "Credit Account Management", then there is a compliment slip from Littlewoods stating that a copy of CCA is atatched with the word "Phoenix" (another DCA) written on it, the my CCA request which has written on it DRD Sold, Scotall, LX, PO19070 then a photocopy of an agrreement which just states Littlewoods Flexible Account, Credit Agreement regulated by the Consumer Credit Act 1974, I have filled my details such as name and address in and signed and dated it :o there is a signature on it from Littlewoods but am unable to tell if it was preprinted etc and they haven't dated it and thats it - just my name and address and signature and account number all of which I have filled in. Is this a true CCA?
  10. Thanks for that - I'm going to try it, after all - it can't really do any harm can it? Its worth a try I think. It just suprised me that they offered a reduction of a third (and its a very, very large OD!!) to settle now or to pay in 3 monthly instalments (still with a third deducted).

  14. i appreciate the fact that I did not have to sign anything regarding the OD but the Halifax have also not sent my any documentation relating to the OD, to say I could have one, the repayment terms etc etc. Surely they would need to do this to make the debt enforecable, in fact, surely for any sort of credit to be made available some sort of process has to be carried out?
  15. Would I be able to procced as I haven't had any letter whatsoever regarding the OD, in fact the only agreement I signed was for a basic bank account with no credit facilities.

I dont mind at all - its the Halifax and I have reclaimed charges but they wanted to use them against the OD if that makes sense so, perhaps stupidly, I didn't sign the form agreeing to accept them. I argued and argued but they stuck fast to their offer that the charges must be used against the OD.

  18. Yes, I claimed back the charges and they just deducted it from the amount outstanding but they are or have been adding interest of approx £300 per month
  19. Thanks, does this mean that if they cannot provide an agreement for the OD (the original opening of the basic account was taken out in 2001) the debt is unenforceable?
  20. Hi folks I have/had a large OD with a major highstreet bank - they passed the debt over to a DCA whilst still addding interest. I CCA'd the DCA who never responded then out of the blue I have received a letter from the bank offering me a third off the debt and i can also pay it in 3 monthly installements if I require - which obvioulsy I cannot afford. So back to my main question, are OD's within the remit of being able to request a CCA - I originally signed a form for a basic account, a couple of years later it was upgraded but I didn't sign anything for this to be done - then an OD was added which they kept increasing. I also havent signed anything for the OD Any advice much appreciated
  21. Well they didn't turn up And i had tea and biscuits waiting lol So I will wait to see what their response is to the CCA though they haven't signed for it/received it yet according to the RoylaMail website.
