I am due to go to court on 14th of September and hear nothing ( of course) I was offered half the amount a few months ago which I refused as full and final offer and am now considering ringing to see if it it is still on offer. A stay will occur as it has to everyone else - should I hang on? Any thoughts?

Sending my best wishes - after all the work and stress of meeting deadlines and this happens - I can relate to this - am due in court on 14.9 but no judge is going to do anything until the test case is sorted. I rejected an offer of 1300 a while ago and really regret it now! But the bigger picture is important and the outcome of the test case has to mean some pay back for us all Frankey x

Hi Chloe - I have been thinking the same thing - another example of the power of large organisations. I have my court date 14th September and it seems pointless even going after all the hours and hours I have spent preparing the case.

Marmite girl is in court tomorrow and has a document prepared in case a stay is requested last minute - have asked what it is - I want to know this too - in the courts Abbey and us are equal and there must be a way of requesting a stay is removed if that is it is granted Frankey

I have received same letter today and feel such injustice as it suits the banks well as opposed to me, woman on the street - where is the equality? My court order issued June 4th said 'A party wishing to make an application ( to have order set aside, varied or stayed) must do so within seven days of the service of this order So how can Abbey seek a stay now of my legal claim? Salford said the hearing was going ahead a few days ago and I have heard nothing. Also the bit in the Abbey letter about offer... 'provided you have not rejected that offer...it still stands and will be honoured' If recipients of this letter had accepted earlier offers then their cases would be settled and hence no need for this letter! We are obviously at the court stage because offers have not been accepted. They are aware cases will be going ahead as they say ' your case is likely to be put on hold' which means cases are still going ahead. What legal right have they got to request stays after the allocated time in directions. I don't know the answer to this but I doubt I would get the same treatment. I go on holiday on Saturday for a fortnight so all I can do is wait some more...been waiting since November 06 Frankey absolutely fuming

Hi I submitted my bundle and have court date 14th September - my local court held onto my aq for ages. I have heard zilch from abbey and they haven't got my email address. Was considering writing letter reminding them of date. It is just a waiting game and it makes me feel better to have read this thread! Frankey

Can anybody help - as my court date is still going ahead (September) I am thinking of writing or emailing to negotiate a settlement as advised in my order. Or should I just wait to see what happens in court? Beofre the annoucement I would have done the former Frankey

As for overdraft charges - you nly get charged because your account hasn't enough in to cover it - hence into an overdraft I rang Salford County Court and my hearing in the second week of Sep is going ahead. I was planning to negotiate with Abbey as in my court directions ...'the parties are encouraged to contact each other with a view to trying to settle the case or narrow the issues' A stay could have been applied for within seven days of the service of the order and it wasn't so not sure whether to point this out to Abbey and ask for a settlement. Be interesting to see what they say.

I am unsure about what to do now but as far as I can see nothing has changed and my charges were still unlawful- was planning to write to bank to point out they have received my court bundle and court date is on 14th September. Be interesting to see their reply. I need to ring court to check my date is still going ahead. Any one else in same situ? Frankey

Hi have sent mine off couple of days ago and got court date for 14.9 I found it useful to do spreadsheet of 'intended contents' from list with statement of evidence template and then find them, print off and add amount of pages to my spreadsheet as I went along. I couldn't get t and c so didn't include in the end. It took me ages, really, hours and hours to sort out so I gave myself a limit of an hour an evening to work on it so I didn't go mad. I intend to negotiate via letter next week now I have sent it off but am prepared to go to court. Keep working Frankey

Hi have a court date for 14th September but sending off my bundle before and then negotiating as advised by court orders. Sent message yesterday but I can't find T and C from 1991 so just going to leave it out - rang up A and they said they don't have them from 1991 and current ones would be relevant but not sure if this is the case. Just need someone who has sent their bundle to advise what they did cheers Frankey

Hi Charley not sure if I said congratulations for your success but meant too been busy putting bundle together v. slowly. When I sent off my SAR in November 06 they just met the deadline but a colleague of mine at work had requested 3 months ago and no statements despite phonecalls and template sent if they miss deadline of 40 days - so just warning you they may be slow in response - but your reputation may help! At last I have the date for court so putting bundle together - been doing it for weeks just not in one go - as I am so rubbish on the PC and lose my patience anyway that isn't relevant I am rambling - am rather stuck re terms and conditions - of course I have kept none - opened this account at least 10 years or more ago - what does one send - t and c from the beginning or end or all of the ones available . This is typical Gesture of Goodwill that appear to be random in amount compared to claim. They will put it in your account but you need to write a rejection letter using one of the templates - making it clear that you reject this as full settlement of your claim and then keep this for reference in your final court bundle - when you get to that stage. The template is easy to find in the templates section. Fran
