  1. The debt was for a credit card. I am going to borrow the money from a friend to pay it off tomorrow. Is this the right thing to do? My main concern is I have a couple more defaults that are outstanding - could it lead to those creditors going for a CCJ too? I am not one to totally run from my debt, I would like to sort it all, and have paid so much back. It is just from a dark time in my life when addiction had a hold on me. .. the others are 1 loan I shouldn't have been able to get and a few payday loans. I think I will arrange paymeny of this tomorrow - as it will mean it will be removed from my credit file I believe?
  2. The claim form said £876.33 but I have just called the court and on their system is is £891.33... I thought I had 28 days to pay this from the date of the CCJ (30/07/2015) ? But the bailiff letter has put the amount as £970.58, obviously adding their fees already! The court said I can contact the solicitors who the debt is with to ask for a settlement amount, and they can then tell the bailiffs to stop all action? Is that correct?
  3. If I had received the County Claim form originally I could have dealt with it properly. Now the CCJ and Warrant have been issued I am in a real panic. I don't know whether to apply for an N244 or an N245 with the court. Would I even have enough time? The bailiff could visit my parent's home this week!! Or should I call the bailiff directly? Would they let me set up a repayment plan with them? Either way my credit file is now screwed as I will have a CCJ on there for the next 6 years
  4. Hello all, I really hope you can help me with how to handle this claim against me. It is regarding a Vanquis agreement from 19 May 2010. To cut a long story short, I was suffering from a gambling addiction and took out lots of payday loans and credit I could not afford. I have paid various debts back but could not afford all. I ended up with 5 defaults against me. With my credit file ruined, I kind of just buried my head in the sand, thinking I would have to wait a good 6 years to get back on track. I have lived in 5 addresses in the past 6 years. Without my knowledge, from nowhere, a County Court Claim form went to my old address (which belongs to my parent's). They do not open my post, and nothing important ever goes there. However, I dropped in last week and a claim had been sent. I could not contest it or even acknowledge it - I had missed the deadline by literally 2 days! When I logged in online, it said a CCJ was issued against me On Friday just gone, a further letter was received at my parents address - a NOTICE OF ISSUE OF WARRANT OF CONTROL It says on this letter that 'Unless you pay the amount due before 25 August 2015 the bailiff will call and may remove goods for sale at public auction' My elderly mother has opened this and is deeply scared. I have tried to do lots of research but do not know what my best option is. They are claiming £970.58 but I simply do not have this money or anyone to borrow that amount from. The original limit was £500 so I do not know why it is so high. I would have liked to have filed a defence, asking for proof of the debt etc as many people are succesful claiming against Cabot with Vanquis debt. I considered asking for it to be set aside, but I fear this will be declined? I did not update creditors with my various addresses. I have moved a number of times since then. If I ask for it to be set aside I fear wasting the £155 which I can ill afford. Or I could file an N245 to ask for a repayment plan? Is this still possible despite the Warrant being issued? I am really in a state of panic - my mum is in tears thinking the bailiffs will visit this week and take MY PARENTS goods to pay this old debt. I really hope someone can help...   5. Hi all - thanks for the comments so far. Indeed, they are outstanding debts. I would not be in a bad position if I had to pay them off - but I haven't heard ANYTHING from the debtors since they defaulted. I paid probably £1000 interest over a year on one of them - maybe that's why they are not bothered. I am not looking to get a mortgage in the very near future. I would love to in the next few years, but I am figuring I need to start working on my credit file NOW. Basically I would do whatever it takes to get the defaults removed, although I know it is not as simple as that. I just want to work out the best way forwards really...
  6. Hi all, A couple of years ago I was suffering from a gambling addiction, and got caught in the payday loan trap. For over a year now I have been clean from addiction and kept complete control of my finances. However, when I was struggling I picked up 3 defaults on Payday loans (although I did pay another 10 different companies back in full). They are on my credit file as defaults from 2010, and so will be with me until 2016. I am desperate to move on with my life and have taken many steps to try and improve my rating and kept all accounts up to date since 2010. I have decided to try and get the defaults removed - is this a stupid idea? I am about to send them all the template letter asking for true copies of agreements and the default notice etc. Will this achieve anything, and is it worth a shot? I would desperately love to pay them all back in full now, as it is only about £600 in total, but from what I gather, even if I pay them, the 3 defaults will remain and I will struggle to get any credit. My partner is desperate for us to get a mortgage, but it seems impossible with these defaults on there. Should I go ahead and send the template letters? I am worried they will just start harrassing me for payment again, and I will be in a no-win situation - apart from knowing I have paid all my dues for my previous addiction. Your help and advice is much appreciated.

It shows: Credit limit £770 Default date 28/09/2007 (SETTLED) Then there is a second entry (at my older address) from Lowell Portfolio, that shows: Current balance £750 credit limit £0 default date (01/09/2007) It seems Lowell bought the debt from Egg, but now I have two defaults on my file. I would love to get them removed somehow. I have a feeling they could both be unenforceable. I would pay them off in full if I could get them removed, but I guess that isn't possible either. Is there any steps I should take? I believe I should get one removed at least? But may have to wait until 2013 for them to drop off...?
  8. Hi all, I am desperately trying to clear up my credit file as I would like to get a mortgage as soon as possible. When I was a student I picked up quite a few stupid defaults by burying my head in the sand about a gambling addiction. I am fully recovered now, and very good with my money, but my credit file is so bad because of my old ways. I have two main defaults. One for £3000 with Capital One, with a default date of 6/4/2006 - so this should be deleted this week! My other one is with Egg. However, they placed two marks on my file for the same debt (Equifax).   9. Hi all, So, the court acknowledged my defence on the 28th February. Is there a date upcoming where, if I do not hear anything, they claim cannot be continued? I have not heard anything at all about this claim yet. I mean, I wrote to the claimant AND the claimant's solicitor almost 3 months ago, and heard nothing. I have now filed my defence to the court and still heard nothing....
  10. Hello again all, Here is an update: Today I received a letter from the court 'acknowledging receipt of my defence'. It now says a copy is being served to the claimant and the claimant my contact me directly to resolve any dispute. If unresolved informally, the claimant will inform the court they wish to proceed and the court will then inform me of what will happen. Where he wishes to proceed, the claimant must contact the court within 28 days of my defence or after that period the claim will be 'stayed'. The only action they could then take is applying for a judge to lift the order of stay. OK...!! So I guess I now just wait to see what the claimant comes up with against my defence that the debt is statute barred. Got a month of worry ahead, but am I really safe in the knowledge that the debt is definitely statute barred? Argh... once this is over I can move on with my life.... :/
  11. I sent my defence via email, after speaking to a telephone representative. I have never been able to use the MCOL service, I have never been able to login again after originally signing up. It is not the most straightforward of systems... in fact it is really annoying!
  12. I just wondered if anyone knows if there are any cut and dry rules to this. Like, because I filed late does that put me in a bad situation, or will it be OK because they claimant has not yet made any further actions...?

  14. Hi, I called the moneyclaim helpline. Basically they said I needed to file a defence. At the moment there has been no action from them either.... does this mean I will be OK? I have filed a defence now, stating the debt is statute barred and that I have contacted the claimant directly. Oh god... I feel like I am not going to sleep for weeks now worrying about this. Does anyone know... if they have not made any move or filed for a default judgement, now that I have put my defence in will it be ok? Or am I just completely ****ed because I filed my defence late anyway?
  15. Hi all.... this is still dragging on... I am sure this debt is statute barred. After following advice from this forum and others, I sent a letter directly to the claimant stating that the debt was statute barred. This was sent firstly to Robinson Way, and then to Hegarty LLP (the solicitors) after I had no response. It has been over 4 weeks since the letter was sent and I have had no response whatsoever. I have spoken to 'moneyclaimdotgov' and they have questioned why I have not filed a defence with them. They told me to file a defence. I spoke to Hegarty and they told me I should now just wait to see if their client, Robinson Way, will respond. I just wondered if there is anything I should be doing now. It is really hanging over me and I am constantly worrying about the claim. Any quick advice you may be able to give me would be greatly appreciated. Thank you all
