ok thanks for your reply, will do, hopefully thats an end to trying to get the info, will wait a couple of weeks and see what happens. As a matter of interest does the 40 days include weekends? or is it working days? Same with all deadlines in fact.... thanks again!

well pigs did fly! She phoned back to say they cannot find the orginal letter i sent (sar) and could i refax if, I re emailed it to her and used the opportunity to email a CCA request also for loan agreement, who knows it might work!
Any advise on my previous question would be gratefully appreciated!

went into barclays bank with id and the girl in there was so confused as to what i wanted lol! She finally found my account number and sort codes etc and says she will pass on my info to head office to deal with request...clock is ticking!

Hi there,
Just need some advice really, have several claims going on right now and have taken this one on for my husband....
He has a car loan with this company who i believe are part of GMAC now... anyways, loan was for something like 14,000 :o and they amounted charges for £568.00 on top of loan at the end for things like missed payments sending letters etc (£30.00 a pop!!) Long story short, have sent a S.A.R - (Subject Access Request) on 07/08/06 and they cashed cheque, rang to find out where statements etc were and have been fobbed off, rang again today and a nice lady said she'd priont it all off and pop it in post, I referred to my letter saying I needed details of manual intervention etc, but she was completely lost on what I was telling her lol!!!
So she is going to track down the orginal letter and phone me back ( ya right I will believe it when i see pigs fly!!)
Anyways my question is this, if I want a copy of the loan agreement, do I need to send a seperate letter quoting the CCA and send £1.00?? Also If we find that they cannot supply the orginal agreement (which i suspect they cannot) what happens then? , have been reading and readin this site and various posts but as everyone has a slightly different case thought I would just ask my case straight out... if you can point me in the direction of an answer thats great if not pleasse help.

you can only go back 6 years, as far as i know you can claim back for going over your agreed overdraft limit but i think it must be due to going over because they have caused you to, does that make sence? best thing if unsure is check with a moderator or site helper here - they have lots more knowledge! sorry couldnt help more - sharon

i send it recorded delivery, but i have read a few posts here that say it doesnt really matter but for my own peace of mind i do it that way as then i know they have it and cannot lie about it being lost!

good luck jim!!! if you want to check the progess of where your statements are i have a really good number i found : 0121 633 5411 - you go straight through (no holding) to the dept that are dealing with all dpa requests!

Sorry first off if this has been covered, I am reading all posts but want to make sure that I am doing this right from the ofset.
Sent Barlcays a DPA Suject Access req on 15/08/06, received letter back on 17/08/06 saying they recevied it and would send statements within the next few weeks, as this is an old account no longer open i dont have any acct details or sort codes but provided a seperate sheet with all my previous addresses, also stated in letter i would be happy to go to branch to collect them and show id.
Anyways.... got letter this morning 25/08/06 saying that the cannot fufill my request due to "insufficent details" being provided by me, which are:
1. Sort code
2. Account Number
They have asked me to resubmit my instruction by going to a branch to update my signiture and a form of ID or by writing again with the details of my account - DUH!!!!!
My question is why should i have to go to a branch just coz i dont know the sort and account number, sureley by asking for a SAR i have asked for info about ME and not that particular account?
What should i do now? Should I write a letter and bring it in branch with me??? Is all this timewasting included in the 40 days?
any help asap would be appreciated as i want to sort this this afternoon!

yup thats right! i got a bog standard letter saying they were sorry to hear that i was unhappy blah blah and someone would be in touch - didnt happen! So sending lba today! - dont forget to include a schedule of your charges with your letter you are sending today and send it rec delivery! good luck - right beside you on this one lol!

hmmm should have thought of that, sent id off with a letter saying that they were still on my timeline, got a letter back with id saying 40 started when they recevied my id lol i DONT THINK SO!

funny, i was just about to start a new thread with the same question, got same letter on saturday from barclays. hope someone can help us.

i think that you should start at the beginning and send a subject access reuest ( found in the library on this forum) which will request all info they hold about you - it is a legal requirement for them to give you this info andif they dont comply there are other letters to send after that - i personally think your letter was too nice and that is why you have been ignored so far!

i believe you can get a letter from a professional person as proof of ie, someone upstanding in the community ie a policeofficer, priest, solicitor etc, with a stamp and letter head paper, this is the norm as acceptable id - ring the abbey and ask what they can accept perhaps?

you might need to send some proof of id - utility bill or bank statement from last 3 months with your data pro letter as i got a letter back from them requesting this - even though they always accepted it was me when i owed them money lol!! Just a thought as it may speed things up a step! Good luck

Hi there,
Well I sent my saq data protection letter off last monday and as expected a letter arrived on Saturday morning requesting some ID to process request, letter also stated that my 40 days would begin when they received this info - I think not!!! - so got a copy of a bank statement here, gong to pop it in post today - recorded delivery, funny thing was the nice people at egg included a Sae for my convenience lol!!
