  1. thanks tanzarelli, your words have been really comforting. I've just seen that sometimes they are letting it get as far as court, how come this happens when they have to submit their evidence 14 days prior and this would therefore show that they have not been honest about their profit making. I've sent my court bundle and hoping that they will settle before now. Any guesses for when they might, see who is the closest for a laugh, i reckon the 28 Feb!!!
  2. thanks tanzarelli, that's what i will do, and going to submit one with the court bundle, court date on 14 March and got to have it in 14 days before, but thought that if i send it now, then they will see that i'm not going to back down and might settle up (chance be a fine thing!!!) When i send it all, do i have to note down that i am asking for the mcol and questionnaire fees that i have incurred, or do they just do that anyway? I think i included asking for it in my claim. Getting scary now, i had grown bored of it as my court date was so far away and now it's almost here!!! Thanks all for your fabulous support and advice x
  3. Thanks mumofthreeboys, I am due to do this in my court bundle, so do i send the whole thing? Why is it important until then? I think i've got a bit confused! Can only do it up to today's date on the spreadsheet, is that adequate and do i put that i have completed it to that date??
  4. i've just realised that i haven't sent a schedule of charges before hand. I thought it was something that i didn't have to worry about until i go to court, and other than their defense stating that i didn't give them that and the court requesting that i do this when i make up my court bumpf, i didn't realise you had to. Have i got it wrong, or does it not really matter till sending the court stuff??
  5. Hi, my problem is that my court case is coming ever closer and my maths ain't good, so is there an easier way of working out the costs leading up to the court case?? I've got to get my paperwork in by the middle of this month. AAGH!! HELP!! I can't believe how quickly it has come up.
  6. I really feel for you, these hotels have no problem filling those places with that kind of notice. We've booked with a very decent, fair hotel in cornwall. They keep a percentage depending on the notice you give and if over a year, you pretty much get most of it back. They only took 500 pound deposit initially and don't require you to top it up until 3 months before. When re-booking in the future, try and find one who does similar, your going to get a good service if you go with a hotel who practices fair, honest terms and conditions, obviously the ones that ripped you off don't!@
  7. We hoped the same. We started our battle against barclays in july hoping we would be the money before our wedding end of december but just got a court date for march next year!! How annoying, it's my money they have and they can do as they please with it. Good luck for getting yours before your wedding.

  9. Ahhhh! Got a court date for 14 March next year. Please tell me that they are still not turning up!! Been busy working for the past few weeks so i haven't had time to come on so if there are any updates can someone let me know. What do i do now?? Where can i find help with preparing the court papers?
  10. When i do a schedule of charges, do i put the interest on too and where can i do that? Do i put my court costs there too? Where do they go? Didn't anticipate it going this far, most other banks are paying out a lot easier. Hope i get my money back in the end! This is too scary, back to not sleeping again worrying about it, ah well never mind, what will be will be lol!!!

  12. Did you include a schedule of charges and interest with your allocation questionnaire, as i'm about to send mine off and haven't. Should i be doing that? Your advice would be appreciated.
  13. I found a piece on filling out allocation questionnaires on one of jonni2bads' threads, was really helpful so thanks to him. Already to send now, lets hope it gets resolved promptly. So....what do i do now, where do i find the things i need to prepare for court? Has anyone had a settlement from barclays, because they seem few and far apart, it's a bit unsettling! Scared now!!! Will i get the £100 fee for the allocation questionnaire back, and if so how?
  14. Help!!!! Just got my allocation questionnaire through and don't know what i am suppose to be doing next. Got to have it in by the 1st Novemeber. Advice would be gratefully received. :o
  15. Hey, that's great!! Hope that is what happens with mine. Mine was deemed as served from the 17th so they have till the 14th October (which is on a sunday, so they have till next friday) if my adding up is right, doesn't stop me waiting for a cheque everyday though! Congratulations!!!

I'm glad that it's only 28 days in total, although expecting them to defend it Used the interest calculator, so if i have to list the charges and interest, is that easy to do, or should i have done it differently? Why do we have to have the awkward bank, why I can't believe how long they draw it out! At least it means the interest can build up, although, i know it isn't a lot. How long on average are they taking to file defence before the end of the 28 days? They have got till the 14 October, anyone want to take a guess, place your bets please!! lol!!
  17. I don't mind you taking over my thread, it's great to be able to check and see that your not alone. Still confused over the 28 day thing. My claim has been acknowledged today and this is what it said on the MCOL: "The Defendant is allowed a total of 28 days from the date from when they are served with the claim to reply. " they were served on the 17th, which then implies that they only have 28 days in total which is the 14 October!! Is this the never ending debate? lol? Anyway, glad i've had an acknowledgment, will keep you all posted.
  18. I was getting confused just reading it all!!! Kept me entertained for 5 mins lol!! Made me grin about the whole thing, which i haven't done for a while. Thanks guys for all being so supportive. Trying not to check my online claim every 5 minutes so made a bet that i will not check it till after 1pm from now on, and it's only 9.17am and it's killing me!!! Keep me posted on any developments

Feeling a lot more optimistic about it all now, at least the longer it takes the more interest they will have to pay!!!   20. Thanks for the encouragement. I'm getting married in December and could really do with the money, and at this rate will be lucky to get it before then.   21. After listening to my mate (who now has been paid out by A&L, and extremely easily) she had me convinced that barclays was one of the easier ones to sue! After reading more closely i now know that this isn't the case. Issued court proceedings on 12th Sept, which i now know won't be acknowledged until about the 13th/14th day, then the wait of another 28 days!! Is it really worth the sleepless nights?! Is it likely that it will then be defended in which i will have to pay more money and spend more time, listing my charges?? I don't know how you really work out the interest, as using your calculator, my mate who just got a cheque wrongly thought you added the total at the bottom of the calculator to your charges fees, so she had to then file an amendment, but before they got that they paid, and about £500 more than she had worked out on the amendment. If you have to pay for the next stage, do you have to stay at the figure you have already filed for?? Am i worrying too much?? Going mad!!
  22. I am at the same stage as you, started proceedings on the 12th got a letter today offering me £550 when i've started court proceedings and asking for £1650.00!! I don't think i am going to reply to the letter, but let the court sort it out as i have already paid them to do so. Have you done your claim online?? If so you should have included your court fees in that, then when you are paid off they have to include that in the sum. I think it's scary too!!! Help!!!

  24. Hi , been doing the bank thing for a while, but not through this site, so finding it all a little confusing. It started after watching Trevor Macdonald, a few days later i had been charged by natwest £38.00 for a returned direct debit, and as i sat there moaning about it, my partner convinced me to write to them about reclaiming charges. They promptly send me my statements and within 2 weeks had written to me offering 50% which i took as the total amount was quite low. Had a previous account with barclays that got closed due to owing them money, part of which was due to charging me. They have really messed me around, writing back eventually and trying to change the goal posts (so if i give them 14 days, they write back giving themselves 28 days!). The 14 days that i gave them is now up and just issued 7 days till issuing court proceedings. Kinda hoping that it will go to court now!! Going to go mad waiting for the post each day, or not as i want it. Don't know if i'm doing anything write so feedback would be great and if you can help me with wording for court papers, would be appreciated as started preparing. :? Thanks, Kate
