Can we add new charges that have been added to our account after the initial letter has been sent?

Claiming beyond 6 yrs - important new information!!!
Beardedlaydee replied to BankFodder's topic in General
Is there a way of finding out old account numbers for our closed accounts? We have a couple of old accounts that had charges on them over six years ago but they are now closed an we have no information on them now. -
We are reclaiming bank charges for a second time from the Halifax and so thought we had better open up a basic bank account as a parachute in case our account is closed this time. However we were turned down. I didn't think you could be turned down for a basic bank account but NatWest said that unless we closed our Halifax account then they wouldn't accept us! I don't want to close an account with debit card and cheque facilities for a basic one unless I have no choice. I'm confused!

I think I'll send an SAR as I don't have any of the documents now as I thought the matter was closed as the insurance is for a car we sold two years ago!
-
DLC have recently contacted me after over a year of not hearing from them over some, apparently, unpaid car insurance. Will I have signed a credit agreement for car insurance? I don't remember doing so. I am disputing the amount as the car was sold and we tried to cancel the insurance. Is it worth sending a cca request?

We have sent our LBA to Nationwide as we had all our statements but they are yet to reply. This is our second claim on this account. We still receive weekly texts from the Nationwide with our balance even though the account is supposed to be closed and the payment I made to Moorcroft in January was on there this week. Am I correct in presuming that Moorcroft are acting as agents rather than them having bought the debt? Should I be concerned about Moorcrofts threats to take court action if I don't pay Februarys payment within 3 days?

After the Nationwide closed our account (probably due to us reclaiming bank charges in March 2006) our £900 overdraft was taken over by Moorcroft. They are now expecting payments of £35 a month. I paid by debit card at the end of January and set up the standing order with my bank for the 10th of the month (as I had told the very rude woman on the phone at the time of the first payment) I set these payments to start on March 10th. They are now saying we have defaulted as we missed Februarys payment. Anyway, my question is should I send a CCA letter? I have never signed anything to do with Moorcroft. What will happen to the debt, is it enforcable by Moorcroft or will it go back to Nationwide? £400 of the debt are bank charges that we are in the process of reclaiming. Any help would be most welcome.

We had a successful claim against the Halifax nearly a year ago and have had a few more charges levied on the account since the claim went through. I am really nervous about claiming for a 2nd time in case they close our account. We would be unlikely to be given an anything other than a basic account if we applied elsewhere and don't want to lose our debit cards etc. Has anyone claimed agaist the Halifax twice without their account being closed? The Nationwide closed our other account after just one claim against them. Thanks.

We sucessfully reclaimed our bank charges from the Halifax earlier this year (thanks to this site!) Since then we have had a few more charges probably adding up to £200 or so and I would like to claim these back too however I am worried about our account being closed. We also had a successful case against the Nationwide and they did close our account so our Halifax account is our only account with a debit card and overdraft and we would be unlikely to get these with a new bank due to our poor credit history. Anyone else taken on the Halifax twice?

Well, Nationwide sent us a letter today telling us they're closing our account in 30 days time and expect repayment of overdraft in full. I called them today and was told they "don't need a reason to close an account" Is there anything we can do? They've added more charges to account since we took them to court, so I'll be claiming those back. AAARGGGHHH, they get me so annoyed!!!
-
Well, we sent the LBA off a couple of weeks ago now and received the standard letter from them this morning, "first direct does not agree with your contention that the charges...unlawful and are therefore unenforcable." blah blah They've got till tuesday before we take court action.

Halifax - Offer received
Beardedlaydee replied to Beardedlaydee's topic in Halifax Bank and Bank of Scotland
Well, we received a letter from halifax this morning with all of the usual rubbish about incurring costs etc and also an offer for £298, a paltry 15(ish)% of the full claim amount. I've jsut finished writing a polite "sod off we want the full amount" letter. Will keep you updated -

Halifax - Offer received

Actually, thinking about it, I don't mind going through the hassle of court action if it means we'll get the extra interest -
Hi, I've just totalled up the charges on our first direct account and credit card. Would it be best to combine the two into one claim or to put in two separate claims as they're separate accounts? Combined they total less than £5000 but they have separate account numbers. Thanks

Halifax - Offer received

And today is the deadline. Court action initiated. Oh why can't one bank just pay up without having to go to court about it. It would be so much easier -

We sent initial letter to Nationwide today
Beardedlaydee replied to Beardedlaydee's topic in Nationwide
On April 13th we received a letter from Northanpton County Court saying that Nationwide had acknowledged our claim and they had 28 days to file a defence. It said they intended to defend all of the claim. I just checked our online banking and it appears they have PAID UP!!!! HOORAY!! £951.78 I am so pleased! One question though, should they be paying the £80 court fee? We will make a donation to the fund for law books asap. Thanks for all your help. Just waiting on the Halifax claim now and then we will start on First Direct!
