  1. I wonder if anyone has lost an ET and had concerns that they were seriously stitched up? I lost my ET several months ago, which I've slowly come to terms with, hard as it was. Life goes on. I was recently forwarded an email from unknown source with attachment containing newspaper article about a barrister that had represented the government in an Enquiry about wrong doing in the Conservative party. Apparently the for-named barrister regularly represents the government in legal cases. It turns out this barrister was representing the respondent in my case, which I lost. Coincidence, I think not!! My case was against a public body! Need I say more!! I have no faith in the ET! Warning to others!!
  2. Very hard having to live with the fact that lies have been believed, especially with risk of costs order. Shameful really. Since read that incorrect judgements are reached in 20% cases. That's an awful lot of claimants having to live with the consequences. Very hollow victory for this company, especially when the liars are dependent on the long term support of a lot of employees. Could be tricky for them. Only takes one disgruntled employee! Very angry!
  3. Well I went through my very lengthy ET to have found out this last week that I lost my case!! Pretty soul destroying, when all through we'd been assured a strong case. Sadly the respondent and it's witnesses lied all the way through and the panel believed the untruths, which is shameful! Having been through it and looking back now I would have no faith in the system. Total farce!! Also, I can't believe a solicitor and barrister would build their case so massively on untruths! These are supposed to be professionals, although I know there are good and bad in every profession!! Shameful! Anyone experience similar? Still reeling from the shock of it!!!
  4. Thanks for providing positive response smokejumper. I'm not under any illusion and know that things often go against the claimant. It's important for me to have closure and will go all the way. At least I'll have the pleasure of dragging them through it. Had 4 CMDs, one over telephone.ET is at end of February.
  5. My claim isn't vexatious! Huge case with lots of procedural failures with evidence to back it up!
  6. Just wonder what your opinion is regarding my ET case. Just found out that my ex-employer has a large number of witnesses against little old me! They have witnesses providing the most ridiculous evidence, which really isn't relevant! Is this a common tactic? Annoying thing is that the time required for the hearing will all be adding to costs! Doesn't seem fair!
  7. I suffer acute anxiety and stress as a result of major surgery and treatment.
  8. I had a cancer diagnosis last year and have struggled to come to terms with it. Coupled with this I'm going through an ET claim, which is very stressful to say the least! I know that cancer sufferers are always recognised as having a disability. Will the ET take my cancer diagnosis and the anxiety and stress associated with cancer/ ET into account for the ongoing proceedings? I have a doctor's note detailing my health issues.
  9. What are the rules on text message evidence and other electronic evidence for the ET. My ex employer has provided text messages which have been typed up and I believe there are inaccuracies, omissions and additions. I've submitted screenshots for my text evidence, containing number/ name sender/ recipient! Can they be authenticated through service provider? Thanks
  10. Think you may've misunderstood my post Sweetlorraine! My case is long running and very complex. I haven't detailed a great deal in order to avoid recognition! Suffered the most horrendous bullying and harassment which has destroyed my health! My comment was regarding my intention to keep going and not be beaten by my ex- employer's behaviour! Got cover from my house contents insurance and case is strong because employer didn't follow their own procedures on a number of occasions! I know that an ET can be very unpredictable!
  11. Hello! My ET case is proceeding and looks like it will go all the way, as my ex-employer seems to be determined to have it that way. I have a case for constructive dismissal which has been allocated a two week tribunal next year. All my witnesses have been contacted by letter, but are choosing to ignore! They're all still employed by my ex-company and I've heard that pressure is being applied. Seems that they're very upset at being asked to support me! I can understand they fear for their jobs! What is the situation when witnesses don't provide a statement? Will there be an order to force attendance? It feels like the whole company is up against little old me! I can tell they think they've got strength in numbers! Feel angry!!! The boss thinks he's mr invincible! I suppose it'll end up 'them' with 20 witnesses and me with none! Odds are stacked against me before I even get there! Any thoughts? It's been ongoing for two years now, but I'm never beaten! Thanks xx
  12. Whistleblowing is definitely very bad for health! Although I've always been very resilient and worked relentlessly for many years in a tough job, the stress of the last few years has certainly had a big effect on health! Very scary, because could be life threatening!! I will continue with my ET case to try and 'right' a very serious 'wrong' and I'll never let these people get away with what they've done to me and my family! Of course, there's the wrong-doing as well that needs to be brought into the open. I get on with life now and try and enjoy every day! But in the background is this rather large thorn in my side! Never mind, my very loving family and sense of humour keep me going! Any thoughts on personal injury would be appreciated!
  13. Hello, My ET case will be in 2014 and is scheduled to last for 2-3 weeks. Been through a lot and as with a lot of whistleblowers, my health has suffered terribly. I presume my ET case won't take into account the long term effect on my health, which has been very serious!! I now struggle to work! Is personal injury claim also an option for me? Would there be a time limit on this? Also, I suppose there would be costs, but perhaps use a no win no fee solicitor? This would be through a different court I presume? Thanks! :-(:-(
  14. Is it possible to bring a personal injury claim in a whistleblowing case? My health has deteriorated due to the treatment i received following whistleblowing and the subsequent stresses of my ongoing case. Would claim be through the courts and would it be a lengthy process following ET case? Many thanks!
