  1. I was a little hasty in stating that it would be a cold Christmas, because it appears it is going to be an extremely good one. Offered full setllement on Monday but noted the letter from [problem] did not state a definitive date for payment and consequently I was not prepared to sign the letter in agreement of their terms. Sent a letter stating that I would accept their settlement terms on the provision that the payment was received in my account within 5 working days from receipt of my letter. Just rang them and the payment will be in my account by the end of next week - £4k - Get in!!!! Just before Christmas. Good luck everyone else!!!! As soon as it is in I will make another donation - Goodbye and thanks for all the fish!!! Warrior
  2. Definitely going to be a cold Christmas - I didn't particularise my claim fully, what a gimp!!!! Anyway, no worries off to my local Count Court tomorrow to amend the claim. All worth it for over £4k. . Shame they don't capitulate like MBNA, although looking at it from a commercial viewpoint; it is undoubtedly costing Lloyds more to defend these claims and protect their revenue, than the cost of refunding them without defence. I am not sure that gives me confidence in Lloyds financial advice services or decision making. Love the new look of the site, so much easier to navigate and find info - Glad to see our donations have not been frittered away on Mercedes SLK for Bankfodder and the crew. Thanks guys, Warrior

  4. Hi Guys, Fresh from victory over MBNA I am well into my claim with these sharks. LBA to be sent tomorrow. Having read a few threads, Lloyds seem a bit more slippery than the other organisations. Can I expect a fight? Can anyone give me any tips for handling this lot? To be fair to MBNA, whilst their now reduced charge of £12 for non compliance is still far too high, at least they have made a gesture. This bunch of leeches have actuall increased some of theirs to £35. Can't wait to win this one. Cheers Warrior

    Hi Loz, May be worth giving their Customer Advocate Office a bell. They appear to be wanting to sort these actions as soon as possible - The way they are going at the moment, they may well calculate the charges & interest and settle on the same day. It's worth a try and will save you loads of hassle and waiting. Try Gareth Tunnicliffe. If it is not resolved, you can continue with your action. Warrior

Wonder, Send the prelim letter stating that you accept the gesture as part payment only and will continue with your action to reclaim the outstanding amount plus interest. 10 - 12 days after sending the prelim letter ring Gareth Tunnicliffe, 01244 672628, and ask for the remaining balance plus the interest on the whole £1400. They usually go away, calculate the interest, ring you back in an hour and offer full settlement. This is what has been happening more and more. Obviously, if they don't offer full settlement, then continue with the process. To be honest it is a whole lot easier to make the phone call than going through the whole action and I think MBNA have realised that it is a whole lot cheaper for them than attempting to fight you.   8. Good Luck Mate, MBNA seem to capitulate very quickly now, as long as you follow the process. Get your charges, add them up (They will even calculate the interest for you), send the prelim letter and give Gareth Tunnicliffe a ring about 10 days later - 01244 672628. They usually offer you a full settlement as long as you make sure you ask for the interest, otherwise they just offer you the charges amount. My charges totalled £1500, which they offered, I told them it would not resolve my issue due to the interest on the charges and they got back to me within an hours offering charges plus interest - £2692 Warrior
  9. Crmorlife, I think these lot have accepted the situation and getting your charges back from them now seems like a formality. There are a few threads on here now stating that full settlement has been offered before any action. Get your charges list, send them the prelim letter and give Gareth TUnnicliffe a ring shortly afterwards - Job Done. Good luck mate Warrior
  10. Just letting you all know that I got a full settlement yesterday. Made a phone call to Gareth Tunnicliffe 12 days after the prelim letter and got a full settlement within an hour - £2692. Result!!!! Just want to thank everyone for your help and support, but especially Surreyscouse, thanks mate. Sev - I hope things continue to go your way. This group is really making a difference to peoples lives, I hope that many more become enlightened and start the journey to taking back what is rightfully theirs.   12. Hi Guys, Sounds promising, I will give them a ring on Monday - Just sent the prelim letter requesting the £1500 in charges they have taken from me. Must say that getting £3.3k from £1.3k of charges has certainly brightened my weekend. Thanks for the info, I will let you know how I get on after Monday. Warrior:D

Hi Fluffball (seems weird typing that to a stranger!!:-| ), You will get a standard letter shortly stating that they have received your "complaint", then probably get a simple list of charges around 33 days after you sent your request. It's murder waiting for it, but worth it at the end. All the best Warrior
  14. If they haven't complied with the Data Protection request within the 40 days, you should report it to the Information Commissioner as per FAQ's. This should make them move quicker for you. Warrior.
  15. I am in agreement with Polly regarding the acceptance of the goodwill gesture - It is exactly that, a goodwill gesture and therefore not in repayment of the unlawful charges. The "gesture" is not in my account yet and I am just going to go for the full lot. I am worried by this interest charge that I should work out - I noticed on some posts by Barricuda that some people were not including in the "Some people are making mistakes thread". The only thing is that I don't have a full set of statements, so I can't fill in the advanced form with the end of month balance. Does that make sense, or am I panicking over nothing? Cheers Warrior

Scouse, In the template letter for Prelim Request it states that: "What I require I calculate that you have taken £XXXXX plus £XXX which you have charged me in overdraft interest for the sum which you have taken. Total £XXXXX . I enclose a schedule of the charges which I am claiming with this letter" What would you advise to replace the amount of interest? - "You have taken £1500 plus compound interest which I will allow you to calculate" Does that sound okay, or would they fob me off?   17. Hi Polly, They refunded it to my account. I am not sure what the score is with that. Having read the other threads, probably should accept their goodwill gestures as part payments, take it off your overall claim and keep going for the rest. Warrior.
  18. Okay I have got over excited then fell back down to earth when I had a look at the advanced spreadsheet for calculating interest. What is the score with that? Can I only request the £1500 + 8% or can I go for compound interest? Please help Cheers Warrior
  19. As it happened, I didn't need to send a reminder. When I got home last night there was a letter from Steve Bailey. Standard letter, offering £100 goodwill gesture and a list of my charges which total £1500. I will accept as part payment and move on to claiming for the rest. Sorted Warrior

The request was signed for on 11th July 2006 and the deadline for your compliance is 21st August 2006. I would not wish MBNA to fall foul of this legislation and require the intervention of the Information Commissioner. Consequently, as a matter of courtesy I am reminding you of your obligation and to seek an expected date of delivery for the requested information. Warrior

    Sev, Just want to echo everyone else's feelings - What MBNA are doing is scandalous and the majority of us have all been through the same harassment. The worst thing about it all is that when you are obviously struggling financially, usually already dealing with the most upsetting of life problems, unemployment, divorce, business closure etc, these ruthless b*stards only serve to compound your misery despite you acting with integrity and informing them that you are having problems - They actually ask you to do this!!!! It is obviously the action that triggers the release of the hounds. DO NOT LET THEM WIN, EVERYONE IS BEHIND YOU FROM ALL OVER THE COUNTRY. Fight on!!!! Warrior
