  1. Hi Is it possible they may have omitted to send this copy of the original loan agreement because they no longer have it? If so what are the implications as this is the period of PPI i am disputing? Thanks

  3. Hi nicklea thanks for your reply. 18 months ago i did all the sar, court action etc and settled for an out of court settlement (a measly amount) which we now regret very much. These charges (total approx £600) are from March 1st 2007 as we haven't used this account since so charges have just been added. Barclays are so unhelpful so we are now in the same position. They have sent statements since May 2007 but they are very difficult to understand. If you have any more advice i'd be really grateful. Many thanks Maudy

  7. Hi I have written to Barclays on my husbands behalf as he has mounting bank charges for overdraft etc. It has now been passed to Debt Managers Ltd. I sent a SAR and CCA request - they have provided the statement info but say that as it is a bank account it is not governed by the consumer credit act. Is this correct and if so what can we do next?   8. Hi I have sent several CCA requests to Capital one and each time i get a letter saying that they will not send it unless i sign the letters. I obviuosly wont do this and have sent the template letter stating that they have been happy to send post to the same address etc but still they wont send the CCA. My question is what do i do next? I recieved a letter from Welcome stating that they had provided all the info they hold on my account already - what on earth am i supposed to do now? I feel like i am banging my head against abrick wall. The info i need is the PPI info from the very first loan we had - if they wont provide this what do i do? Thanks in advance Maudy

  11. Hi all My friend is Polish and has basic understanding of the employment system however i am asking this question on her behalf. She has been on Maternity leave since Nov 1st 2007 and gave birth on January 4th 2008. She has worked for the smae complany for almost 3 years and would like to extend her maternity leave to the full 52 weeks available but is having problem composing a letter to her employer. Does anyone have any templates for this sort of thing? Many thanks
  12. Thank you Hobbie Thats fab - the whole issue relates back to the PPI and as i said before i wrote asking for the SAR in order to obtain the PPI info so i think it should be okay to put that in. I also need to write to Compliance services to ask 'again' for the relevant info - oh joy! Thanks so much for your help - they make my blood boil!
  13. I have just penned the following letter to the local branch who are hassling me at present. Any comments would be greatly appreciated. Dear Sir/Madam I would like to respond by saying clearly that we have also tried to resolve this situation on numerous occasions by requesting all documentation of accounts held with Welcome finance since 2003. To date we have still not received this information despite paying the associated fees in relation to the request. We have received (letter from compliance services dated April 3rd 20088) information dating back to 17th August 2006 however the S.A.R - (Subject Access Request) letter sent to you (dated 10th March 20088) clearly requests ‘entire loan history’. As this is the second SAR made to Welcome, (first SAR letter dated 29th October 2007) and you have failed to meet the demands of the SAR for a second time, I now consider you to be in default. We have been trying to obtain this information for the past six months, the documents provided to us in the SAR contain proof that we have done so, therefore you cannot claim that we have acted unreasonably. I also refer to your ‘threat’ of the account being passed to a debt recovery agency – whilst the account is in dispute with Welcome Finance that passing the account to a DCA would not only constitute a breach of OFT collection guidelines, but also a breach of the Consumer Credit Act 1974 and Data Protection Act 1998. At this point in time I have written to Compliance Services in an attempt to obtain the requested information for a third time, once I have this I will contact you in order to discuss matters further.
  14. HI Hobbie Yes thanks - much appreciated. There is a 'log' style document of a good few pages contianing each attempt or contact we had with them. This dates back to the very 1st agreement (for the car) but that is the only reference to that loan - very strange!

Hi Hobbie I sent the SAR in the hope that it would clarify the amount of PPI we paid for the car loan - we had been paying for 3 years before voluntarily returning the car to them so i know we have paid through the nose so to speak. I only sent the SAR to obtain the precise figures as my paperwork is not as it should be (tut tut!). I thought they must be in default - will pen a letter now. Thanks Hobbie
  16. Hi I am at the end of my tether with Welcome Finance and need some advice in the hope that i may stay sane for a little longer! To cut the story short after financial difficulties we have been in dispute with Welcome since February 2007 and have been hounded by telephone and letter ever since. In 2003 we had a loan through approved car credit (financed by welcome) and at the time were advised that we could not have the loan/car unless we took out PPI - so we did. Over the past 14 months i have written to Welcome requesting copy of CCA,SAR etc and they have sent me a large bundle of doc's which i don't totally understand. I have a CCA dating from a 'top up' loan in 2006 but nothing dating back to 2003 which would show the PPI i object to having paid. I have requested this info and surely a SAR would cover the entire period as it seems we have had the same account number throughout. How do i now ask for this info for what is likely the 4th or 5th time? Many thanks

Hi We have had several unsecured loans from the dreaded welcome finance over the past 7 years and each time i have been told that if we didn't take out PPI we would not be able to have the loan. I am registered disabled and although i work when i can, i was under the impression that i had been paying PPI to cover against unemployment - needless to say it would be of no use to me at all as pre-existing conditions are not covered. With this in mind i wrote to welcome and stressed my dissatisfaction, they wrote asking which one of us is disabled. When i found the policy it seems that the PPI only covers my husband so i feel a bit silly now, on the other hand this confirms that we were mis-sold the policy as i was under the impression it covered both of us and shows that the policy was not explained properly. I think i still may have a case as we were also told that without PPI = No Loan! Does anyone have any advice - as i have to respond to their letter asking for clarification as to which one of us is disabled! I hate Welcome finance lol! Thanks in advance
  19. Hi My friend took a job at the beginning of January as a home carer. She was not told certain things during the interview i.e that she would not be paid for the time which she travelled between clients and when she worked out the amount of money she earned she found it wasn't worth it. When she recieved the contract of employment she did not sign or send it back as she did not agree with the terms and had decided to resign. She then resigned and has just recieved her pay cheque, the company has deducted £45 for a CRB check which she was not informed would happen and as she hasn't signed anything we wondered if this is actually allowed?? Could anyone kindly offer advice? Many thanks

  23. Hi What kind of letter would i use intially to obtain all of the information? Would it be something like an SAR? I guess as i don't have all the loan ref no's i would just have to give them all of our previous addresses so they can search?? Thanks Maudy
