  1. I really dont get this, nobody is bothering to read what the law says and starts posting all this rubbish about the law is flawed. enforcement starts seven days from the point the notice is given to the debtor.
  2. pre-action protocol is simple enough, its called an LBA or Letter Before Action. Taking the council to court is logical because they are less inclined to vigourously defend a claim but if a Ross Roberts want to tool up then its at their expense. Elsewhere on this website its unanimous advice to take banks to court but not bailiffs. why is that?
  3. The only one looking for loopholes is you. you bleat on about courts giving money to bailiffs and say its regulation 13.
  4. Bailiff advice is tomtubby, that stuff about money paid is proceeds of enforcement is complete rollicks. Enforcement is taking control of goods. He doesnt take control of goods thes no proceeds.
  5. Wouldnt it be a matter to adding together the fees, subtract whats charged and reclaim the balance? Cant see that needing lawyers to spin it out, or is there something more?
  6. Neckbeard. Money paid to the EA is not the same as proceeds of enforcement. I read it that enforcement is the process of taking control of goods. That power ceased under the council tax regulations reg 45.
