  2. Recieved letter from Heather Bunting this morning to say that we appear not to be able to reach an amicable resolution but I can still accept their offer! Not long to go til moneyclaim, it's getting very scarey now
  3. Finally done my LBA this morning as the printer decided to pack in and the new one only came yesterday!!! Typical, I get back from the post office this morning to a letter from Laurence White offering me £1,000. Very tempting I must admit but I like the sound of £2,000 and something even more so here goes typing out the thanks but no thanks letter now lol.

  7. I have now sent my request for repayment of charges, can someone please tell me if when I send my LBA can I add any other charges since that letter was sent to it or can I only claim now what I've asked for? Thanks
  8. The interest is always added after we're over the limit so I've added them as well. I am claiming Interest charges, unautherised overdraft fees, paid referrals and unpaids out. Is this right??? :?
  9. I wasn't going to claim any of the interest charges back but looking thru these statements some of them are up to £10 and over so I want to claim them as well now. I can claim these back can't I??? :?

  13. We've always had trouble getting statements but I think that might be the post here sometimes more than barclays! I'm not that worried about them ringing because the accounts in my husbands name and he's rarely here in Barclays hours lol

If you meant the LBA it's this [your address] [their address] LETTER BEFORE ACTION Dear Sir/Madam, ACCOUNT NUMBER: xxxxxxxxx I am very disappointed that you have failed to respond to my letter of the [XXDATEXX]. I now understand that the regime of 'fees' which you have been applying to my account in relation to direct debit refusals, exceeding overdraft limits and so forth are unlawful at Common Law, Statute and recent Consumer regulations. I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law. I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise as my fiduciary. I calculate that you have taken £XXXXX plus £XXX which you have charged me in overdraft interest for the sum which you have taken. Total £XXXXX. I am enclosing a copy of the schedule of the charges which I am claiming. I have already sent you a copy of this in my original letter of the [XXDATE OF FIRST LETTERXX] Additionally you have entered a default notice against my credit record. This default occurred merely in respect of unlawful charges levied by you or was the result of impecuniosity caused directly by the taking by you of penalty charges which you had applied unlawfully to my account. Please note that mere correction or amendment to the entry will not be acceptable. I require repayment in full of this money and removal of the default notice. If you do not comply fully within 14 days then I shall begin a claim against you for the full amount plus interest plus a claim under ss.7 and 13 of the Data Protection Act 1998 plus my costs and without further notice. Furthermore, I shall submit a Consumer Credit Act 1974 complaint to the OFT upon the basis that you have failed to comply with the OFT's direction of 5 April 2006 and are therefore not a 'fit and proper person' to hold a consumer credit licence under the 1974 Act.   17. Thanks victimnomore, am I right in thinking then that I dont need copies of every letter they've ever sent me then just the statements? I thought I'd swotted up and knew everything I needed to do up to my LBA but not so sure now!
  18. Think I've Made my first cock up!! I didn't realise I had to send another cheque with my last letter Recieved this from P Townsend this morning DATA PROTECTION ACT I refer to your letter 1 september. Your above letter appears to reguest information not sought in the previous letter of 33 August. The bank has confirmed that duplicate statements are in course of preperation and these will be provided without charge. If you now require further information, the bank is entirely willing to supply the general information that should be disclosed due to the DPA. To initiate the process Barclays will require payment of a £10 fee per individual which should be provided by cheque, payable to Barclays plc, directly to this department. Upon payment of the fee(s) the relevant information will be supplied as promptly as possible. I assume if the statements arrive now before the other stuff I can still proceed with sending my preliminary approach letter while I wait for them?

  22. I actually just posted on mamma caz's thread lol, re-checked my statement online and both debit comissions had changed. ! is now overdraft protection and the other is an account fee and I cant claim either of them back!
