  2. Hey All, As per TPO website, the agent should inform the prospective tenant in "writing" the purpose of holding deposit. Are they supposed to give the tenant a copy of the form on which tenant authorizes them to draw holding deposit? At the time of accepting the offer from customer, what all is an Agent supposed to do in the interest of customer? One of the Agent retained my holding deposit by interpreting my LLs reference in her own way. Basically what happened was that at the time of viewing, I explained the agent very clearly that I was made redundant in April. She said its all-right and as long as I am able to prove my employment till April. However the next day, the landlady who works a the same Agency said she was not willing to let out the property to me and that she will talk to lady who showed me the flat. She finally refused to let let the property to me saying that my credit check has failed as my LL reference was not good enough. I had a discussion with my LL and he says that he had said that I was a nice guy, living here with boys and there were a few occasions when the rent had got delayed when I was at my home country. My current contract is a joint tenancy and I told the Agent about this? There is no way I can be held solely responsible for delays in rent. I think as the landlady did not want to give me the flat, she just made an excuse. Is an Agent free to interpret the LL reference in just any way they like? What prospect are open for me now? £350 is not a small amount. Please help me.

  4. Thanks Mariner for reply. With my tenancy due to end in May, my landlord never got GSC certificate for last many years. Now that I have requested it to him, he is likely to get the inspection done this week. Once he gets the inspection done this week, Will I still be able to complain HSE that he did not get the inspection done in last two years?
  5. Hey All, I am new to this forum and I find it great. What is the process for getting GSC? Does it not involve the tenant present at that time signing the GSC? Can my landlord not forge one and say that he just forgot to give it to me. Does GSC have the signature of the tenant to approve that GSC was actually done? Otherwise my landlord can always find a dodgy gas safe engineer to issue a certificate in back date. Isnt' it?
  6. My landlord protected the deposit quite late: Given this, I understand that I can claim up-to three times the monthly rent. Are there other items that I claim, say for example - the expenses incurred in maintaining the property cleanliness and state of repairs. If so, how can do that?

  9. My landlord never handed me the GSC. Is there a way to find when was the time he got GSC inspection done ? Are GSC certificates also stored with any third party organisation as well?
  10. Thanks Mariner, Agreed that the previous tenancies will be disregarded but I am sure giving this information to judge will help get the maximum penalty awarded to me. Also the LL tried to rent out my garage to one of the other tenants without taking my approval/informing me. Presenting this info should help me get the 3x penalty I suppose.What do you say? Also thanks for the pointing out the risk but with the additional points ( lacking GSC and trying to rent out the garage which was mine) , should I still worry about losing. What kind of points LL could make to mitigate his side? The rent has been being paid within one week of start of month for last five years.
  11. Hello Mariner51, Why do you think I could lose the case? The evidences to be produced in court for civil cases need to be disclosed in advance by both defendant and claimant, There cannot be any surprise for either of the parties in the court: Isnt't it? I will know about the strength of LL case very well and proceed accordingly.

  13. Hello Samderby, I tried calling Shelter but could never get beyond the menu which asks me to press zero. So just thought of asking you weather I could be liable for uncapped defense cost? Is there any organisation which can help me sort such questions.
  14. Thanks Samderby, Did you have a personal experience of this. Just asking as you sound quite familliar How can I press for the maximum penalty? I was thinking of using lack of GSC certificate to demonstrate the nature/personality of my LL. Can you suggest what are the points which can help me to press maximum penalty. He has not protected my deposits for last four annual contracts. Will this help maximize the penalty? Thanks
  15. Mariner51, Many Thanks for your reply. What is the maximum that I could lose if I were to go to the county court? The LL did not obtain GSC despite my request/reminder to have it done. He said that he will get the GSC done only if I enter into a fixed term contract. He has got GSC done only once in last five years. Also The LL did not protect the deposits for last four annual contracts and for the latest contract he has protected the deposit but only after I chased and chased. So my deposit was protected but delayed by 11 months. Can he get away if he has protected, late though?
  16. Hello Friends, My current contract started on 01-Dec-2011 and ended on 30-Nov-2012. Subsequently I have been on rolling tenancy on monthly basis. I am moving out on 31-May-2013. My LL had not protected the deposit and only after I pressed him did he protect my deposit on 15-Nov-2012, which means a delay of nearly one year. My LL has been very nasty to me. I stayed at this placed for five years, took good care of his property and still he is a nagger. He has not got me the GSC either. I want to pull him to the court for delay in protecting my deposit and claim compensation. What is the best way to do this? Will the fact that he did not get Gas Safety Check done in last two years help build my case? Many Thanks for your reply. Regards
  17. Hey Sidewinker, Thanks for your reply. Well my contract does not say anything about support. The contract says that I have to work for 35 hours per week and any overtime must be agreed in advance. But there are many assignments which officially necessitate me to work more than 35 hours. So am I legally eligible for overtime, given that the employer itself has stipulated the time of work and which extends beyond the agreed contracted hours. Thanks
  18. Hello Friends, In my employment, I have to be on support on weekends every 8 weeks and every I have to be on support till 8:00 PM. There is an official rota and we have to work based on this. Now these hours are over and above the 35 hrs per week that is in the contract. I want to understand weather it is legal for my employer to ask us to work beyond the contracted hours. Can I ask my employer to pay me overtime for the hours worked in past.
  19. But it was the LL who pressed that I need to stay for further quoting T&C, which were prepared by him and which is not a fair T&C, in first place. I succumbed to his pressure and decided to carry on to avoid getting into any legal trouble as I was not sure that time. But anyway, I think I will avoid this point. Given that he did not do it for four years, can I sue for each of the four years separately. Also What do you mean by 'provision of prescribed info' in your post above.
  20. I will be pulling my LL to the court for not depositing my money or not providing me deposit-id. How can I press for maximum penalty. Any suggestions. He has not provided deposit-id for last four years. He has not got the annual gas safety check done every year. He pressed me to stay back till December despite the contract ending on 30 Nov. Will any of these points help?
  21. Hey Guys look, this is what is mentioned in the annexure on which I have not even signed. Just can you tell me if such a clause is statutorily correct for a fixed term AST agreement. The tenant shall notify the Landlord in writing not less than two calendar months prior to the expiry of the term if Term is not be extended and in the event that the term is not be extended the Tenant shall permit the Landlord or his agents to enter and to view the premises at reasonable times by prior appointment during the last 30 days of the term or any extension thereof. In the event that no notice is given the tenancy shall be renewed.
  22. Hey, Is it statutorily correct for a fixed term contract to have a clause in its T&C that if two months notice is not given before the end date, then the tenancy will have to be renewed. Aren't T&C supposed to be within the limits of statute.
  23. Hey Raydetinu, Will it be cheaper if I initiate court process before expiry of tenancy? He has not given me the deposit-id despite me having asked so many times? What would be the best course of action for me? Should I first send a formal letter to him asking for deposit-id? I have asked him by email already? If he still does not provide me deposit-id, is there a way I can bring this to the cognizance of court so that he is punished for not following the law. Do I necessarily need to sue him?
  24. Hello Raydetinu , Many Thanks for replying. Even if my LL returns all of the deposit, Will I be able to sue my LL for not protecting my deposit at all? Regards. ps: I got mail from all three deposit schemes confirming that not only this year, but even in past my LL never protected the deposit. Although my LL has been telling me every time that he will give me the deposit-id after getting it from his solicitor. I know he is telling lie and is only buying time.
