The bank have refused to send information under a DSAR as the person is deceased so do I now try to get the information under the Freedom of Information Act. Thank Tlk
  3. Thanks dx100 uk, I think assurant are trying to pull a fast one. Tlk
  4. Hi all, so after all this time assurant ( d and d home care) have agreed to pay back the the premiums for the years I wasn't covered but are refusing to pay 8% statutory interest on the grounds it wasn't missold. Am I right in thinking that if the policy was non cancellable and non refundable then it contains an Unfair contract term so therefore should included the 8%. Any views would be appreciated. Tlk
  5. Hi, I've received an email from the FOS stating that UKi have rejected the complaint on the grounds it is out of date and the FOS are looking into their jurisdiction and the fairness of Uki's claim. Does anyone know what the FOS jurisdiction is in this matter please. As I said previously the single premium mppi was taken out in 2002 and the FOS where looking at the administration of the policy . Thanks TLK
  6. Hi all, just an update on this ongoing saga re d and d home care ppi. After Assistant so kindly sent me the documents relating to this policy UK insurance ltd (NIG) have finally admitted they were the underwriters, after point blankly informing me that they had never underwritten such policies, hard to deny when it's in black and white. The FOS have now opened a case against them, not under mis selling but the way the policy was administered and the fact that the policy non cancelable and no pro rota refund offered. As I said think I said before the policy ran for 5 yrs and covered a mortgage, after it running for a year I then gave up full time employment after having my first child, so I had therefore paid upfront for a policy that was of no use what so ever. I also remortgage within that 5yrs so again useless. Will keep you all updated when I get a response, fingers crossed.

  8. Not yet dx, just sent of their ppi questionnaire. Will be on to it now
  9. Hi all, I tried reclaiming ppi I had with an old pre 2005 principles card. The ppi was sold to me over the phone, I never received any terms and conditions so was not really sure what it entailed. As it is I never needed the insurance as I was working full time and was entitled to 6 months full pay and 6 months half. Santander have now written to me asking for prove of sickness benefit as they have had to go back to the insurers and will not uphold the complaint unless I can provide this. Unfortunately I left the company 14 years ago and they have since ceased trading. Can anyone help me on what to do next if anything. Thanks Tlk
  10. No Ford, I had all the info I needed for the other complaint, statements and agreements etc. I'm usually quite anal about keeping paperwork hence still having bank statements dating so far back. Unfortunately this loan was taken online and if I was sent an agreement I can't find it anywhere. Lloyd's are going to be glad see the back of me after my last success with them which ended with them having to payback nearly £30,000 in interest and charges.
  11. Thanks everyone, will get on to it straight away. Tlk
  12. No I haven't sent an SAR yet, I didn't think I had ppi on this loan it was only after I phoned them regarding ppi on a 1997 loan that they gave me the account numbers of other loans I had with them that they say had ppi and this was one of them. Will get on to it straight away.
  13. No nothing, only old bank statements. Lloyd's haven't said a definite on the refund yet Im just living in hope. Just interested in what sort of figure I would be looking at if they do uphold. I know I'm probably jumping the gun but I'm well aware of the little games they like to play.
  14. hi,Mightymouse, I'm not sure whether this is was frontloaded or not as I never requested it. The other I know I was told at the time the ppi would better my chances of getting the loan.
  15. most of them, I was paying £297.00 Per month and if I recall correctly it was over 84 months but I repaid it after a year. Tlk.
  16. Hi Ford, this is pre fos, it was a loan I forgot I took until I was going through very old statements. I phoned Lloyd's regarding this and 5 other loans, they have admitted PPI on 4. I had a call the other night asking for more info on one of them and I should have their response soon. This is a new case Ford but maybe I should go down the irresponsible lending route with the 2006 loan also. back to this case, I was wondering if the ppi would have been front loaded as if it was I never had a rebate when I paid it off a year later. If I had I would have known poi had been added. Cheers Tlk
  17. Hi all, Lloyd's have admitted that I have PPI on a £17k loan that I was unaware of having and I would not have taken it out as I was only working part-time. They have yet to admit mis-selling but I should hear within the next couple of weeks. As I have no paperwork I was wondering if anyone knows whether or not the PPI would have been front loaded. It was taken out in 2006 under the name of Loans direct and was repaid early.
  18. HI All, i'm still trying to claim back my single premium mppi from Assurant ( D and D HOMECARE LTD). Of course they aren't having any of it, claiming " we weren't the ones who sold it to you". The FOS and FSCS wont help either as pre-regulation. My next course of action is to go to the top, if anyone could help me with the email or address for the CEO of Assurant Intermediary ltd I would be very grateful. cheers TLK
  19. hi all, the fos and fscs have said they cannot help as pre-regulation and cannot find a relationship between D and D homecare Ltd and the underwriters who they say were UK Insurance ltd. Anyone have any idea where to go next. cheers tlk
  20. Hi all, does anyone have any idea who the underwriters were for D & D Homecare ltd, now Assurant, back in 2002. Cheers tlk
  21. Cheers dx, will send off complaint and keep you informed. Tlk
  22. Thanks dx, i thought fsca would only look at the ppi if it started after 2005, not sure though. I read somewhere that in some cases the fos will look to claim off of the insurance provider, wasnt sure that this would be the case with single premium ppis, at the end of the day it was the insurance company who had the money. Any thoughts? Cheers Tlk
  23. Hi all, a letter was sent to assurrant solutions who now own d&d homecare, their response is that they are the provider of the ppi not the people who sold it and that my complaint is with jml consultants who sold the ppi not them. Unfortunately jml have gone out of business so assurant have suggested i go through the fsca. Surely assurant have some responsibility in this case for failing to insure that the product was suitable, for not providing the overall cost of the ppi including the interest and for providing a single premium ppi which only covered 5yrs of a 25yr mortgage. This i believe the fos class as a term mis-match. Any help please._ Tlk
