  1. They havent closed my account, just got a letter saying... "..we are unable to offer you an account that is comletely free of all charges if you breach the terms and conditions of your account.We will,therefore, expect you to comply with the terms and conditions in the future." It was an actual P-E-R-S-O-N who signed my letter, thats quite amazing, from Tracey Tanner. blah!blah!blah! Now i am gonna go after some charges that i incurred whilst undergoing court processes!! Look out NW! here i come again!! Or is this a bad idea, and do you think they would definitely close my account if i go after them again? (edit) - got a letter the same day saying that they werent going to refund the charges????!!
  2. So far no info about closing account, not even any info about what their defence was!! Thanks to everyone who helped me with this claim, couldnt have done it with out all the GREAT advice.

  4. Still nothing (as usual) in my account! Heres hoping it could be today or tommorrow, still waiting on confirmation of what their defence is at the moment! Any of you have your judgement rejected?(that have just had money refunded?)

  6. ADVICE NEEDED! Got a letter from CCBC regarding judgement being rejected, it says " A bar on judgement/enforcement is in place" Any ideas on what the next step is? I have emailed MCOL to complain that they got an extra day to defend, where i would have lost the case if i had left it till day after 28 day notice to defend. - as if 28 days isnt enough? any legal boffins out there who know if this is legal or not? or is it a loop-hole!
  7. Wish it would happen that easily for me! waited 29 days with MCOL, and when i requested judgement(waited one more day)it was rejected as NW seem to have got a defence in! Anyone with ideas as to how long i might have to wait now, or if i have to go to court with it now?
  8. Can someone tell me how Nationwide are allowed to put in a defence on the 12th April when MCOL told me that teh last day they had to reply was the 11th APril? surely this doesnt give them a leg to stand on?

  10. Right the tw@s have managed to get a defence in it looks like as my judgement request has been rejected! When this AQ comes through, how much is the next fee, as i dont think i can afford it? Also has anyone else had success from this point? (sneaky gits arent they?)
  11. I had already transferred my case to my local court before claiming, does that make any difference? Also the lady said that if i got my judgement in early enough they wont have time to dispute it, so hopefully they wont have time to file a "late defence"
  12. I HAVE PRESSED THE BUTTON! Requesting payment IMMEDIATELY in ONE LUMP SUM! Now feeling like i should have chosen to ask for INTEREST SINCE DATE OF CLAIM which i didnt.
  13. does anyone read my posts anymore? If i get to set a judgement because NW havent replied to my claim how long could it be until i get my money? They have until close of business on wednesday 11th April to defend!

  15. its now 3rd april and still no response from Mr Bacon and team, they have until the 6th to sort something out, provided i have worked out the dates correctly. I filed on the 8th March and they acknowledged on the 13th March. What happens if the 28 days are up and still no reply?
  16. Now 29th March, been 16 days since acknowledgement! Run out of fingernail, now on to my toenails, and thats not easy when your 6'2"!!
  17. OOOH!, My claim has been "Acknowledged" on the 13th March! Panicking now, worrying that i have missed a step out, am sure i havent but dont want to have wasted my time and money on the claim.

  19. Thanks Last1standing. Just checked MCOl and it says on "judgement" "Start". And gives me the option to click on it. Should i?(its like a big red button saying"dont touch")

  21. Heres one for you... Since i started this process back in August 2006(it has taken me this long to build up the court fees and the guts to process) i have incurred other charges on my account. When this has gone through(note i say When not IF) can i claim fo these other charges aswell?
  22. Apparently my "particulars of claim" are wrong - must be 24lines or less or 1080 characters and not contain or & - which i am sure it doesnt. According to MCOL, you cant use £ signs or anything other than full-stops or commas!! How do you put in your particulars if you cant use a £ sign? H E L P.! Sorry, everybody! ignore the last 3 posts as i have sorted it out with the guys from MCOL. Have Filed today !!!!
  23. URGENT HELP REQUIRED! Hi, i am going to process my MCOL today and would like some advice. Apologies if this is somewhere on this site(as i am sure it probably is), could someone tell me what i should put in the "particulars of claim section", obviously i can only put 1080 characters in this, so i dont want to get it wrong - i will search this site until someone replies, i suppose i could leave it until Friday 9th March to claim, but want to do it as soon as possible. I look forward to your helpful replies. Have i filled this in correctly(particulars of claim): 1.The Claimant has an account 31601847 with the Defendant, opened August 1997. 2.Since 07/09/00 the Defendant debited charges and interest in respect of purported breaches of contract. 3.Defendant is aware of all details as a list of charges has already been supplied. Another copy will be sent. 4.Claimant contends:(a) The charges exceed the Defendant's losses caused by the breaches; (b) The Term permitting the Defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999, Unfair Contract Terms Act 1977 and at Common Law. 5. Claimant claims: (a) return of the amounts debited of £3728; (b) Interest per S.69 County Courts Act 1984 of 8% - £694.50 continuing at 8% until judgment or settlement at a daily rate of £0.97; 6. Alternatively, if the charges are a fee for a service, then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982. 7. Costs allowed by the Court.
  24. Posted my LBA toady as i will have funds available to proceed with court by next week, just need to put the £120 somewhere safe until they dont reply. Gettin Nervous!
  25. Hi guys, i`m back again. Quick question, obviously with it being christmas and all i havent been able to get the money together to file in court, any advice on what i should do now that i have the money ready? Should i send all the paperwork to the bank again, or just send another LBA? Would really appreciate some advice. Thanks
