  2. Just letting you know, my daughter has just checked her current account and hey guess what Halifax have paid the money back whoo hoo!!!!!!!!!! Soo very very pleased ....Thankyou soo much everyone for you're help, wouldn't have done it without all the encouragement and advice. :razz: Can someone let me know how to make a donation to the site?   3. Well ive been helping my daughter who's 21 get her charges back. She left home last year and got herself in to dept and Halifax helped her to get into a bigger mess giving her a credit card,overdraft etc. She was being charged almost £90 per month and they knew that her income wasnt enough to cover her dept, she just wasnt getting anywhere. When I found out about it I went into the branch with her to see what could be done but nobody could help us. The girl behind the counter was very helpful and apologetic but said that there was nothing she could do. We tried to get help from the Halifax via the phone and "Dave" (couldnt give me more info about himself due to data protection act) told me to let her get into dept until the bank decided to stop her account, he said that they would only do something about it then. I couldnt believe it, I then found out about this site and we are now up to the court action stage we filed MCOL a week last Thursday and have received court details today saying they intend to defend, so we are just waiting.

  7. Can I just ask did Halifax acknowledge your claim? We sent MCOL a week yesterday and have just received notice today that acknowledgement of service has been filed and they intend to defend.
  8. Hi, my daughter did her MCOL on Thursday, she is claiming back her charges on her current account and also credit card. We were advised to put each one on a seperate claim, so that things wont get confused and we just used the help from the templates library on here. Hope that helps
  9. hello again, posted earlier but no replies as yet, ready to fill in MCOL and need to know whether each claim i.e. credit card and current account needs to be sent seperately as, so far we have claimed for them jointly in the LBA, please help thankyou.
  10. Hi there, sent LBA 14 days ago today and no reply soooo..... gasp.... next stage MCOL. As we have made the claim for both bank account and halifax credit card together, is it still ok to put both together on MCOL or do we have to make seperate claims? My daughter is now beginning to worry about having to go to court and i`m really hoping it doesnt, as I have been the one to encourage her to put her claim in.
  11. Hi, we received a similar letter to that and the statements arrived 42 days after our request and came by registered post. I had e.mailed though to say that I would be making a complaint if we hadnt received them by the 40 days, dont know if it was just a coincidence, but we were feeling the same as you. You could give it a try, we sent it to [email protected]
  12. Well we shall send it as the template and hope that all goes well. Could I just ask, if the banks have reduced their charges due to the OFT report doesnt that put them in a worse situation where these charges are concerned as surely they are admitting that the charges were too high in the first place, am I being a little naive?

  14. Hi Just received reply from Halifax, thanking me for my letter but telling me that: 'under the terms of the original agreement....blah blah.......' 'after assessing the OFT findings our charges have been reduced as from the 1st August 2006 In view of the above, I regret to advise I am unable to refund the charges in question as they were applied to your account as per your original agreement.....' In the templates section the LBA letter contains this paragraph: Furthermore, I shall submit a Consumer Credit Act 1974 complaint to the OFT upon the basis that you have failed to comply with the OFT's direction of 5 April 2006 and are therefore not a 'fit and proper person' to hold a consumer credit licence under the 1974 Act. If you do not understand what this means then seek advice from your legal department. Do I need to include this?

  16. Thankyou for your replys, in the end we decided not to bother, as we couldn`t work out if the interest related to the charges. In total the charges came to £1081.00, so we sent the request for repayment yesterday by registered post. Will keep you posted as to what happens next, thankyou so much for your help, Mommywend

  20. Hi, could anyone tell me if it usually takes the full 40 days to receive statements from the Halifax, we are now up to 31 days since they received our request. Do we still wait?
  21. Thank you so much for your support i`m sure that there are many young people in the same situation, lets hope that this action will eventually get through to the banks just how devastating this can be at such a young age.

Hi, would just like to say hello for the first time:) I joined this site after finding out that my 21 years old daughter was in dept, mainly due to bank charges and taking out credit cards to try to pay off the dept that she had got herself into. It has been difficult but with help from your site we have started to take on the Halifax. We have applied for a break down of charges and are waiting a reply. Hopefully soon, we sent the letter on the 11th September 06 by registered post with a cheque for £10. Will keep you informed of our progress, Many thanks Mommywend.
