  1. I have had a letter now referring to my preliminary letter saying the charges are correct and the 280 i found in my account last week was a GOGW. I started my court claim Friday 23rd and it was issued 26th so need help with following having read around: which is the best way forward? 1. I let court know I have had a part payment by ringing them. 2. I can either adjust claim at next stage which will be settlement ( doubt it) or AQ or deduct from my claim when settled. 3. I should write to Abbey with rejection letter 4. I should write to Abbey accepting as part payment for claim and raise awareness of where proceedings are now. 5. I should not write to Abbey I think number 1 and 4 but not sure if I need to explicitly reject GOGW offer Help please! Fran

Did Abbey send you a letter or anything???. I wouldnt ammend your claim as its not your fault the figure is different now. You could write to Abbey and inform them of this and that if it was for your claim then you will accept as part payment and take them to the cleaners for the rest. Well in about 3 or 4 months after they stall and stall!! this is waht sparkydawg says and I am going to accept it if it is some payment of my charges and just deduct it from the amount I claim at my next stage in the process as I have filed a court claim FRan
  4. thanks sparkydawg no, no letter or explanation but will write to bank and acknowledge in next stage of claim - it's just been an intermittant reward for me that has reinforced my impetus and drive to carry on til the bitter end. I want my money back - all of it Fran
  5. Hi I never had a reply from my lba and filed my NI on Friday gone - waiting for post from court. Then this morning I have 280 quid paid into my abbey account - all refunds. My original claim was £1998 so it's peanuts but still amazed. What is going on? If it is a GOGW why is it such a piffling, random amount? What do I do next? Fran
  6. Hi - thanks but have done spreadsheet and worked out 8 percent - Answer to my query : it's the charges x 0000.22 to work out daily rate that I will also claim on N1 form - not charges plus 8 % x 0000.22. It is good you are slightly ahead - you sound like you know your stuff. Good luck

Hi Lula - thanks for replying to me - have written in another thread of yours but shall write again is it a) charges 1998 + 8% interest 441.22 x 0.00022 = 54 pence per day or charges 1998 x 00022 pence per day = 43 pence per day ( this is how it appears on page 2 of CAG NI Particulars of Claim - Hard Copy Version - which why I am a bit worried) sorry for being so thick but need to know before I start my computer claim form thanks Fran

Hi - feeling a bit unsure as the hard copy NI particulars of claim says charges + OD interest times 0.00022 for daily rate but this thread says it would be charges + overdraft interest ( I am not claiming for OD interest) + 8 % s.69 interest times 0.00022 for daily rate is it the former or latter - just don't want to get it wrong thanks Fran
  12. I have prepared my claim form so I can type it up at work tomorrow as don't have printer at home and am stuck in the value section you write charges, 8 percent interest, court fee and total. Then underneath it says ..plus interest pursuant to s.69 county courts act 1984 from date of issue to date of judgement settlement at £ x per day I have times my charges 1,998 by 0.00022 which comes out at 0.43956 so I have called it 43 pence a day from date of issue to date of judgement. Have I got my sums right? Yours quite exhausted
  13. Michael Browne has replied to me saying that my schedule of charges for court is the crucial one. I have corrected schedule now because put a couple of wrong dates on it including the title stating it claimed up to December 2007 when I meant December 2006. Will the original schedule - sent with preliminary letter and LBA which is not correct and new correct schedule cause problems? Should I send my corrected one to the bank stating that there is couple of amendments which will be used in my claim. The schedule doesn't go with the NI form at this stage anyway does it? Any advice - thanks F
  14. Anyone calm me down? I am going to start my claim tomorrow and realised my schedule says claim from 19.9.2001 to 20.12.2007 and the last two claims are December 2007 - of course I meant to write 20.12.2006. Just been so busy and rushed all the time so didn't spot it before. I have sent this obviously wrong schedule with my prelim letter and lba. What do I do? Send a corrected one to bank with explanation and pursue starting claim tomorrow as 14 days to respond are up. I also wrote to OFT as threatened in my second letter but do not know the address - anyone know it. Everything seems to be going wrong - can't believe I made mistake on schedule. Fran (P. O.)
  15. Hi I am not going to claim any compensation - I just want to be sure they can't turn round and say they never received it and therefore I haven't followed the 14 days to respond guidelines. Feel happy now that provided computer says delivered and I ring Royal Mail to check this then Abbey can't say they haven't received it. Fran
  16. Thanks for reply- yes I feel unlucky as other claimants in my office have got a signature and typical I don't get one despite my efforts. It says delivered on 8th March so I will carry on and file claim tomorrow. Just didn't want it backfiring and Abbey not recieved/ filed letter despite it being delivered. I think I will also ring Royal Mail to check if delivered means it was delivered to the address or just left the depot.

Hi I sent my lba on the 7th March recored delivery and www. royalmail shows it was delivered on the 8th March but no signature so I do not know if it was received as I have had no fob off letter yet and I got one from my preliminary letter within days. I am going to ring Abbey later and if they haven't received it do I resend and give them another 14 days to reply? I want to follow procedure appropriately. Has anyone else had this?

Hi in the LBA template I have included the section about writing to the OFT - sent LBA today but can't find information on a script I can send to OFT = anyone done this too - what did you write in your complaint letter to OFT - worried my threat is empty- just for interest a colleague of mine received full refund of charges from RBOS from her preliminary letter. Abbey really seem to drag it out thanks

  20. Thanks CF. Yes I will carry on preparing but I thought the NI was handwritten - that's how it is presented in the Pearl book - are you reading it too or using the information on the website?
  21. I've waited a couple of months to start my claim - the small claims court scenario was really putting me off but a friend at work started her attack on her bank so I decided to go for it. Having sorted out my schedule of charges I finally sent off my first letter last week and have 14 days marked in my diary before I send off my lba. I am reading a chapter of Pearl every night and wanted to know if it was a good idea to get the NI form ready now rather than expect my letters to be successful. I also paid for the other text recommended - small claims kit but never received it - not sure who to sort this out with. Any advice about preparation would be welcome. Thanks
  22. Thanks a lot Bish - yes it is clear - so basically I can claim back the interest they charged me each month despite the reason they charged it? Would there be any circumstances that i wouldn't be able to - like if I had no charges that month but still interest for being overdrawn? thanks Fran:idea:
  23. Hi - I get stuck at every stage despite my avid reading. I have received my list of transactions within the timeframe and am now putting together my schedule of charges. I am not sure whether I can claim for unauthorised overdraft fees which appear on my statement - when I have gone over my authorised overdraft limit. Am going to complete a schedule this weekend - which one should I choose off Vampiress's list there's a lot. I am also strugging with the interest bit. I have read and reread the ?s and answers but still not clear. Anyone explain it in layman's terms to me:!:
