  2. Hi all, Just looking for a bit of advice / guidance about the flat I have moved into, it is a basement flat which I moved into 3 weeks ago and is managed for the landlord by an agency. I was aware before moving in that the property has some issues with damp caused by the rendering on the outside being damaged, the walls not being damp proofed and the front room windows being sealed shut for security. Before signing the contract I was told these issues including new front door and double glazing had been agreed and would be happening. Upon moving in it was clear that no one had been in the property between the tenants leaving and me moving in, there was a lot of black mould on the walls which I photographed before cleaning off. I obviously made the agency aware who said they would send someone round to do the "damp work". This just turned out to be a contractor coming round and painting over the walls with anti-mould paint. Our biggest issue is that we can't ventilate the rooms because the windows are completely sealed, we are running a de-humidifier pretty much all day and it is filling up quickly. I have asked the agency on many occasions for a date when the windows will be done but they keep skirting around the question. As I have since found wet rot in the bathroom and myself and my girlfriend have been feeling ill I have booked an appointment for environmental health to come round and look at the flat. The biggest issue is the windows for sure, is restricting ventilation against any legislation at all? Any advice on how to deal with agency would be appreciated, this is my first experience on them.

Hi all,This place has been invaluable to me over the years.I had a debt with MBNA for £1,100 which I agreed to partially settle with the DCA Aegis, the agreement was to make 3 payments and then my credit file would be update as partially settled!That was 5 months ago, I have written to MBNA twice asking them to update my file but have been ignored.I guess my questions are:Is the fact that they have not updated my file damaging my rating? Are Aegis an official DCA for MBNA? and what should I do next considering they have completely ignored me thus far?As always, any help is greatly appreciated.Mack
  4. Hi Katie, Thank you, that is very helpful. I would imagine they are in no particular rush to update my credit file or reply to me as I am no longer a priority. Will keep chasing them to update my file though.
  5. Hi all, Was hoping for a bit of help with this one. I owed MBNA £1,100 on a credit card which ended up being passed to AEGIS for collection. I negotiated a partial settlement of £600 with the DCA and paid that as agreed at £200 per month for 3 months. Now almost two months after the last payment my credit file has not been updated. I have written to MBNA twice to get clarity on this and make sure AEGIS were acting on their behalf.. NOTHING. They certainly were fast enough to send me letters before, but don't seem so keen now. Any thoughts? Thanks Mack

  7. Hi Silverfox, Thank you for the reply, I have answered the questions below: How old are the debts? Mostly between 2/3 years with the Egg one being 6 years this month Is the Natwest account a bank account gone into overdraft? Yes it is, it is being dealt with by Fredrickson and I have made a part settlement offer. Are any of the debts with DCA's? Egg is still with Egg, is was passed back from Arc after they failed to respond to a CCA request. Lloyds ones are with BLS and the Natwest is with Fredrickson. I have tried to make offers but they tend to demand the full amount. Do you own property?No Are there any late payment or overlimit charges on the loan/credit cards? I have been quite good at claiming most of these back so I don't think their are any that I am owed Thanks Mack
  8. Good Morning all, This forum has been invaluable to me over the years. Through various circumstances I have allowed debts to go into default and never really saw any light at the end of the tunnel. I now find myself in a position where I could pay off my debts within a year or two and just wanted some advice on how best to tackle them. The debts in question are: Lloyds TSB Loan - £4,057 - In default Lloyds TSB Credit card - £1,468 - In default Egg PLC - £259 - In default (6 years) Natwest account - £1,010 - In default Can you advise on the best way to make offers on these as I have about £300 per month that I can afford. I basically want to start re-building my credit rating so I can provide for the future. Any views are greatly appreciated. Mack
  9. Hi, it was an old student account on an overdraft that I was gradually paying back but when I lost my job the payments stopped. I did advise Natwest of this but they must have passed it to Triton. I did say on the phone I would write with a repayment offer but the woman insisted that I must make an agreement with her there and then. She also told me I would still be liable to pay interest which I questioned because other DCA's I have dealt with didn't do this.
  10. Had my first experience of Triton credit services last night, my Natwest account has been passed to then due to me being unable to pay due to redundancy. I explained that I was happy to make an offer in writing for monthly repayments as I now recently employed. This was met with 20 minutes of questions about whether I could borrow the money from friends, what my income was etc... Then I was told that rather than writing to them if I didn't come to an agreement with them over the phone they would send a door step collector within days... can they even do this?? I'm obviously worried now but did some research and they are directly linked to the Royal Bank of Scotland are they not? I am happy to write to them with an offer but don't really want someone turning up at my door demanding money.
  11. Good Afternoon all, I hope everybody is surviving the weather. I'm not sure where to put this but a friend of mine is having a difficult situation with a previous letting agent. The situation is this: "I rented a property through a letting agency in Bath from August 08 to August 09 and since moving out I payed an additional 3 month’s rent as I initially did not cancel my standing order at the bank. However, I was made aware of this at the beginning of November 09 and was assured that I would promptly receive a cheque to refund me with the money. Since then I have chased them countless times for my money, each time being told that a cheque has been processed, yet I still have not received anything. I would like to know where I stand and how I can prompt them to resolve the situation ASAP, the most recent contact was today when they told me it was two payments and not three - it seems they are just stalling now and I wondered what action I can take to make them do the right thing. I can obviously prove the money was taken with bank statements." Any advice you guys can give would be greatly appreciated.

  13. Hi I wrote to moorcroft about the CCA request and they sent this back, I don't completely understand it as I don't want to go to court I just want to clarify who if anyone can enforce the debt, are they just trying to put the wind up me?
  14. Good Afternoon About 18 months ago I signed up to a well known Gym chain, I signed up to pay £35 per month. As my financial situation spiralled out of control I phoned the gym and informed them I would have to end the "agreement" early and cancelled my DD three months into it. After a few months a received a letter C.A.R.S account recovery solution demanding payment of the remaining payments in full, not being as savvy as I perhaps am now I paniked and paid them the 300 odd pounds in full having to borrow most of it. I have since read that it may be unlawful or unenforceble for them to claim the rest of these payments? Does anybody know if their is any truth in this and also is their any small chance I might be able to get my money back. Any help is greatly appreciated

  16. Many thanks for taking a look! Egg Plc have made a strange move on me and I dont know if its because they don't have the CCA to provide, they have had over their 12 days and nothing, until today I receive not the credit agreement but a letter from Moorcroft debt recovery ltd on behalf of egg asking for the entire repayment of £700, Egg know full well I can't afford to pay that as I had an interest free re-payment plan agreed with them. What should I do about this bearing in mind Egg have not provided the CCA??

I am writing on behalf of a female work colleague who feels she may have a case for discrimination but is'nt sure how to proceed: This is centred around a friend , she is employed by the Bath Chronicle in a sales role.The lady in question has worked in this role for almost 5 years and in this time never received a pay rise, being on the same £13,000 p.a as when she started, since this time every member of staff doing the same job and every new employee doing the same job has been put on a higher rate of £14,500 p.a, despite repeated pleas to be treated equally and given parity my friend has been told to have 3 months to "prove" herself each time. As if 5 years service is not enough to be paid the same as a new starter doing the same job. This has put her under tremendous financial strain and the way they keep telling her to prove herself or be let go in 3 months seems almost bordering on constructive dismissall This is a piece of employment law which I believe shows this is unlawful: All workers have a right to receive equal pay Women and men have a right to be paid equally for doing the same job or for doing work of equal value. The right to equal pay comes regardless of a worker’s type of contract and covers basic pay, bonuses, overtime, holiday pay, sick pay, performance related pay and occupational pensions. I don't know if this is fully law and how she would proceed though, any help would be gratefully received.

  21. Hello Thanks for all your advice so far Received a reply from MBNA today with a "copy" of my credit agreement, now should this be something that contains my signiature? Because what they have sent me seems to be a template of a credit agreement with my name & address inserted at the top, although their is a ticked box and a date relating to when the agreement was made.

  23. Hi the debts are with Lloyds(main debt)Overdraft,credit card & Loan, MBNA(credit card), Egg(Credit card) & Natwest(overdraft)! I have not cca'd any of them because excuse my ignorance I'm not certain what that is but will do some reserch Thank you
  24. The debts vary in age , being with different creditors...having tried to get myself out of trouble through further borrowing I found myself in much more....vicious circle! They range from 1 year to 3-4 years!!!
