  1. Please don't give up yet!! If you send the letter in the templates saying you will persue the full amount they will give in. You must persevere, that past 2 days on GMTV have had people who have gone all the way and see how many millions watch that. There was a guy from a bank who could not defend thet large amount for charges and was talked down. There is over 10,000 people engaged in the various websites. I'm on low income and want my money back!! If it's not too late keep the going.
  2. This is the one when the offer has been made after court action has been taken. The top ones for an offer made after pre-lim letters were sent but no action taken yet. Sorry for the error.
  3. Hi Foget the above. I have used this one. Dear Sir or Madam I acknowledge and refer to your letter dated xxxxxx. I respectfully decline your offer of xxxxxx and request, once again, that you return to me all charges imposed to me on this account, interest and court fees, now totalling £xxxxxxx. I will accept the sum offered only as part settlement and only on the clear understanding that I will pursue recovery of the remainder. I would be willing to withdraw the claim upon receipt of full unconditional settlement of my claim. I trust this clarifies my position. Yours faithfully
  4. Hi Found this in templates. I used it but not the red or blue bit. BANK NAME Address Address Postcode Re: Account number XXXXXXXX Response to settlement offer. Dear [named sender or Sirs] Thank you for your letter dated xx/xx/xx I respectfully decline your offer of settlement and request, once again, that you return to me all charges imposed on this account, totalling £xxxx I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder, with a County Court claim if necessary. My letter before action sent previously indicates that you have until xx/xx/xx to respond before Court action commences. You are reminded that there will be no extension to this timescale. I trust this clarifies my position. Yours faithfully [signature] [print name] BANK NAME Address Address Postcode Re: Account number XXXXXXXX Response to settlement offer. 5. Hi Kerry Have Cobbetts made you an offer yet? I got an offer for approx half this morning. usual 'you will not win' letter. Sending 'thanks but no thanks I want it all' letter today. Good luck we willl get there in the end! isobel
  6. Hi there I got exactly the same letter this morning. I am going to reply with the 'thank you I will accept as part but willl still proceed with the claim' letter. Posting it today with 'signed for' post. Hopefully they will send our cheques out before the weekend. isobel
  7. Hi Greg Still waiting. Did they refund the interest and court costs as well? Did you have to sign a disclaimer to keep you quiet? Again, well done!!
  8. WELL DONE YOU!!!!!!!!!!!!!!!!!!!!! Great news, still waiting for that cheque to come through. isobel
  9. Ho Greg It sounds good to me. I pu the same info in as ammendment to particualrs and asked them to complete a CPR request. I'm sure they will settle soon, have you seen Delorean - he won in a matter of a couple of days from partial offer to full refund. Why? because the judge wanted to put his as a test case in Crown Court. That frightened the life out of Natwest. Hopefully it won't be long before they cave in. Isobel
  10. Go to Bank Survey Charges Results on the iste map - there is a table of all the banks and the numbers of claims paid out. If you check each day it is very exciting. Natwest have had approx 6 claims paid out in the past few days. When I started my claim it was approx 90 something now it is 158 and that is only from people who have completed the survey results themselves. Probably alot more. Keep going11 Isobel
  11. WELL DONE YOU - CONGRATULATIONS!!!!!!!!! there are so many of us at the same stage as you, the test case at crown Court may frighten them into paying up quicker, heres hoping. Hope the move goes well. Isobel
  12. Hi Kezza, I 'm still waiting too, just send me my money!!!!!!!!!!!!!!!!!!!!! I've got their defence, they have got my defence, they have my AQ, I have their AQ maybe they ran out of cheques and are waiting for a new one to come in the post!
  13. Hi Debbie I am at the same stage. The court has sent Cobbetts defence - pretty pathetic really. The asked for CPR by 13 Sep - they didn't get it till 19th Sep. Boo Hoo - they had no right to ask for it it the beginning. You just have to wait, probably send a letter with an offer.
  14. Good Luck, fingers crossed for you. Isobel
  15. Hi Clarky & Chris, I handed in AQ today at Oxford County Court. I asked the person who took it if she had seen any others claiming from the banks and she said she hadn't. Strange is no-one in Oxford claiming. Anyway I sent the whole 3 page ammended defence (from Bs0lth) for Cobbetts to answer and a CPR request for them to answer asking for proof of charges eg. manual intervention, telephone calls etc. All the stuff that we originally asked for in the S.A.R - (Subject Access Request) (I only got statements not SAR). Has anyone elso done this? Isobel
  16. Hi Roger, Me too, have prepped the next letter for them for next claim. Should be quicker as have statements. In my request to them I asked for them to complete CPR Part 18requesting confirmation of how the charges are made up, and to visually see their evidence for making the charges. That should be interesting to see if they reply and how!!
  17. Hi Kerry Did you sent it special delivery toCobbetts? I am off to court now with my AQ. Just stalling tactics, I think we all think that it will be ours that goes pearshaped!! Keep your chin up and good luck. isobel
  18. Congratulations you!!!! I think they were probably scared if it got out and came to the attention of the media or local press. You are an inspiration and if letting other people know how you did it, then maybe more people would have the courage to go for it. Isobel
  19. Hi there, I decided to send my defence and request for them to complete CPR Part 18 as did Bs0lth. They sent full payment to her within 14 days. Bit long winded but thought it may be a bit different and wanted to see if it made a difference. Going with AQ to court today. Is it scary?
  20. Hi Michael is great with his replies. I am at the same stage as you and going to court on Monday with my AQ completed. I posted my letter re request for CPR part 18 recorded delivery so no way they ssay they didn't get it. Good luck!!!
  21. Hiya Plutos, This is the response letter to the request for CRP saying not necessary as small claims but have attached schedule of unlawful charges - are we on the same track? I thought that they needed this info as Natwest has not provided them with it.
  22. Being a bit vague today. I have a total for all the charges on a spreadsheet but not an accumulated total of interest worked out day by date, and a total of the interest owed via. the online calculator at 8%. Total charges 3630 between Nov 00 and Jul 06. Interest looks like 1495.53 does this look right? Interest seems a bit high to me. Any thoughts....
  23. Hi there all, Sendind CPR response to Cobbetts. Having a bit of a mare!!!!!!! Lost my original spreadsheet with interest calculated. Can i send the list of charges with a subtotal and the total for interest added at the bottom. If I change the one I have done it changes the days from offence to today's date. This is not appropriate. Am I totally stupid? Probably........
  24. Well done. Was it Natwest or their solicitors Cobbetts who acknowledged the claim?
  25. Hi Chris - I really hope so. I did mine through MCOL so will have to wait that bit longer. I have until the 19th to return AQ. have sent refusal to return CPR today. decided to send the simple version. Don't want to trip myself up. Anyway not long or you. Fingers and everything crossed for you!!!!!!!!!!!!!
