  1. Never ever rely on Atos to record your "assessment".I took an upstanding member of the community(as opposed to a dodgy one like me )AND as soon as their creep had ushered us into the interrogation room,I said,"I will be recording this interview". "I had better go and see whether that is permitted",they replied."It is",I said.Off they trotted,or in this case lumbered, and returned saying,"Yes that`s ok but you can`t use it for your case".Oh really, I thought. Just in case the hideous individual refused,I had my witness with a phone ready to click it off whilst the thirty quid 2nd-hand digital recorder sat in my top pocket switched on. I am halfway through transcribing said recording and along with guidelines from.... street democracy.wordpress.com/using-atos-complaints-procedure.....sorry I was forced to remove actual link ,as have yet to accrue the required ten postings necessary! Had a post removed the other day too! I am turning some of the -ve stress which is compounding my chronic health problems, into +ve action. I tape all phone calls and with ones where the other side start with recorded codswallop about doing so for training purposes blah, blah, blah,if I have any hassle from the other side I tell them that I am recording.Their response tends to be "that`s illegal, you are supposed to notify me",to which I reply that the conversation was headed up with a recorded message saying the conversation was being recorded! Very often "illegal" then becomes "common decency"....something the can`t aspire to. Recording phone conversations has been an immense help to me.Also back in the day before digital,I carried a 35mm camera with film, and over the years had four incompetent drivers run in to me.Trainee quack,19F,head-on,in spite of me moving as far off the single-track road to avoid her as a stone wall permitted. Her posh mum phoned me saying that it was a 50-50 and she would get her London lawyers on the case to consolidate that "fact".When I responded that I had taken photos of the collision aftermath, she said that it would be her luck not to have a film in the camera, which was an attempt to suss whether I had.Don`t worry, the photos are on their way to my insurer and I have had copies taken,I replied. That was enough to win what otherwise would have been a 50-50 decsion or worse probably. Those types tend to twist things in their favour, making you the villain.Had that with a dog owner after their dog bit me. Then there was the RAF chap who shot out of a car park into the side of my car as I was driving along a town street minding my own business. He immediately apologised, saying he was half asleep having just returned from Belize.A recording would have been good there! Then a woman exiting a supermarket car park drove straight into the side of me as I was passing. Her view was obscured by a large German Shepherd dog in her front passenger seat!I collared a witness and took photos,by which time the GSD was now sat in the driving seat. The woman had the cheek to try and change the state of events but street witness and another who I later found saw the RTC from their house, together with the all-important photos, won me compensation.....which the then DHSS promptly took from me in lieu of benefit`s paid whilst I was incapacitated through injury! I still think to this day that move was illegal on their part. My big smash previous to the three mentioned,I didn`t walk away from but was able to give police info which they could corroborate, leading to a win for me.When you are seriously injured and close to death(thanks surgeons )you can`t use a camera! Do not trust anyone, always be one step ahead,or else someone richer or higher up the food chain will have their word taken as gospel and you will lose out,you will be labelled a liar!Turn the tables on them by being prepared.Expose them for what they are.Honesty can win out.Liars have poor memories and struggle to replicate their untruths.
  2. Thanks.Had a thought, DM might be department manager? Letter all ready to post to Atos tomorrow for them to decipher the illegible handwriting in the rest of the piece. Then I will be hitting them with a major complaints letter on Thurs hopefully.
  3. Hello everyone,I am attempting to decipher dodgy handwriting from an Atos manager to the awful character who carried out my farcical "assessment".It was written two years ago and was connected to rewriting part of the above.I am still building my case for the Tribunal Hearing.I will send a copy of the illegible script to Atos for interpretation, but don`t hold out much hope on that front. I`ve worked out half of it, but what appears to be DM? or OM? pops up as does TDM ?or TOM? The M could be something else too.....yes I know I`m not being very helpful...maybe the M is really a H or W? Can anyone think of possible abbreviations? Letter starts:- "Hi *****,please take a look at this for the DM?/OM?".... &.... "You advise w©=200.The TDM?/TOM? does not explore mobility well......" Thanking you kindly.
  4. Have you won the lottery?
  5. Had phone call saying no judge available to hear my case.Postponed. ...today received ambiguously worded letter, the content of which could be interpreted to mean that the cancellation was due to me and not them!
  6. Hope it`s ok for me to get someone to type this out for me,as have no glasses, three eye conditions and no money to pay for three prescriptions given to me less than a fortnight ago.Not sure how I`ll be able to function fairly at the Tribunal but I have notified them and had a second postponement refused. Thanks very much for your replies everyone,I had to drop this subject from my mind as it was making me ill through stress....autonomic nervous system, adrenals, you know the score I expect. Thanks Margaret,my Appeal will be heard tomorrow afternoon. If I`m too ill to attend,I wont be there, but my paperwork was faxed through from Brum,so they say.Hopefully I have sent enough proof to undermine Atos. They changed a lie and the alteration in text was upheld by the DWP.Bit of a minefield.I`m suspecting the Tribunal is just a formality cover and of little use for the appellant`s views. I taped my Atos interview and due to illness, have only transcribed a quarter of it.I obtained my Patient`s Records with view to using content to rubbish much of Atos write-up,but I find they are contaminated with another patient`s.I wrote to the Tribunal stating that I would be bringing the witness who attended my Atos "assessment" with me to coroborate my statements re Atos, but it was too short notice for the witness to attend.I also stated that I needed yet more time to build my case due to the problems mentioned above. Atos farce Firstly the interview was not private.I could hear every word of the preceding interviews. It was stated that I sat in the waiting room for 40mins,but in fact I stood leaning on a chair. This they altered later after I pointed it out to the DWP. I was rushed by the interviewer, not enough time to respond to questions properly and was too tired to undertake the physical tests at the end. It was stated several times that I was "Hostile".Tape and witness prove not so....but if the interviewer thought this to be the case, shouldn`t they have logged it under Mental Health Issues ∴ accruing points? Interviewer refused to accept paperwork showing treatment and meds and waved aside bag of meds bottles I had brought with me.In their write-up,the interviewer stated that I visited my GP infrequently and was on no medication. I have pointed out in the papers submitted to the Tribunal that points should have been awarded totalling at least eighteen....and explained why. Tribunal Letter Latest Tribunal letter in response to my request for further postponement(they only postponed previously for around a month when I requested time to obtain copies of my medical patient records and time to interpret them)and other paperwork submitted, which included recent report by optician, states that a postponement was refused. "This decision is made without sight of the file which has already been sent to the venue" So the Tribunal Office ignored the opticians report which backed up the fact I`m not in a fit state to attend! "The available information indicates that the date of the decision appealed is _/_/_(and they give a date which is thirteen days after my asessment!),and the Tribunal is required by law to consider the appeal based on the circumstances that existed at that date" So does that mean the Tribunal is judging only the altered Atos paperwork and will not consider throwing out Atos`s altered decision because of the doubt this casts over rest of their write-up due to them altering a section of it? Tribunal Directions Notice "1.The papers sent in by the appellant in support of his request for a postponement are to be faxed to the venue and issued as further evidence." "2.The appellant is to attend and provide further evidence."(In spite of me stating that I required more time to obtain this, and why I needed more time due to my various chronic health issues and how they affect my ability to function, and other relevant factors) "3.The Tribunal will consider the file of papers and hear from the appellant in order to decide on the day whether there is sufficient information to enable the hearing to proceed justly and fairly." I tried over a dozen legal oulets to try and get some help but non were interested in offering such help. The CAB have offered some help but non of them were legally trained and would only offer advice up to a certain level. Just in case anyone with five mins to spare has any advice or experience to offer,I will log back in several times up until around lunchtime tomorrow. Thanks for reading
  7. Can someone please provide an Atos complaints phone number, the 2012 one at the top of this thread is no longer valid.I have been waiting for over eighteen months for them to reply to the form I filled in.Assumed they had binned it,but was adviseed to chase them up.Local CAB haven`t been of much help, they act as if their hands are tied and have phoned dozens of legal info numbers with no luck either.I have Atos on three clear cut(as I see them) issues but no legal representation available.I will not attend a tribunal based on falsely gathered and presented info. The DWP never dealt with my complaint either,in spite of the details being supplied to them.
