  1. Hi again Thanks for getting back to me - it takes me a while in between posts as Im currently undergoing chemo so apologies for the delay. So what do you think I should send now - pursue the CCA as the letter does indeed state 'This arrears notice is required to be issued under the CCA 1974' - i guess i could enclose a copy of this said letter along with a CCA request??? Or should i send a SAR? Thank you to everyone who replied - i appreciate it so much as does my lovely friend Maudy xxx

HiAt work today and my friend has bought in some paperwork relating to the DCA info - its an arrears notice from HSBC dated March 2010 and clearly states that 'This arrears notice is required to be issued under the CCA 1974' and goes on to quote that it relates to a credit agreement...... Does this mean that it IS a credit agreement and therefore we do have the right to pursue the CCA request??Failing that SAR will be done this evening lol :-)Many ThanksMaudy xx
  3. Hi Thanks for your reply. No the ex is not around - he doesn't help her financially or any other way and i think communications have broken down and so she is not aware if he is being pursued for it. She has explained to DCA that its a joint debt and they don't seem to care. So do you think the only option is to send the SAR? - Is this the only way we can find out if its a loan or account?   4. Hi all I am writing on behalf of a very good friend who had been receiving hassling phone calls at work from a DCA (Rockwell). When i enquired as to why she was avoiding the calls she explained that they were a DCA who were calling continuously about a debt she had incurred whilst with her previous partner, he had left her with two children to cope on her own with a joint debt of just under 10k. I asked her to bring in a letter from the DCA and offered to send a CCA request and also a harrassment by telephone letter which i did just over 2 months ago. They promptly wrote back declaring: 'We can confirm that the account assigned to our above named client relates specifically to a current account and as such is not regulated under the CCA 1974. Due to the nature of this account there is no written agreement to provide. The enclosed statement showing repayments is your acceptance of liability' So when I read this i questioned her further and she described what i can only interpret as a 'consolidation loan' offered to them by HSBC, she has since provided a statement from March 2010 which describes it as a 'Managed Loan Account'. Now Rockwell are still making calls despite the letter i sent them, and i wonder where we can go from here. The previous partner has left her with two children, one on the way and pays not a single penny whatsoever and she is frightened to death of the DCA turning up on her doorstep. Is there anything we can do now?? Thank you in advance Maudy xx

  7. Hi Sorry for the delay - it must be 5 or 6 years (possibly more) since we took out the loan. I will go through all my old letters and see if i can locate my last contact with them - should have done that first really!! Many Thanks Maudy

Thank you so much for your reply - I had hoped they were talking a load of hot air but they seem to be more and more convincing each time I wouldnt have a clue where to find the agreement - do i need this in order to pursue? With regards to a soc I dont actually know how much PPI i have paid - do i need to find out and if so how? Thank you so much once again xxx
  10. Hi all I had a loan some years ago (joint loan) from Black Horse - at the time we took it out they did the usual - you cant have the loan without PPI etc and so we opted for it. After going through severe financial hardship and finding myself a full time wheelchair user, we fell behind on almost everything. Now we are left with £4500 debt with Hillesden securities and they are now threatening to transfer it to a Debt Surveillance Programme where regular reviews into our financial circumstances will be conducted to assess our suitability for litigation action. I have contacted Black Horse a couple of years ago regarding the PPI but didnt get anywhere Can anyone advise on what I can do? Kind regards Maudy xx
  11. Hi I have recieved a letter from Cabot financial (lucky old me!) stating that they have now purchased an aco**** i held with barclays bank (its an overdraft totalling £1600). I haven't paid into this account for almost 4 years and as most of the amount owed is made up of bank charges I had forgotten it existed. Attached to the letter from Cabot is a letter confirming (from Barclays) that the account has been sold and any further enquiries should be addressed directly to Cabot. Cabot have now started calling my home (dont know where they had that number from as I'm ex directory) and my mobile several times a day, is there anything I can do at all? Any letter I can send them to stop them - I am disabled and am so stressed with it all I dont quite know where to turn Kind Regards Maudy xx

  13. Hi I am hoping someone maybe able to advise as my sister needs urgent help! She received 3 separate letters from Phoenix Collections about 6 months requesting payment for council tax dating back further than 6 years - She cant remember specific dates but has lived down South for the past 6 years so its obviously longer than that (the debt is originally from a diff council to where she now lives). She had a bailiff on the doorstep on Nov 9th and her hubby was home at the time and 'got rid' of him however she has now received 3 further letters claiming that the account will be passed back to council who will seek a bankruptcy order!! Please could someone advise what she should do as I wrongly or rightly thought that if a debt was over 6 yrs old the company couldn't claim. Has this been 'sold' to Phoenix do you think? Hi and thanks for the reply, Yes I have a copy and I'm sure someone on here checked and confirmed it is enforceable so I (altho my memory is hazy on this) think that just left me the PPI issue to throw at them. Its been a case of waiting to see if they pursued it and its been so long now i had almost forgotten about them lol! Until this - a rather nasty bullyish letter i might add! Is the Statute Barred 6 year date from the date I last made a payment?? Thank you again

Hi all I have today received letters (1 each for me & hubby) from Ruthbridge Ltd claiming that if i do not make payment by 6th Nov they will declare me bankrupt- this is no threat to me as we have been through this before and are still coming out the other side! (Discharged 2002). This debt in question relates to a Black Horse loan taken out in 2005 which was transferred to Hillesden and now it seems to DLC and Ruthbridge - confusing! We defaulted on the loan due to my ill health and when we realized we had been a victim of PPI mis-selling i immediately wrote to them to complain, after hearing nothing I forgot about them - only receiving 'updates' from Hillesden to say they were still searching for my CCA copy! After 12 months of searching they did in fact find it and I have heard nothing until recently from these scumbags. So my question is what is the best way to proceed now? I know that Hillesden have a copy of the CCA but what about the PPI issues? And is there a letter I can send to get them off my back for a while longer? What is the timescale when debts are no longer 'chaseable'? Many thanks in advance Maudy x
  18. Hi Chris, They refunded the money within 48 hours but only after we were persistent that it was not our transaction! They sent us a letter about 8 weeks after asking us to sign to confirm it wasn't us but haven't heard anything since. Still no clue as to how it happened either! Good Luck xx
  19. Hi My hubby has been recieveing calls from a company called Advantis credit, with ref to a Powergen account (amount £488 - 2 yrs old). My plan is to send a 'harassment by telephone' letter but i wondered if there is anything else i can do? I.e - are there any template letters someone could guide me to for offers of repayment? Does anyone have any experience of asking companies to write debts or reduce the amount owed as i feel they may have sold the debt onto Advantis. Many thanks Maudy xx

  21. Hi Shadow I have have attached the scanned copy i have stored on my PC (not sure where the paper copy is) so hope its readable. I posted some time ago asking where to go for advice on if its enforceable but didn't get much joy. What would you advise on how to check this? The grouns for PPI reclaim is that I am disabled and have been for many years, plus the fact that we were told 'No PPI = No loan'. Thank everyone for their advice. xx
  22. Hi I have a joint debt of £4516.80 with ref to a personal loan from Black Horse, Hillesden Securities took over the debt 2 years ago and I sent numerous CCA requests. I finally recieved a signed copy of the cca 12 months after first requesting, i have also attempted to claim back unfairly sold PPI to no avail (its been a while since i dealt with things). Now I have a letter from Direct Legal Collections saying that they will accept half of the outstanding balance if i contact them asap. Given my current situation i have no money to pay these people but wondered if there is anything else i could do? Many thanks Maudy xx

  24. Hi all I have recieved a demand for payment from Credit Security Ltd regarding an outstanding overdraft amount of £1666.66 with Barclays. The letter is a standard demand but says 're: Wescot Credit Services Ltd - Barclays Bank Plc' - does this mean that Credit Security are one and the same as Wescot?? As well as demanding payment it threatens that a collection officer will be instructed to call at my home if payment is not made, is there anything i can do regarding this debt as my husband is currently out of work and i am off sick after suffering a stroke. I am trying to plough thru all the paperwork i have avoided for the past few months but am becoming more and more depressed! thanks maudy xx
