  1. hi, can anyone tell me, what is the limit for filing claims with MCOL? my dad has been pursuing a case with his bank, for around £1200 - does he need MCOL or N1?

  4. i have sent the council a letter asking for a complete breakdown of the overpayment, including reasons for the overpayment, and also copies of any previous correspondence regarding the alleged overpayment, but i dont know what to do when i get them??
  5. help... i have had a letter from Philips Collection Services Ltd, saying that I owe the council 569.60 in overpayment of housing benefit... I have repeatedly asked the council to prove where this overpayment was made and how, as I am fully aware of the little loophole in the law that is: "The law of Estople quotes that if you recieve an overpayment and did not realise, and if to repay the money would put you in a worse financial position than if you never recieved the overpayment the amount does not have to be repayed". well to be frank, the council have never told me: a) when this overpayment is supposedly for, b) how they worked it out, and their reasons for working it out at the moment, I am really in a bit of a tight spot financially, and there is just no way that i can pay back 569.60. also, i dont feel that i should - the last time i claimed HB was Jan-April 2006, and I kept them fully aware of my employment situation - i even returned the final HB cheque to them unpaid as i had started work, but they hadnt updated their computers, and i thought "sod's law, if i bank this, theyre gonna want it all back..." so i returned it. can anyone advise on what i should do? the bailiffs are saying that if i dont pay them in full within 7 days they will 'take further recovery action' help....????

  7. shall i write to the CE with a letter along the lines of... having spoken with AP from your call centre, i wish to make a formal complaint...blah blah (give the reasons as stated above)..enclosed are copies of the previous letters as well as a list of the food lost... and give the CE ten days to respond with payment before i get energy watch involved?
  8. just had a call from an Alan Pendleton from SP.. he said that there is no way that they are going to compensate me for the food, and he's going to send me the standard £50 and that is it. I reiterated the fact that a representative of SP had entered into a verbal agreement with me by promising me the compensation, and his reply was ' well he shouldnt have, but anyway, we're still not going to compensate you' what do I do???? do i now write to energywatch? or do i write to the CE?

  10. Hi again... this is the new thread for claim # 2 against rbs.. in brief, prelim letter sent 26th March, updated SOC with another letter sent 28th March (deadline NOT extended however) will keep you all updated!

  13. update..... charges have now increased to £309 so have sent another letter with SOC but have not extended my deadline - they still have 14 day from the original letter dated 26th march, so deadline is 9th April
  14. if you find it could you let me know where it is? I'm not sure which of Glenn's threads to look in - theres so many!! gonna be needing the POC's myself by Friday if barclays aint pais up (and its not like theyre going to now is it!?)
  15. i got that in my offer letter from RBS - i wrote back accepting their offer, and also mentioned that any action taken by them to force me to make other banking arrangements would be classed as retaliatory and that I would not hesitate in taking further action against them! he he he... i got my money from them too btw. no such luck with barclays though...
  16. busy yes, but i feel that it is worth the work in order to get my money back! its amazing that companies think that they can get away with it!! i mean christ, since the 8th march, i have had £240 paid into my account, and have 'spent' around £200. and i get paid on friday...however, RBS have charged me over £260 so the £200 i legitimately spent all went through over my o/draft limit! its insane! if they hadnt charged me that £260, there's still be around £40 sitting in my account...
  17. im getting really into thie reclaiming my right lark! so far, ive got claims going with brclays, #2 with RBS, have started one against scottish power for compensation, applied to egg for default removal, and am gathering information against the DWP because apparently there is a loophole in the law which means that they cannot claim back their overpayments to me if they didnt notify me that i was being overpaid my JSA (which they didnt)..."The law of Estople quotes that if you recieve an overpayment and did not realise, and if to repay the money would put you in a worse financial position than if you never recieved the overpayment the amount does not have to be repayed".
  18. just a quick update, have been off sick for a week, and in all that time, have had no response from SP, so sending them the following letter today: I am very disappointed that you have failed to respond to my letter of the 12th March 2007 a copy of which is enclosed. As previously mentioned in my earlier letter, I have sought advice from Energy Watch on how to approach the matter of compensation from yourselves without having to involve Energy Watch, however despite my earlier attempt, you have failed to settle my complaint. I am also disappointed that I have had no communication from yourselves regarding the loss of power sustained on the 8-9th March 2007, despite numerous conversations with your customer services department ensuring me that you would be in contact within approximately 10 days of the power to my property being restored, and a conversation with the engineers who came to repair the fault who promised me that I would be compensated for the loss of freezer food. I am writing to inform you that I will give you 14 days to reply to me accepting, unconditionally, my request in principle and letting me know a date by which I will receive payment as requested in the attached initial letter, sent to yourselves on 12th March 2007. If you do not respond, or you do not respond positively, within this time period, I shall send you a letter before action giving you a further 14 days in which to reflect. I believe that these targets are more than sufficient for a large company such as yours with dedicated staff and departments. After that, there will be no further communication from me and I shall issue a claim with Energy Watch against yourselves at the expiry of the second deadline. any body have any thoughts / advice??
  19. ive had nothing from barclays since their rather pathetic offer of £750, given that my claim is for £2600 i wasnt too chuffed... theyve got til friday (when i get paid) before i pay the £120 and file my N1...
  20. how far along are you? just wondering whether they are likely to get shirty with me. its not with this barclays account, its with my RBS one, but still...
