  1. hi,morning, we were making the standard monthly current payments of approx £135 for our most recent bill, then the old debt cropped up and we made an arrangement for a further amount to be added to it to make approx £150, this was fine but we missed a few payments when hubbys wages werent geting paid properly and they sent ot straight to the bailiff as it was a large amount at the time £1955. i contacted the council right away but they were quite blunt and not interested despite my telling them i was paying them direct whether they retracted the bailiff or not,as we had already had phone and email and written contact with jbw who were only interested in amounts we couldnt afford, because by this time hubby had lost job but decided to go self employed to try and better himself and money was very tight or a few months with no financial help. weve had the standard few visits and charges added on and had an enforcement visit with 2 of them and a van yesterday and looking through our window and a letter left adding further charges for removal/enforcement,and 2 emails and texts from them this morning saying they will pursue due to unpaid account. ive been paying the local council direct since july and although only £50 a month have brought it from £1955 to £1705.the local council will not retract the bailiff due to the amount and not maintaining the arrangement when we were struggling for money,so i guess its myy own fault . i mailed jbw this morning acknowledging receipt of their email and text and noting its contents and simply told them that the account is not unpaid and hasnt been since july, will not be giving them any means of access through legal peaceful entry at any point, and pointed out we had already tried to make offer of payment to them and their push for more than we could afford, and their outright lie of lack of contact.. julie
  2. thanks for your advice, i know my rights and not to let them in and the means they use,im just generally worn out by it all.ive been paying the council direct since july and was hoping they would see this gesture as a testimony to my commitment to repay my debt and let me officially pay them direct
  3. hi i sent the following to them just now,I use the online payment system to pay them regularly anyway so assume its accurate as i use my local authority website and have to log in,i pay using my council tax ref and address and i am able to view my council tax account online which lists payments made and shows debt going down. The bailffs record of the debt is much higher as it has their charges on it.so my debt currently at 1700 shows as nearly 2300 with jbw
  4. Hi, we have an old council tax debt that was near on £2000, we had a payment arrangement with our local council and we were late making 2 payments and it was handed to a bailiff who we contacted right away by email and phone to make offer to pay and set up a payment arrangement. They would only accept amounts we couldnt afford or stick to,we made a clear repeated offer of £50 monthly and did income forms.despite this and our contact with them they then sent enforcement letters citing lack of contact and would not retract them unless we paid the amounts they wanted or the full amount. They were not willing to any payment plan other than one that was a minimum £150 a month and we couldnt afford that.from the start we offered regular payments of £50 monthly. Despite contacting our local council we had no luck in them retracting the bailiffs and the council were quite rude and blunt about it.Regardless we have made regular online payments direct to the council since July, but the bailiff still visits,i think they've done their 3 visits now,we had an enforcement visit this morning with 2 agents and a van. I know the rules about not being able to just enter etc but was wondering is there anything more we can do to stop this little short of being bullied into payments we cant afford because they'd be too high. The pressure and stress is awful.I'd appreciate and help you can offer, thanks,Julie
  5. I need the relevant piece of law as I had a response to my complaint an all it said was as I hadn't replied in time to the council I could send income details and pay rossendales direct and council refuse to take debt back from them, I have no intention of dealing with rossendales so the relevant piece of law to quote to the council when I respond to the complaint would be useful ty
  6. Ty again, ill write and email a further complaint but ill send the posted one via recorded delivery, this all started when I had a letter from the council about the debt giving me 14 days to reply and come to an arrangement which I did via post, never had a reply and then low and behold a bailiff visit, contacted the council and had a Short reply saying they hadn't recieved my letter and to deal with the bailiff even though the 14 days had only gone over by 5 days when the bailiff visited and the council had said they'd not got my letter, I further emailed to complain and they never replied, I then emailed a complaint and told them of my circumstances and they never replied again
  7. Ty stigman, spoke to the council and had the usual deal with the bailiff comment, only contacted the bailiff by text after first visit to let them know I'm paying council direct and refusing to let them in or have any dealings with them, bailiff replied he would talk to the council but did a 2nd visit a week or so later, that was last week, emailed council telling them I'd made a direct payment and to make a formal complaint and had no reply, told them I have 3 children of which 2 are autistic and one severe cerebral palsey but as I said no reply, am paying £40 per month as my husband is on a low wage, am not too worried about the bailiff but just worried as my yard will be unsecure from Monday, Ty for your help :0)
  8. Could someone please help me? , I'm sorry I don't quite get how to start a new post/thread but I need advice about rossendale bailiffs, I'd just like to know if my back yard is unsecure and they come into it, does that mean they can gain access to my locked home?, I have a council tax debt £1100 that I'm paying back to the council direct even though they won't help or call the bailiffs off, and know my rights and to not let them in etc, but I've had 2 visits and prob due another soon and I'm having work done on my backyard and need to leave the yard gate unlocked for the builders access, I'm not daft enough to leave my home unlocked but if the yards unlocked are they allowed to go into my locked home?
