  1. The only reason we're paying them is to keep 'em quiet - and also the fact that my husband 100% owes the money, and it wasn't old enough to even bother disputing. Once we had the information that proved hubby owed it, we agreed to pay a small amount each month. We're disputing this one with BCW because it seems pretty dodgy!
  2. Yes, we sent a CCA and an SAR for those accounts - which is why we're happy to pay the amount we're paying. It's just this one that seems a little odd.

Oh sorry, now I've confused you - Lowells are fine, we're paying them £10 a month towards two accounts - I just remembered we sent them an SAR request like, 2 years ago Do I send the SAR to BCW or Provident - I don't have an account number for Provident - only the last 3 digits off his credit file. Thanks.
  4. Thanks citizenB - am I sending the SAR request AND the other letter? Or just the SAR request. Come to think of it, I think that's what I sent Lowells - an SAR.

Loan was apparently taken out 08/05/2010 - husband does not recall this, and his two other Provident Home Credit's are both 'settled' and have been for years - which is why we're confused about this one. He never contacted them as we've literally had no communication regarding this alleged debt until about March this year, and actually thinking about it now according to his Noddle report the 'default' was logged in March and the first letter they sent was in January. I just don't get it!
  6. Thanks for replying. Firstly, I don't know who placed the default on the file - as the default just says (D) as of March 2014 - which basically means, there was no 'default' on his credit file for this account for 3 years. The actual 'default' date according to Noddle is 10/01/2011 but in 'Balance History' there is no history, no records of late payment, no record of default etc. Just a red (d) as of March 2014. I sent the £1 postal order with the CCA which was probably over a month ago now, via recorded delivery but never had any acknowledgement of them receiving this. In fact, as far as we know we've had no contact since until this email today!
  7. Hi all, Me again... . I need some help dealing with this nasty ones. My husband receieved a bunch of letters from these claiming they'd been sold a debt from Provident for £ 1,382 to our old address, naturally it progressed to the 'threatening' stage before we even got the letters as we no longer live there. They did offer us a settlement at some stage but because we don't live at the address, we never got it. We emailed them, stating he'd changed his name and his address and to contact us there from now on if necessary - we also sent them a CCA request (which they haven't responded to, at least not to our current address) This morning I checked his emails and we received this email: 'Dear Mr **********, This is an urgent message from Buchanan Clark and Wells. We have been attempting to contact you as we require to speak with you as soon as possible. Could you please contact us on 0844 571 4015 quoting this unique reference number **********, or alternatively reply to this email with a contact telephone number and we will arrange for someone to contact you urgently. Thank you Buchanan Clark & Wells' Naturally, we won't be calling them & I replied to the email telling them we will only contact them in writing - but this whole thing is so dodgy. This debt 'appeared' on his credit file randomly in March (it wasn't there when we first opened his account a few months before that) - the default date 10.01.2011 but where as his other defaults have a detailed history of payments etc., this one only shows 'default' from March 2014. I can't help but this something is going on here, but they refuse to cooperate. Anyone got any advice on how to sort this out? They're MUCH more difficult to deal with than Lowells and I feel out of my depth. Thanks.

Thanks, I just spoke to another advisor and he said in the long run the best thing to do is to pay off what we can, but focus more on saving for a larger deposit than paying off the debt as really on his credit score it might not even make much of a difference until the 6 years are up. I think it's probably best if I look into getting a higher paid job, save more and then get a mortgage in my name. Thanks.
  9. we're looking into getting a mortgage and in terms of my husband even being on the application is pointless. He's got about 4 defaults, one for over £5,000 which naturally any lender wont accept. We're making payments towards two of them, one's in dispute and another one we've just left because it's only £400ish and they haven't contacted us in about 2 years! I was thinking of making an offer for an F&F (for the big one) but not sure if I can do this because he's currently paying £10 per month towards the £5,000 debt. But ideally, we need to clear it or we're never going to get a mortgage and are gonna be stuck living at my parents forever! HELP!?
  10. Oh yeah, we sent a CCA request to Lowell and bascially everything they had was legit so we agreed to pay £5 towards each account (he had two) - we've actually just recently increased it to £10 a month - but hoping that the CCA request to BCW will help!

We didn't sign the Lowell letter, no - and they've been very reasonable thus far - and the 'default date' is some time in 2011 I think although when I click on 'default' it says March 2014 which must've been when it was sold? Will have to check his credit report. I'll send the CCA this evening, thanks!
  12. Hello, I posted on here a few years ago with regards to my husband's catalogue debt - which is now under control, we pay Lowell £5 a month for 2 accounts and they've not given us any hassle. We're saving to buy a house, and I know he's had a few defaults in the past so we did an in depth credit check and the only defaults showing as active were his Lowell ones which we're managing - which is fine. Fast forward a few months and we get some post from our old address regarding a Provident Loan thing that's been sold onto BCW group and they're demanding over £1000 - has anyone had any dealings with these guys? this debt is now showing on his credit file but a month or so ago it was showing as settled. I emailed them asking them to put the account on hold and tell me why it's suddenly become defaulted when it was 'settled' (even though he hasn't paid but all they said was that they bought the debt and if we've paid it we have to send proof. We're happy to come up with a payment plan but something tells me these guys are gonna be difficult. Can I sent them a CCA? If so, can someone direct me to the template cos we did one for Lowell but that was such a long time ago. Thanks.
  13. Thanks - it just seemed like a waste of time as when we got sent all the SAR info there was no evidence of any fees. And the balance hasn't ever gone up when they sent a new letter. My fiance was just happy to start paying £5/month towards each account, and they're going to freeze any interest so we can reduce the debt. The person we've dealt with seems very acceptable.

After being advised to reclaim charges and all sorts on my Fiancé's Littlewoods/Kays debt - we just couldn't be bothered with all the fuss, and it would've cost just as much sending all the letters recorded and SAR'ing all the companies and such, so we decided to make them (Lowells) an offer of £5/ month towards each account, so £10 in total. We got a letter on Friday to say they've accepted. I'm so pleased that we can start paying and get it all sorted. They've been relatively good to deal with, once we got in contact and showed we wanted to sort it out. So, fingers crossed and thanks for everyones help!
  15. Like I said, they didn't supply us with anything like that. It was just a bunch of copies of letters. No dates, nothing. I'll SAR the companies, do you have a letter that would include the CCA request and such too? Also, how do I go about reclaiming the payment of the £10 for the SAR?
  16. Hello - so do you think I should send a CCA request to Lowell, Littlewoods and Kays? I'm just trying to get it sorted as soon as possible, I know it'll be a long process though *sigh* Should I send a CCA request to Kays & Littlewoods, and ask Lowell to hold collection whilst I dispute it, or should I send a CCA to all 3 (although now that I've SAR'd Lowells, won't a CCA just be unwelcomed) as of yet, we've had no further letter from them, but I'd like to write to them soon so they know what our plan is.
  17. I need advice ASAP, I'm worried they'll start sending demanding letters again - we literally have like, £100/month spare and some of that is needed if either of us fall ill or anything, so I need to get this sorted.

  19. I can't remember, I don't have the stuff right infront of me - Lowell basically sent no agreements or fee notices or anything - it was literally just all the letters they'd supposedly sent, from RED, Lowell's and Lowell's legal side which I can't remember the name of.
  20. Okay so, does that mean I just send one to Shop Direct Ltd with both account numbers? - and then send a copy of the letter to Lowells, asking them to hold action on the account until further notice?

I think it was like, 2008/09 or something like that - I think I'm gonna have to go through all the letters before I do anything at the moment, I can't remember what the default date was... maybe just send them a quick letter telling them we're getting things in order and will contact them in the next week or so?
  22. Hi, sorry - yeah, I always forget to say what it was. It's 2 Shop Direct accounts, 1 for Kays and one for Littlewoods. Littlewoods; Just over £5,000 Kays; Just over £1,000 my fiancé was a darling son and opened accounts for his mother - she stopped paying and now he has to deal with her debt, unfortunately the accounts being in his name. We've only SAR'd them, we avoided it for a while as we were figuring out how to tackle the problem, and after advice on CAG I was told a CCA would be pointless as Cat debt companies just take it as avoidance - we don't have a copy of the agreement, my fiance doesn't have much in terms of all that stuff cos he avoided it for a while and, his mum had a tedancy to throw any letter looking like a DCA away when he lived there, I managed to convince him to get it sorted so it wasn't hanging over our heads.
  23. Hello! I sent Lowell's an SAR request - to which they complied, but it's just photocopies of a ton of letters that, a lot of which my fiancé never actually received. But anyway, that's fine and it gave us a bit more time to figure out what we were doing. They sent a letter today reminding us they sent the information - we're caught in in wedding planning so forgot to get back in contact with them. Now, I'm not sure what to do next - I was going to send a letter to Lowell's thanking them for their correspondence, but informing them we would now be dealing with the original creditor and wish to recieve no further contact from them unless otherwise stated, do you think that'll work? Or should I just write to them offering them £5/month (so £10 altogether, there's 2 accounts my fiancé owes on) I've read it's better to deal with original creditors, but if we tell them we're going direct (Shop Direct) will that get them off our backs or just make them mad? Help?
