  1. Hi all, Yes another welcome finance thread! My situation is : I have had an account with the above (cant bear to type the name again) for approx 4-5 years - different loans. I wrote to them on 26th sept 07 requesting a copy off the CCA, also including a harrassment by telephone and PPI letter. The CCA sent because as explained to them severeal times my disability allowance was suspended in april this year, (for which we have appealed and have a tribunal next monday) and consequently we have been unable to keep up the repayments on the loan. For a while this was acceptable to Welcome until they passed it to a Debt collection agency, to which i have no written correspondance - just an address! This company have bombarded us with calls day and night despite being given the facts. Hence i then send a harrassment by telephone letter followed by a PPI letter. Two days later i recieve 4 phone calls within 2 hours! AAARRRGGHH!! I rang them back and spoke to a (very polite) chap who promised me the earth basically, to reduce the (completely inflated) balance due and come to an arrangement with me to cover the PPI concerns, also to erase any charges put on in the last 4 months providing my husband rang the PPI team to make a claim for the time he himself had been off sick from work (broken wrist). This was all with agreement that i also make a full months payment £176 at the end of Oct. Now my query is - after reading lots on here and also whats been on tv recently, what would you advise i do? Should i request that they adhere to the contents of my letters? As i have had several loans over the years (each been a new loan and consequently paid off the first with additional PPI) can i request all details of the PPI charges etc dating back to the first loan i had? Sorry for such a long post!! Maudy
  2. Hi all I wrote to DLC on 8th August to request a CCA copy. They now write to me in the name of Hillesden Securities just to confuse matters. Anyway since then i have had 3 or 4 letters apologizing for the delay and that they are trying to obtain a copy! To date still no copy. My question is how long do i allow this to go on for? and is there anything i should be doing in the meantime? I have also hit them with Harrassment by phone and PPI claim! Thanks in advance Maudy
  3. Hi ODC I will PM you my defence - altho im not sure how to do it. Thanks Maudy
  4. Hi ODC Yes i rang the court this morning and expained what i had got from FW Oakes. The lady said that no judgement had been entered and there was no need for the company to send such a letter, she couldn't understand why they had. She also said they had attempted to enter a judgement but couldn't because i had entered my defence (even tho i was late in doing so)! So now im not sure what to do. I dont really want to speak to the company. Maudy
  5. Thanks Dave I will ring the court first thing in the morning and then send back if they advise. Huge thanks once again Maudy
  6. Hi Patrick i have no copy of the CCA - they didnt send it and i think the first letter says that they were unable to provide it.
  7. Hi Dave Thanks for that. I will ring them first thing. Do you think this means that i haven't got to pay them then? Thanks
  8. Hi Dave Yes it seems they want a signature - i have only obscured my name. I didn't want to sign because i wasn't sure what it meant,
  9. Hi Dave I have checked on MCOl and it doesnt appear that a judgement has been entered?? Thats why i was confused. I was late in entering my acknowledgment but the court wrote to me to confirm receipt and when i entered it there was no sign of a judgement. Thanks Diane
  10. I have just looked at this also - it came with the above letter in my 1st post! Maudy
  11. Hi all, I have recieved a letter from FW Oakes solicitors on behalf of Empire stores. I requested a copy of the CCA after they filed a court claim through MCOL. I have recieved the attached but do not understand it. Could anyone enlighten me please? Many thanks Maudy
  12. Hi Thanks for the replies. I realise we have a problem and we have been trying to sort it out. I will send the CCA request today along with the harassment letter. Diskmanddave - we have been working with National debtline which i think may be along the same lines as the one you mentioned. I will have a look into it however. It seems that if you have over 15K in debt you can sort things but as we have approx 10K we are below that threshold. Thanks to every one for their help
  13. Hi all, Apologies in advance if this type of thread has already been dealt with but i am in such a mess right now i cannot make head nor tail of anything. Five months ago we got into a mess with loan repayments to Black Horse for a £3500 loan which we took out 2 years ago. We arranged to pay a reduced payment of £49 per month which we have managed to do since despite being difficult to do at times. Last week we recieved a letter from Direct Legal & Collections - see attached letter. From the threads on here it seems that the next step maybe to request a CCA, is this the right thing to do? They are calling my husbands mobile up to 5 times a day, even as late as 7.30pm. Thanks
  14. Hi Thanks for you reply. We have recently moved and i dont even know if i still have the info They really know how to make my day worse! Maudy
  15. Hi all, I have received a letter from the tax credit office (HMRC) requesting details of my last few years tax credit awards. They want me check whether the last few awards were based on the correct income figures and if they took into account all the relevant circumstances! This particular letter requests details from 2004-2005 tax year - i wouldn't know where to start looking for this info! Does anyone have any idea what i can do? Thanks Maudy
  16. Hi Tomterm Thank you i will get this sent first thing tomorrow Huge thanks once again. Maudy
  17. Hi Yes it was the same Feel really stupid now Maudy
  18. Hi Tomterm - i was so pleased about littlewoods! I have already posted my defence although it seems it may be incorrect, is it posible to add to this? Dont worry about posting tonight, i will check back tomorrow evening. Thank so so much once again Maudy
  19. Hi First of all can i say thanks for the replies which i didn't realise i had until now!! The POC are as follows: 'The Claimants claim is for a sum due from the defendant to the claimant under a contract for telephone services and or equipment hire' Short & sweet! On a postive note i followed your advice with littlewoods and recieved a letter from the court yesterday stating that littlewoods had discontinued the claim!!! Thanks Guys
  20. Hi tomterm sorry for the late reply! the debt is actually for line rental - not unpaid phone use, i.e i stopped using the phone before the contract expired if you know what i mean. As far as i am aware there are no fees (late or otherwise). Moorcroft have taken me to court not O2 - thats why i assumed they had bought the debt. Acknowledgemnet was 12th June and my defence was 4th july. thanks - hope you can help you'v been fab so far
  21. Hi The debt was for an unpaid mobile phone bill, basically i had been payin an agreed amount and got behind, the last payment was made 6 months ago, they have sent me various threatening letters ever since (moorcroft who are acting for O2). The debt is £150 plus £70 court costs. Thanks Tomterm
  22. Hi tomterm8, this is a separate debt from the littlewoods mentioned at the beginning of the post, how do i contact 'laiste' and who are they? I'm panicking a bit now because i just assumed that it was the same procedure, its the same situation as littlewoods -i.e - really old debt been bought by Moorcroft. Thanks for your help - please send more lol Maudy
  23. Hi, What does that mean for me then? Do i have to pay them? needless to say the postal order they say is present was not
