  2. LBA sent, 10 days to go. No communication whatsoever.

In the words of a well known dog on the Churchhill TV adverts "oh yyess" My main aim is to get the defaults removed and by claiming the damages I am hoping to push them a little more than just claiming they are not providing the data. From what I have read the governing bodies are very slow and some of the replies are in the favour of big business not us the individuals, so I am trying the court route. We will see which way is best between us and then for any future activity like this all forum members will know which way to go. It is so much fun as we are in a no loose situation. They cannot do any worse to us than they already have but it can get better, they on the other hand (DCA and CRA) are on a loosing streak. They have to resource all these additional requests and as you so clearly stated in you posts above htey are breaking the law. So at some point they will loose. Not sure what but they will. I live for the postie arrinving every day to see what unfolds.
  4. I have just been on the phone with my best pals at Nationwide. When I called them I was asked to call the number of there new team "refund policy team) on 01793576760 which takes you through to the ISA customer service number. The person I spoke with said that they had to use additional resourse for the charges claim activity. Awww........
  5. Caz 2 things you need to consider. 1- Scotland is a 5 year limitation England is 6. Do you have many charges in the additional year? 2 - Scotland is a limit of £750 per claim so can you be bothered going through the process for each £750 you need to claim. Good luck and make sure you enjoy yourself.
  6. Flibble, I am the first to admit we were "careless" with our money, we had good jobs, spent everything we had and no kids. Now have a kid, Mrs is part time and I wanted it back. It is not actually £10k (this was just my second claim) the first was for £6k. But it wasn't all charges, there was around £3500 in interest so it was only really £12k over 6 years, £2k a year so £40 a week. I look at this as my 8% savings plan..... Best of it was we opened the acount towards the end of 99 and ran it ok for the first 6 months so the full 6 years we were bad was covered by the legislation window. Lucky or what
  7. ouch. Thats gotta hurt. Cabot (or is it Kingshill) are in for a lot of trouble. I am awaiting there defence for my damages claim by 10/11 and I am sure I will be getting in contact with you when it comes to pulling my evidence together. I will start pulling this together at the weekend. Hope you are having as much fun as me.

When I got home the full set of statements were sitting on the door mat and once I had entered all the data into a spreadsheet it was obvious that the bank were trying a fast one. the charges added upto 3 times the amount offeres and even compound interest at 8% came to another 4 times their offer. So off goes my next fax to BAS/Halifax, again for a hugh amount of my unlawfully taken funds. What a christmas we will be having.

Well I sent my LBA off last week for 1 account (the one they had sent all the sataments for), the next day in the post they (a different department) made me an offer for 4 times the amount I was requesting. There was an acceptance form attached for me to sign and return. I called them to try to understand what this was all about. After investigating they said that this offer was for my second account, I asked "is that the account you have not yet sent me the statements for"? "Yes" was the reply. I have today sent a fax for a part payment acceptance, accepting the offer in part payment for the second account but as they have failed the SAR and not supplied the statements I cannot accept this as F&F settlement (I would never do that anyway). I also informed them in the fax about the LBA they received last week and that if no offer was made on that account was received the N1 would be in the court on Monday next week. today they called saying all the statements had been posted yesterday by speciial delivery and I would have them today. Lets see what they were trying to hide by withholding the statements. Sly old dogs that they are.
  10. Just sent my LBA to my pals at blackhorse, sent by fax for speed. Within 2 hours the top man at the branch called appologising that I had not had a reply to my prelim and that he was personally looking into the "serious allegation". Sure is serious......£10,000 + anyway told him not to call again and to put this call in writing and also any future communications. I gave them 10 days for a reply before raise an N1.
  11. thanks Andrew1 I will be adding the (how can the DCA default me when I have not given them the permission to do so) to my list of defences. Cabot have til 10/11 to file a defence.......... not long to wait to see wht they come up with. thanks
  12. Hi, I have been dealing with Cabot and waiting CCA and SAr info since August. As they have not replied I have raised court papers and taking them to court to provide the paperwork or give a good reason why they have taken my money. They have filed an aknowledgment and we have a date for mid Novemeber for the defence to be in. See the link in my signature for info. good luck
  13. Jude I have just read your thread and you have my utmost respect. A pensioner, using a PC and spreadsheet plus willing to take there bank to court. If I can be of any help just let me know and ask any questions. If you follow the process to the letter and give the 14 days for each step you WILL have you cash back about 7 days after you file the court papers, 5 weeks from posting your prelim. Good luck.
  14. the date you typed up the letter as that was the earliest date you can prove you were aware of this unlawful act. Good luck. NW are generally very quick in posting the statements.
  15. cheque received this morning. Plus my second Nationwide payout started today. £3k received other £7k is being posted. What a good day I am having. yes!!

Well, I got impatient and phone my pals as NW, htey confirmed the cash credit was from them and the remainder of my claim in full will be credited later today and for my closed account the cheque will be posted today. I don't think they have paid me the 4.85% for my loss of potential savings but I am happy to leave the claim open to get the court to decide. woooohoooo what a Christmas we will have, matching Mercedes I think. Todays was a £10 k payout.......I am off to the pub. Donation on it way as soon as it hits my account.
  17. Redsue I have not yet received the bulk of my payment yet, hopefully later today. But I did claim contractual but it was at 7.75% which is the authorised interest rate, but then ontop of that I claimed loss of savings interest at esavings rate of 4.85%. So not sure what they are going to do about paying me for that.
  18. Excellent news. I am still waiting at the moment. I don't use MCOL but I am guessing you can do something there to say the claim is satisfied. Enjoy your money.
  19. Hi, I have a collegue who has had their 10 month old laptop back for the same fault/repair 4 times in 6 months, each time it is away for 2.5 weeks. It has failed again for the same fault. Can someone point me to sections of the sale of goods act he can quote and what sort of further action he can advise them he will be taking. thanks I hafe found this so far. The Sale of Goods Act 1979 (as amended) says that goods should be as follows: Of satisfactory quality. This means the goods must meet the standards that any reasonable person would expect, taking into account the description, the price and all other relevant information. In some circumstances, the retailer may be liable for any statement made by the manufacturer about the goods. Satisfactory quality includes the appearance and finish of the goods, their safety and durability and whether they are free from defects (including minor faults) Fit for the purpose that goods of this type are generally sold. They must also be fit for any specific or particular purpose made known to the seller at the time of the agreement.
  20. Called the court today and Cabot have acknowledged the claim and have until mid Nov to file a defence. Can't wait to see what they say.
  21. sorry to tell you I am at the MCOL stage with my second claim and they have til end of next week to file a defence. I think they may have started to payout as I received £500 overnight. I reduced the time between each stage to 10 days as thought I could justify to the court this was resonable as they never actually replied to my last letters for claim 1. Next time I would go for 7 days. I have read that someone just went straight to the MCOL for claim 2. Good luck

The last time I claimed (I am such a Nationwide veterin now), I actually just phoned the number on the rejection letters (from Deborah Deborah - 01793712603) and asked them politly where the rest of my money was. They had it in my account within 2 hours, they said it was an oversight - sorry. I would probably do that first and if not a simple email quoting you court case number and the amount of shortfall should be enough.
  23. Hi, its me putting in a damages claim to Cabot (defence required tomorrow or they default), I hope they don't as I quite fancing sitting face to face with them. I am claiming damages caused by them sharing my data illegaly and have split the cost of my new mortgage which is higher than typical high street products, between all of the folks sharing my data illegally. Whether it be due to the contract being finished or because they did not prove they owned the debt. If they default tomorrow then I go after them for every penny I have paid them and furhter damages cuased over the last 6 years. Oh great joy!!!!!
  24. Psycic Redsue. Got a cash credit today between 4pm and 8pm. £480 so hopefully the rest will flood in tomorrow. Great day. MBNA agreed to pay in full, Cabot need to file a defence tomorrow or Balliffs will be sent in and Nationwide start to stump up a hugh 7K + payout.
