Just for the fun of it, I wonder what the actual cost is... given that it is a computerised system its time to respond to the action must be measured in fractions of a nano second and given the economies of scale employed at the bank the cost of paper printing and automated mailing are likely to be miniscule... Perhaps we can calculate an estimate for the bank just to show our willingness to cover thier costs..... what would you say 5p? seems a fair offer to me
  2. I always thought we would see the "Refund the difference" response and here it is.... Does anyone know if this is lawful. My view would be unless they have adopted it as thier practice now they cannot reasonably expect to apply backdated lawful charges? and I would still want them to JUSTIFY thier charging regime.
  3. CATS... just to confirm what stage you are at have you gone through the claim process, sent your LBA and completed your Small Claims Forms and sent them? If not you should not have applied the cudicial interest rate to your claim yet.

Please somone correct me if I am wrong but if you complete the spreadsheet calculator with debit interest the figures it gives you are an estimate of the amount of debit interest you would NOT have incurred had you not had the unlawful charges in the first place. Therefore you are not claiming ALL your debit interest back just the amount you have ESTIAMTED to be attributable to the unlawful charges over the 5 (scotland) year period. I would suggest you do take them to court on this and add that it is the defendents (Your Banks) responsibility to provide a more accurate estimate of the unlawful debit interest based on the unlawful charges. They will probably respond with somthing along the lines that if you had not been charged you would have used that money elsewhere anyway but if they do I doubt they could prove what you would or would'nt have done given that you never had the opportunity to do so!?
  5. Just been reading through the Summary Cause forms... is there a limit to any costs you might be liable for if taking this route... I am claiming for £913 but I am loathe to making two claims for this at small claims in scotland unless there is a substantial cost risk by taking the summary cause route... Whilst I presume I do not need a solicitor.... they could turn up with Kavanagh QC! and in the unfortunate event ... leave me liable for his costs? Any advice from others taking these routes or success rates and ease of use would be appreciated.... Also... is it even concievable that the court would see £913 at small claims in scotland and would this be worth trying for first. I am sending my 1st request to HBOS as we speak for the full amount but without reference as to how I would intend to claim i.e. full amount or by 2 claims at small court I presume this is acceptable and I do not have to commit to the small claims or summary cause route until I actually pick up the papers?
