Hey great news.......I won the appeal!!!! Have just received an email back from POPLA stating that Athena must cancel the parking charge notice.. Reasons for the assesssors determination. It is the Appellants case that the parking charge notice was issued incorrectly. The operator has not produced a copy of the parking charge notice, nor any evidence to show a breach of the conditions of parking occurred, nor any evidence that shows what the conditions of parking ,in fact ,were. Accordingly i have no option but to allow the appeal. I dont know wether anyone else has done so but i will be writing to Athena with my costs now for letters,appeals,time and recorded delivery costs....i will let you know if i manage to get paid out! Many thanks to all that have helped me on here.

Kelly. If i get the same outcome i will be sending a letter for costs to Athena....will you be doing the same?

Hi Kelly. I put my appeal in last month and my hearing is on the 26th......have not heard anything at all so far so hopefully i will get the same email as what you have received.....fingers crossed and well done to you.

Thanks ims21.....its appeal time with POPLA...can anyone help me with what i need to put into this appeal. I did ask Athena for a breakdown in their costs for this charge which they have not given me. I also asked them to provide me with a copy of their contract with Lidle for them to pursue charges,again something else they didnt provide....anything else i could add?

No not yet.....the wife was parked in lidl at 8am...think shop was shut....went running and came back 17 minutes over...it was actually dark as seen on the 2 photos we received on the notice and she genuinly didnt see the signs as they were poorly lit.....i am the RK and got the notice through so came onto this forum and copied the letter you had sent.....sent it recorded delivery yesterday....will let you know what i get sent back....many thanks for the reply as it has caused distress with the wife....i have told her to chill and will sort it out..
