  1. Got my reply from Argos today, and guess what? I asked for £52.50, they told me they had in fact charged me a TOTAL of £87.50, WITHOUT the need for a SAR! They offered me the £45 as a refund with all the usual crap attached. I think for this case, I am prepared to take the offer because of 2 reasons: a) It is pretty close to the original amount claimed by me b) As stated in my first post, it is partly my fault not to inform them of my change of address c) It DID cost them some money to track me down at my new address Because of the above points, it may not look too good on me if it does goes to court. What you think? I have the usual 14 days to respond.
  2. JulesTools, my brakes squel like a pig all the time since I got it 1 year ago. I had it checked by National (front and back) 3 months ago, they said it is ok, just dust and hot weather. They cleaned it and the noise went away for a few weeks. I had my MOT done last month, it passed without any problems, and I checked it personally (front only) when I rotated my tyres last week. There are still loads of pad left. I do a little DIY myself, checked the discs, they are not warp or excessively worn, so what could be the problem? Or it is a non problem? Thanks!
  3. When I looked in my old statements (old style pre 2004), I noticed that my charges are only £8.50 each. Can I claim on that? If they are willing to negotiate, I will be happy to drop those as there are only about 4 of them in the £160 total.
  4. Charge up fees is not what the person earn per hour. I am a building surveyor, and my listed charge up fee is £40, but I make only £9.74 per hour. The rest goes back into the company for things like overhead and stuff.
  5. I just had a quick calculation yesterday, it is just over £160. But I have some gaps in my statements. So until I send my SAR off, I wouldn't know. Those who had claimed from Bos before, how negotiatable are they?
  6. Hi all, I am thinking of checking with BoS on how much they had taken from me, not as much as my ongoing case against NatWest I think, so I may just send off for a SAR first. I may or may not try to get back my money as I have a good ongoing relantionship with them. But there are some questions I would like to ask first, I opened the account in Edinburgh, Scotland, but I am now in Manchester, England. So which law applys? Or it does not matter as the (est) amount is less than £500 anyway. The reason I may not want to take action is as I said, a good relantionship, and I have a 0% overdraft with them. Even if I get a backup account, I will not get the 0% overdraft, and I do not want to loose that.
  7. Got their standard sod off reply today. Fast reply! However I do not understand one paragraph in the letter which reads: In your letter you have claimed that we have been acting as the customers fiduciary, yet I am unsure of the basis of your contention. This does not form part of the normal banker/customer relationship. I believe it is a response to a paragraph in my own letter which reads: I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise as my fiduciary. Of course the above paragraph is cut and pasted from one of the sample letters floating around, and I have no idea what is a "fiduciary". Anyone care to enlighten me here? And do I wait for the full 14 days or can I send off my LBA now that they had replied?
  8. Just one question, I had read somewhere that I can legally charge them £5 for every letter sent, is that true? I tried to look it up on the FAQ but there is nothing there.

  13. Not that I ever had any trouble with bailiffs, but to stop people from getting in, I use a crawbar or spray insecticide on their face.

  15. One point about your case is, I think you will not get any money back, maybe just wipe your credit report clean. Since they wacked a load of charges on you to take you to -£390, you "owe" them money anyway and had never paid them back. The charges are illegal anyway, so if they courts rule in favour of you, it just means the charges are removed, and the amount you "owe" them disappears. However what is important here is to get that defult on your credit file remove, I feel.
  16. There may have been a interest charge for the OD, but it is not shown as a charge or an item on the statement, so I couldn't find it. The only chrages items I can see are for Unpaid Item(s). natweststaffmember: What do you mean by "that charge"? Which charge are you refering to? OD charge or unpaid item charge?
  17. Wow fast reply. The answer to your question is NO. The reason is my account is a Natwest Step account. I have no cheque book, no overdraft and only a Solo card. I see a few ODs in statments, but no charges from them (I think), and they were OD in the first place because of the charges.
  18. Hi all, Just sent in my claim today for £52.50 plus £3.57 interest. Not 100% sure of my chances of getting them all back because these charges are my fault (i think!). I got hit by these charges because when I moved house, I forgot to inform them, and therefore I did not recieve the bills. And at the same time, NatWest was hitting me with loads of charges, so the min amount is not taken via D/D automatically. Argos actually had tracked me down at my new address, and sent me the letter (costing £17.50), which together with the late payment charge of another £17.50, brought my account over the limit, resulting in (yeap, you are right) another £17.50! I am not sure if they can charge me (cost maybe?) for tracking me down at my new address, but then there is nothing in the charges that says that. They are "Letter charge", "Overlimit charge" and "Late payment charge". On the basis of that, do any experts here think I have a chance? Thanks!
  19. Hi all, Just sent off the first letter today, I got all my statements from account open, so there is no need to send a request for info. Sum claimed is £272 plus interest of £39.86. Charges are ALL for failed D/D, starting at £30 in 2002/3 and rising up to £38 in 2005. Will keep all informed of what goes on next. Alvin
  20. Hi to both of you taking action again Vanquis, I am thinking of doing so myself, but only for £20. Any news on your outcome? Is it worth doing it myself over £20?
